The treaty of friendship, cooperation and partnership between Ukraine and the Azerbaijan Republic

of March 16, 2000

Ukraine and the Azerbaijan Republic, further "the Contractual Parties", confirming the arrangement to the principles of the Charter of the UN of the Gelsinsky Final act, the Parisian charter for new Europe and other documents concerning the European cooperation,

being based on the reached level of strategic partnership, political mutual understanding and development of cooperation in economic, humanitarian, trade, cultural and other spheres,

being sure that traditional friendly relations between two people will create necessary conditions for further development of strategic cooperation,

realizing that further development and consolidation of the friendly relations are equitable to fundamental interests of the people of both states,

aiming at creation of the democratic constitutional state based on the commonly accepted standards of human rights, the principles of market economy and supremacy of law,

attaching importance to collateral actions on the international scene for the purpose of consolidation of safety, stability and trust in world, European and regional context,

aiming to make contribution to reorganization of new Europe combined by general values of democracy, freedom and the constitutional state

noting importance of interaction, as at the bilateral and multilateral level, in consolidation of sovereignty, independence of territorial integrity, inviolability of borders of each other,

agreed about it:

Article 1

The contractual Parties will develop the relations as the friendly states based on the strategic partnership directed to the 21st century.

The contractual Parties shall be guided by the principles of mutual respect for their sovereignty and independence, equality and non-interference to internal affairs of each other, nonuse of force or threat of force, including economic and other methods of pressure, territorial integrity, inviolability of borders, peaceful settlement of disputes, respect of human rights and fundamental freedoms, fair accomplishment of the undertaken obligations, and also other rules of international law.

Article 2

The contractual Parties will promote further development of political, commercial, social, cultural ties which are based on the principles of mutually beneficial cooperation and mutual trust.

Article 3

The contractual Parties will make common efforts for consolidation of international peace, stability, safety, attaching special significance to consolidation of regional security and trust.

The contractual Parties will closely cooperate within the international, regional and subregional organizations and structures, and also will use the mechanism of consultations at the different levels will exchange the relevant information.

The contractual Parties will provide mutual support in the course of integration of two countries to the European structures, and also deepening of cooperation with Euro-Atlantic structures.

Article 4

The contractual Parties will cooperate and will provide support, according to rules of international law, both on bilateral and on multilateral basis, the effort of each other directed to consolidation of their sovereignty, territorial integrity, immunity of borders.

Article 5

In case of situation which creates threat of the world, commits breach of the peace or violates vital interests of safety of one of the Contractual Parties each of the Contractual Parties can address other Contractual Party with the offer on carrying out urgent consultations.

The contractual Parties will aim at approval of the relevant activities for overcoming such situation both on bilateral and on multilateral basis.

Article 6

The contractual Parties prohibit and prevent creation in the territory of the organizations and groups which represent threat of sovereignty, independence and territorial integrity of other Contractual Party.

Article 7

The contractual Parties not allow uses of the territory for implementation of acts of aggression and other violent actions against other Contractual Party.

Article 8

The contractual Parties note need of further development and consolidation of partnership within the advisory forum GUUAM and state intention to enhance and strengthen the mechanism of permanent consultations and interaction.

Article 9

The contractual Parties will make efforts for development of cooperation in the field of the industry, power, production and oil transportation and gas, use of natural resources, environmental protection, work and social policy, transport, communications and other areas.

The contractual Parties provide each other the mode of the greatest assistance in trade and economic, financial and credit and customs areas and will aim at the fastest creation of the free trade area.

Article 10

The contractual Parties will promote development of cooperation of the state and private enterprises, other subjects of housekeeping. The contractual Parties will take adequate measures for encouragement of investments of legal entities and physical persons of both states.

Article 11

The contractual Parties will promote free passing of passengers and loads of other Contractual Party through sea, river, air ports, networks railway and highways which are in their territory. The contractual Parties will cooperate in the development and enhancement of infrastructures connected with transit and transport communications and other areas of transport according to the existing international treaties which participants are both Contractual Parties, and also to the legislation of the Contractual Parties.

Article 12

The contractual Parties will communicate and will sign free standing agreements concerning trade and economic, sci-tech cooperation, and also monetary and price policy.

Article 13

The contractual Parties, realizing important role of investments in development of economy of both countries, will create favorable conditions for capital investments and exchange of technologies.

Article 14

The contractual Parties, paying special attention to cooperation in the field of agricultural industry and providing with food, will sign free standing agreements in this area for the purpose of its development.

Article 15

The contractual Parties will comprehensively promote preserving historical and cultural heritage and will develop direct connections in areas of culture, education, literature, art, health care, publishing, cinema, radio, television, tourism and sport.

Article 16

The contractual Parties confirm readiness to create conditions for full access to use of language, historical and cultural heritage, literature of other Contractual Party.
