About measures for radical enhancement of activities of law-enforcement bodies in the field of investigation of crimes

1. Consider the most important task of the Ministry of Internal Affairs of the Republic of Uzbekistan and its territorial subdivisions realization of the following main directions of increase in efficiency of investigation of crimes:

the first - strict ensuring the criminal procedure regulation guaranteeing that everyone, committed crime, will be subjected to just punishment and any innocent will not be made responsible;

the second - timely disclosure, comprehensive, complete and objective investigation of crimes, unconditional observance of priority of the rights, freedoms and legitimate interests of citizens, respect of their honor and advantage in case of production of inquiry and pretrial investigation;

third - ensuring authentic procedural independence of investigators and investigators, non-admission of illegal impact on them, unreasonable intervention in their activities;

the fourth - creation of worthy conditions for work of investigators and investigators for the purpose of effective realization of the tasks assigned to them, the solution of questions of their material and social security;

the fifth - widespread introduction in activities of expert and criminalistic divisions of law-enforcement bodies of the advanced criminalistic and scientific and technical means, and also modern forms and methods of work.

2. Determine that:

The investigative department under the Ministry of Internal Affairs of the Republic of Uzbekistan (further - Investigative department) is the independent division of the Ministry of Internal Affairs of the Republic of Uzbekistan accountable directly to the Minister of Internal Affairs of the Republic of Uzbekistan;

investigative divisions of law-enforcement bodies are a part of the system Investigative department, Investigative department under Management of ensuring public safety on transport of the Ministry of Internal Affairs of the Republic of Uzbekistan, investigation departments under the Ministry of Internal Affairs of the Republic of Karakalpakstan, Main Departments of Internal Affairs of the city of Tashkent and Tashkent region, the Departments of Internal Affairs of areas, investigative departments (departments, groups) under district (city) managements (departments) of internal affairs, and also departments of ensuring public safety on transport;

investigative departments under district (city) managements (departments) of internal affairs with the general number of staff at least 10 units are headed by deputy chiefs of district (city) managements (departments) of internal affairs;

investigative divisions in questions of the organization and implementation of inquiry and pretrial investigation submit and are accountable to higher investigative divisions and Investigative department, and in questions of service in law-enforcement bodies - according to the head of department of ensuring public safety on transport of the Ministry of Internal Affairs of the Republic of Uzbekistan, to the Minister of Internal Affairs of the Republic of Karakalpakstan, chiefs Main Departments of Internal Affairs of the city of Tashkent and Tashkent region, the Departments of Internal Affairs of areas, district (city) managements (departments) of internal affairs, and also departments of ensuring public safety on transport;

intervention in activities of investigative divisions of law-enforcement bodies, and is equal impact in any form on their employees with the purpose to prevent implementation of the powers by them, and also non-execution of their resolutions obligatory for execution, attracts the responsibility established by the law;

appointment to positions of investigators of Investigative department, investigation departments under the Ministry of Internal Affairs of the Republic of Karakalpakstan, Main Departments of Internal Affairs of the city of Tashkent and Tashkent region and the Departments of Internal Affairs of areas is performed in the presence of length of service as the investigator at least three years;

criminal cases concerning investigators, investigators and heads of investigative divisions of law-enforcement bodies are initiated by the prosecutor of the Republic of Karakalpakstan, prosecutors of the city of Tashkent, areas and prosecutors equated to them, and concerning investigators, division managers and the chief of Investigative department - the Attorney-General of the Republic of Uzbekistan or his deputies.

3. Create in structure:

Investigative department department of coordination and control of work of inquiry, investigative department under Management of ensuring public safety on transport of the Ministry of Internal Affairs of the Republic of Uzbekistan, investigation departments under the Ministry of Internal Affairs of the Republic of Karakalpakstan, Main Departments of Internal Affairs of the city of Tashkent and Tashkent region and the Departments of Internal Affairs of areas departments (departments, groups) coordination and control of work of inquiry;

investigative departments (departments) under district (city) managements (departments) of internal affairs, departments of ensuring public safety on transport of department (group) of inquiry.

Determine that departments (departments, groups) coordination and control of work of inquiry and department (group) of inquiry are staffed by the employees having the higher legal education.

To the Ministry of Internal Affairs of the Republic of Uzbekistan following the results of 2017 to make offers on optimization of the number of staff of departments (groups) of inquiry and increase in efficiency of their activities taking into account the analysis of their office loading.

4. Approve:

Regulations on Investigative department under the Ministry of Internal Affairs of the Republic of Uzbekistan according to appendix No. 1.

6. To provide to the Ministry of Internal Affairs together with the Ministry of development of information technologies and communications and the Ministry of Finance of the Republic of Uzbekistan till January 1, 2018:

creation in law-enforcement bodies of special rooms with equipment by their systems of shorthand of interrogation, video surveillance, and also audio-and video fixing of investigative actions;
