About rules of sanitary safety in the woods

According to Article 60.3 of the Forest code of the Russian Federation the Government of the Russian Federation decides:

1. Approve the enclosed Rules of sanitary safety in the woods.

2. Recognize to invalid:

the order of the Government of the Russian Federation of June 29, 2007 No. 414 "About approval of Rules of sanitary safety in the woods" (The Russian Federation Code, 2007, No. 28, the Art. 3431);

Item of 8 changes which are made to acts of the Government of the Russian Federation concerning implementation of the separate powers by the Ministry of Natural Resources and Environmental Protection of the Russian Federation and Federal Forestry Agency approved by the order of the Government of the Russian Federation of November 1, 2012 No. 1128 "About introduction of amendments to some acts of the Government of the Russian Federation concerning implementation of separate powers by the Ministry of Natural Resources and Environmental Protection of the Russian Federation and Federal Forestry Agency" (The Russian Federation Code, 2012, No. 46, the Art. 6339).

Rules of sanitary safety in the woods

1. These rules establish procedure and conditions of the organization of implementation of measures of sanitary safety in the woods and the requirements aimed at providing sanitary safety in the woods during the using, protection, protection and reproduction of the woods.

2. Measures of sanitary safety in the woods include:

a) forest shelter division into districts;

b) state forest pathological monitoring;

c) carrying out forest pathological inspections;

d) prevention of distribution of harmful organisms;

e) other measures of sanitary safety in the woods.

3. Carrying out forest shelter division into districts is provided with Federal Forestry Agency.

4. Implementation of the state forest pathological monitoring is provided:

a) concerning the woods located on lands of forest fund - Federal Forestry Agency;

b) concerning the woods located on lands defenses and the safety which are in federal property - the corresponding federal executive bodies authorized in the field of defense, safety;

c) concerning the woods located on lands of especially protected natural territories of federal importance - the Ministry of Natural Resources and Environmental Protection of the Russian Federation;

d) concerning the woods located on the lands which are in property of subjects of the Russian Federation or municipalities - executive bodies of subjects of the Russian Federation or local government bodies respectively.

5. Carrying out forest pathological inspections and the prevention of distribution of harmful organisms are provided:

a) on the timberland provided in permanent (termless) use, lease - persons using the woods based on the project of development of the woods;

b) on the timberland which is not provided in permanent (termless) use, lease:

concerning the woods located on the lands which are in property of subjects of the Russian Federation or municipalities - executive bodies of subjects of the Russian Federation or local government bodies respectively;

concerning the woods located on lands of forest fund which implementation of powers on protection is transferred to public authorities of subjects of the Russian Federation according to part 1 of Article 83 of the Forest code of the Russian Federation, - executive bodies of subjects of the Russian Federation;

concerning the woods located on lands of forest fund which implementation of powers on protection is not transferred to public authorities of subjects of the Russian Federation according to part 2 of Article 83 of the Forest code of the Russian Federation, - Federal Forestry Agency;

concerning the woods located on lands of especially protected natural territories of federal importance - the Ministry of Natural Resources and Environmental Protection of the Russian Federation;

concerning the woods located on lands defenses and the safety which are in federal property - the corresponding federal executive bodies authorized in the field of defense, safety.

6. The procedure for forest shelter division into districts, procedure of the state forest pathological monitoring, procedure for carrying out forest pathological inspections, rules of implementation of actions for the prevention of distribution of harmful organisms are established by the Ministry of Natural Resources and Environmental Protection of the Russian Federation.

7. The documentary information obtained when implementing measures of sanitary safety in the woods specified in subitems "v" - "д" Item 2 of these rules, in accordance with the established procedure is submitted for entering into the state forest register.

8. When implementing measures of sanitary safety in the woods assessment of sanitary and (or) forest pathological condition of the woods is carried out according to the scale of categories of state of trees given in appendix No. 1.

9. Deterioration in sanitary condition of the wood lot or separate forest apportionment (or its parts) is increase in amount of trees of the following categories of state: the drying-out, fresh and old dead wood, fresh and old windfall, fresh and old windbreak.

Deterioration in forest pathological condition of the woods is increase in the area of the existing centers of harmful organisms.

Deterioration in sanitary and forest pathological condition is determined by comparison of the indicators containing in the relevant act of forest pathological inspection which form is established by the Ministry of Natural Resources and Environmental Protection of the Russian Federation to the indicators containing in the previous act of forest pathological inspection, and in case of lack of such act - by comparison to project data of the development of the woods approved in accordance with the established procedure.

10. In case of death of the woods or deterioration in their sanitary and forest pathological condition the measures of sanitary safety in the woods provided by these rules are performed.

In case of death of the woods or deterioration in their sanitary and forest pathological condition owing to emergency situations of natural and anthropogenous nature mitigation of consequences of such emergency situations is performed according to the Federal Law "About Protection of the Population and the Territories against Emergency Situations of Natural and Technogenic Nature" and other Federal Laws.
