The consular convention between Ukraine and the Azerbaijan Republic

of March 24, 1997

Ukraine and the Azerbaijan Republic which hereinafter are referred to as further "Contracting parties",

being guided by desire to develop the consular relations with the purpose of more effective protection of the rights and interests of both states, their citizens and legal entities, consolidations of friendship and cooperation between Contracting Parties, on development of provisions Vienna conventions on the consular relations of April 24, 1963,

confirming that on questions which are not caused in this Convention, will be regulations of the international commonly accepted law and multi-lateral international treaties which participants are Contracting Parties will be applied,

decided to sign this Convention and agreed about the following:

Section I of Determination

Article 1

In this Convention the stated below terms make such sense:

"Consular establishment" determines any consulate general, consulate, vice-consulate, the consular agency or consular department of diplomatic representation.

"The consular district" determines the area allocated to consular establishment for accomplishment of consular functions.

"The head of consular establishment" determines person, it is entrusted to them to be effective in this quality.

"The consular official" determines any person, including the head of consular establishment to whom accomplishment of consular functions is entrusted in this quality.

"The consular employee" determines any person who carries out administrative or technical obligations in consular establishment.

"The worker of service personnel" determines any person who carries out obligations on servicing of consular establishment.

"Employees of consular establishment" determines consular officials, consular employees and workers of service personnel.

"Family member" determines the wife (husband), children, parents of the employee of consular establishment, and also other persons who live together with it and are on its content.

"The private house worker" determines person who stays only on private service of the employee of consular establishment.

"Citizen" determines any physical person who is citizen of the accrediting state or state of stay according to the legislation of these states.

"Consular rooms" determines houses or parts of houses and the parcel of land which services these houses or parts of houses which are used only for the purposes of consular establishment irrespective of whose property they are.

"Consular archives" determines all papers, documents, correspondence, books, movies, technical means of accumulating, storage and use of information, registers of consular establishment together with the codes and codes, card-indexes and any furnishings intended for ensuring their protection or storage.

"Vessel" determines any civil vessel which is registered in the accrediting state, and has the right to raising of flag of the accrediting state.

"Aircraft" determines any civil aircraft which is registered in the accrediting state and has the right to use identification marks of the accrediting state.

The Section II General provisions about the consular relations

Article 2 Opening of Consular Establishment

The consular establishment of one Contracting Party can be open in the territory of the second Contracting Party only in its consent.

The location of consular establishment, its class, the consular district, and also any changes are in this respect determined only by agreement between the accrediting state and the state of stay.

Article 3 Appointment and admission of the head of consular establishment

1. For appointment of the head of consular establishment the accrediting state shall receive prior consent of the state of stay. If the state of stay does not agree to it, it shall not explain motives of the decision.

2. The accrediting state transfers to the Ministry of Foreign Affairs of the state of stay the consular patent or the message on appointment of the head of consular establishment.
