1. Approve:

1) the minimum and maximum limits of the main remuneration of the temporary administrator, rehabilitation, interim and bankrupt managing directors according to appendix 1 to this order;

2) Rules of payment of the main remuneration of the temporary administrator, rehabilitation, interim and bankrupt managing directors according to appendix 2 to this order.

2. Recognize invalid:

1) the order of the Minister of Finance of the Republic of Kazakhstan of March 18, 2015 No. 183 "About approval of the minimum amount of the main remuneration of the temporary administrator and rehabilitation managing directors, and also the amount of the main remuneration of interim and bankrupt managing directors and rules of their payment" (it is registered in the Register of state registration of regulatory legal acts at No. 10808, it is published in information system of law of Ad_let on May 21, 2015);

2) the subitem 1) Item 1 of the order of the Minister of Finance of the Republic of Kazakhstan of December 30, 2016 No. 705 "About introduction of amendments to some orders of the Minister of Finance of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan at No. 14768, it is published in the information system "Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan" on February 17, 2017).

3. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of payment of the main remuneration of the temporary administrator, rehabilitation, interim and bankrupt managing directors

Chapter 1. General provisions

1. These rules of payment of the main remuneration of the temporary administrator, rehabilitation, interim and bankrupt managing directors are developed according to Item 1 of article 13 of the Law of the Republic of Kazakhstan of March 7, 2014 "About rehabilitation and bankruptcy" (further – the Law) and establish payment procedure of the main remuneration of the temporary administrator, rehabilitation, interim and bankrupt managing directors.

2. The main remuneration for the temporary administrator and the rehabilitation managing director is the monthly remuneration established by creditor meeting for the entire period of implementation of powers irrespective of its duration.

3. The main remuneration for the interim manager is the fixed monthly remuneration established by creditor meeting for the entire period of implementation of powers.

4. The main remuneration for the bankrupt managing director is the fixed monthly remuneration established by creditor meeting for carrying out insolvency proceeding without the term of its prolongation.

5. The amount of the main remuneration of the temporary administrator, rehabilitation, interim and bankrupt managing directors is determined in the limits set by authorized body according to Item 1 of article 13 of the Law.

Chapter 2. Payment procedure of the main remuneration to the temporary administrator

6. The amount of the main remuneration to the temporary administrator is determined on the first creditor meeting. The solution of creditor meeting is drawn up by the protocol.
