Based on part two of item 4 of article 236 of the Law of the Republic of Belarus of January 10, 2014 No. 129-Z "About customs regulation in the Republic of Belarus" and Item 9 of the Regulations on the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of June 20, 2013 No. 503, the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus DECIDES:

1. Approve the Instruction about procedure for issue of the conclusion about possibility of destruction of the goods intended for the room under customs procedure of destruction it (is applied).

2. Declare invalid the resolution of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus of December 21, 2007 No. 102 "About approval of the Instruction about procedure for issue by the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus for the conclusions about possibility of destruction on customs area of the Republic of Belarus of the goods intended for the room under customs regime of destruction" (The national register of legal acts of the Republic of Belarus, 2008, No. 32, 8/17887).

3. This resolution becomes effective after its official publication.

1. This Instruction determines procedure for issue of the conclusion about possibility of destruction of the goods intended for the room under customs procedure of destruction (further – the conclusion).

2. The conclusion is issued by territorial authority of the Ministry of Natural Resources and Environmental Protection (further – body of issue of the conclusion).

3. The conclusion is issued to person interested in destruction of the goods intended for the room under customs procedure of destruction, according to customs procedure of destruction and having the right to act as the customs applicant of this customs procedure according to the international treaties and acts constituting the right of the Eurasian Economic Union regulating customs legal relationship and the legislation of the Republic of Belarus on customs regulation (further if other is not established, - the interested person).

4. For receipt of the conclusion the interested person submits to body of issue of the conclusion the documents specified in Item 2 of Regulations of the ministerial procedure performed concerning subjects of managing according to subitem 6.35.1 "Receipt of the conclusion about possibility of destruction of the goods intended for the room under customs procedure of destruction", the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus approved by the resolution of January 14, 2022 No. 5.

5. The body of issue of the conclusion in case of consideration of the application accepts according to article 24 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures" one of the following executive decisions:

about refusal in adoption of the statement;

about issue of the conclusion;

about refusal in issue of the conclusion.

6. The decision on refusal in adoption of the statement is passed by body of issue of the conclusion in cases, the stipulated in Article 17 Laws of the Republic of Belarus "About bases of ministerial procedures".

7. The body of issue of the conclusion makes the decision on refusal in issue of the conclusion on the bases, the stipulated in Article 25 Laws of the Republic of Belarus "On bases of ministerial procedures".

8. In case of decision making about refusal in issue of the conclusion the interested person is notified about the made decision according to the procedure, the stipulated in Article 27 Laws of the Republic of Belarus "About bases of ministerial procedures".

9. The conclusion is drawn up on the form of body of issue of the conclusion in form according to appendix in duplicate, signed by the authorized officer of body of issue of the conclusion and certified by official stamp. One copy is issued to the interested person, the second – is stored in body of issue of the conclusion with the documents submitted by the interested person.

10. The decision on refusal in adoption of the statement or for refusal in issue of the conclusion can be appealed by the interested person according to the procedure, the stipulated in Article 30 Laws of the Republic of Belarus "About bases of ministerial procedures".
