1. Approve the enclosed Rules of establishment and payment of monthly pension supplement to persons replacing the state positions of the Russian Federation.

Rules of establishment and payment of monthly pension supplement to persons replacing the state positions of the Russian Federation

1. These rules determine procedure for establishment and payment of monthly surcharge to insurance pension by old age (disability) granted according to the Federal Law "About Insurance Pensions" or to the pension which is ahead of schedule appointed according to the Law of the Russian Federation "About employment of the population in the Russian Federation" (further - monthly pension supplement), to persons replacing the state positions of the Russian Federation which provision of pensions is not settled by the relevant Federal Laws (the laws of the Russian Federation), other regulatory legal acts of the Russian Federation and which earned the monetary reward due to assignments of the federal budget.

2. Monthly pension supplement is established according to the statement of person applying for monthly pension supplement, the decision of the head of federal state body in which person replaced the state position of the Russian Federation before the termination of powers (including ahead of schedule) and in case of abolition (reorganization) of federal state body - the decision of the head of federal state body to which functions of the abolished (reorganized) federal state body are transferred. Monthly pension supplement to person dismissed from the abolished (reorganized) federal state body which functions are not transferred to other federal state bodies is performed by the Ministry of Labour and Social Protection of the Russian Federation (further - authorized state body).

3. The following documents are attached to the application for establishment of monthly pension supplement which is issued in form according to appendix No. 1,:

a) passport copy of the citizen of the Russian Federation;

b) copy of the service record;

c) in case of absence in the service record of the records confirming appointment (election) to the state position of the Russian Federation - the documents confirming the facts of appointment (election) to the specified position and dismissal (abdication);

d) the copy of the pension certificate or the certificate of provision of pensions from the body performing provision of pensions.

4. The application for establishment of monthly pension supplement is submitted by person replacing the state position of the Russian Federation or his representative.

In case of filing of application about establishment of monthly pension supplement through the representative passport copies of the representative and the document confirming it the power which is drawn up according to the procedure, established by the legislation of the Russian Federation are enclosed to the application.

The copies of documents specified in Item 3 of these rules make sure of the procedure established by the legislation of the Russian Federation. Not verified copies of documents are represented with presentation of originals and make sure the employee of authorized state body accepting documents.

Statements for suspension of payment of monthly pension supplement, renewal (recovery) of payment, the termination of payment and the documents attached to them move with observance of the requirements provided by paragraphs the first - third this Item, in the body performing provision of pensions of person replacing the state position of the Russian Federation.

5. The statement for establishment of monthly pension supplement is registered in day of its receipt in authorized state body.

Reception of an application and documents, stipulated in Item 3 these rules, is confirmed by the notification on their acceptance which is issued to person replacing the state position of the Russian Federation or his representative to their giving.

6. The authorized state body considers the arrived applications and documents, stipulated in Item 3 these rules, checks their completeness and reliability of the data containing in them.
