About approval of the Procedure of complex planned actions of the state supervision (control)

Approve the Procedure of complex planned actions of the state supervision (control) which is applied.

Procedure of complex planned actions of the state supervision (control)

1. This Procedure determines the procedure of implementation of complex planned actions of the state supervision (control) in the sphere of economic activity (control) by state supervision bodies (further - complex action).

2. In this Procedure terms are used in the value given in the Law of Ukraine "About the basic principles of the state supervision (control) in the sphere of economic activity".

3. Complex actions are performed according to the plan of implementation of complex planned actions of the state supervision (control) of state supervision bodies (control) which affirms the order GFS and is published on its official site no later than November 15 of the year prior to planned.

4. Complex measures are performed by state supervision bodies (control) according to the Law of Ukraine "About the basic principles of the state supervision (control) in the sphere of economic activity".

5. The term of implementation of complex action cannot exceed ten working days, and concerning subjects of micro, small business - five working days.

6. For implementation of complex action each state supervision body (control) issues the order (the decision, the order) which shall contain the name of the subject of managing concerning which the action, and subject of complex action will be performed.

Based on the order (the decision, the order) the certificate (direction) on implementation of action is drawn up.

7. Before implementation of complex actions officials of each state supervision body (control) shall show to the head of the subject of managing - the legal entity, its separate division or to person (physical person entrepreneur or person authorized by it) authorized by it the certificate (direction) and the official ID certifying the official of state supervision body (control) and to provide to the subject of managing the copy of the certificate (direction).

Before implementation of complex actions the official of each state supervision body (control) brings in the magazine of registration of actions of the state supervision (control) (in the presence of such magazine at the company) record relatively:

Like form of complex action;

names of state supervision body (control);

numbers of the official ID, surname, name, middle name and position of the official of state supervision body (control) authorized on implementation of complex action;

date and number of the certificate (direction) on implementation of complex action;

term of implementation of complex action (start and end date of complex action).

8. By results of implementation of complex actions by each state supervision body (control) statements in duplicate are separately drawn up.

9. Each state supervision body (control) provides acquaintance of the subject of managing or person authorized by it with the relevant act during the last day of implementation of complex action taking into account working hours of the company identified by its employment policies and procedures.

In the last day of implementation of complex action two copies of such act are signed by officials of relevant organ of the state supervision (control) who performed it, and the subject of managing or person authorized by it if other is not provided by the law.

If the subject of managing does not agree with the act, it signs such act with notes.

Notes of the subject of managing on implementation of the state supervision (control) are integral part of the act of state supervision body (control).

In case of refusal the subject of managing from signing of the act of state supervision body (control) the official of such body makes the corresponding record in this act.

10. One copy of the act is handed to the head of the subject of managing of the legal entity, its separate division or person (physical person entrepreneur or person authorized by it) authorized by it in the last day of implementation of complex action, and the second is stored in state supervision body (control).

In case of refusal the subject of managing from receipt of copy of the act the second copy of the act goes to the subject of managing by the registered mail with the inventory of investment and the assurance of receipt within three working days after completion of complex action.
