For the purposes of this Protocol:
a) "production" means any processing or conversion, including also creation and special transactions;
b) "material" means any ingredients, raw materials, components, parts and another that are used for production of product;
c) "product" means the made product, even such which will be used in other production operations;
d) "goods" mean both materials, and product;
e) "customs value" means the cost which is determined according to the Agreement on application of Article VII of the General agreement on tariffs and trade signed in Geneva on April 12, 1979;
f) "ex-works price" means the price which is paid for product of the plant where also last carried-out processing and conversion and the included cost of the used materials is considered, without all internal taxes which are compensated or can be compensated when exporting ready-made product;
g) "material cost" means customs value at the time of import of the used materials which do not come from the country, or if it is unknown or cannot be established, nachalno the determined price which was paid for these materials in the corresponding territory;
h) "material cost which occur from the corresponding territory" means customs value of the materials determined in the subitem g) that is applied with corresponding changes;
i) "value added" means factory price except for of customs value of each of products which are part of goods, and do not come from the country where these products were made;
j) "groups" and "line items" mean groups and line items of 4-unit code which is applied by the Harmonized system of the description and the coding of goods, in this Protocol designated as "The harmonized system" or "GS";
k) "classified" belongs to classification of product or material which is designated by the corresponding code;
l) "sending" means products which go from the exporter to the receiver and drawn up by one transport document which confirms its movement from the sender to the addressee, or, in the absence of such document - single invoice.
For the purpose of application of this Agreement and without breaking provisions of Articles 3 and 4 of this Protocol, the following products will be considered:
1. Products origin from Ukraine
- the products which are completely made in Ukraine as it is determined in Article 5 of this Protocol;
- the products made in Ukraine, containing materials which are not completely made in Ukraine provided that these materials underwent in Ukraine to sufficient processing and conversion as it is determined in Article 6 of this Protocol.
2. Products origin from Estonia
- the products which are completely made in Estonia as it is determined in Article 5 of this Protocol;
- the products made in Estonia, containing materials which are not completely made in Estonia provided that these materials underwent in Estonia to sufficient processing and conversion as it is determined in Article 6 of this Protocol.
