About cooperation in the field of quarantine of plants

The governments of the State Parties of this agreement which further are referred to as with the Parties

proceeding from provisions of the International convention on quarantine and protection of plants against December 6, 1951 in edition of 1997 (further – the Convention), and also other international treaties in the field of quarantine of plants,

expressing intention to continue cooperation in the field of quarantine of plants,

recognizing importance of cooperation for the purpose of prevention of drift and distribution of quarantine objects when implementing contacts and development of economic and commercial intercourses within the Commonwealth of Independent States,

agreed as follows:

Article 1

For the purposes of this agreement the main terms having the following values are used:

quarantine objects (quarantine harmful organism) – the harmful organisms which are absent or restrictedly extended in the territories of the State Parties of this agreement and brought in national lists of quarantine objects and (or) in other lists of quarantine objects provided by international treaties between the State Parties of this agreement;

phytosanitary quarantine control (supervision) – the activities of authorized bodies in the field of quarantine of plants directed to identification of quarantine objects, establishment of quarantine phytosanitary condition of quarantine products, accomplishment of the international obligations and the legislation of the State Parties of this agreement in the field of quarantine of plants;

disinfecting – set of the actions concerning quarantine products directed to destruction of quarantine objects;

the quarantine products (quarantine freights, quarantine materials, quarantine goods) – plants, products of plant origin, loads, the soil, organisms, materials, container, packaging which can be carriers of quarantine objects and (or) promote their distribution and concerning which acceptance of quarantine phytosanitary measures when moving through customs border is necessary and on customs areas of the State Parties of this agreement;

quarantine products of high phytosanitary risk – quarantine products which according to the list of quarantine products of the State Party of this agreement are carried to quarantine products with high phytosanitary risk;

quarantine products of low phytosanitary risk – quarantine products which according to the list of quarantine products of the State Party of this agreement are carried to quarantine products with low phytosanitary risk;

authorized bodies – the state bodies and/or the organizations of the State Parties of this agreement given the Parties authority on implementation of phytosanitary quarantine control (supervision).

Article 2

Subject of this agreement is the cooperation of the Parties in the field of quarantine of plants, development of joint efforts on increase in quarantine phytosanitary safety and level of security of the territories of the State Parties of this agreement from drift and distribution of quarantine objects, to decrease in the losses caused by them, and also removal of obstacles in international trade in the quarantine products which are subject to phytosanitary quarantine control (supervision).

Article 3

The realization of this agreement is enabled by authorized bodies which list is determined by each Party and is transferred to depositary in case of delivery of the notification on accomplishment of the interstate procedures necessary for the introduction of this agreement to force.

In case of change of authorized body or its name the relevant Party within 30 days informs on it depositary which notifies on it other Parties.

Article 4

Coordination of joint activities of the authorized bodies performing scientific and methodical management, coordination of the research works which are carried out by the Parties in the field of quarantine of plants and also development together with authorized bodies and research institutions of the State Parties of this agreement of drafts of regulating documents, instructions and recommendations about questions of quarantine of plants are assigned to Coordination council on quarantine of plants of the State Parties of the CIS.

Article 5

The parties through the authorized bodies exchange:

information on identification and distribution of quarantine objects in the territories of their states, and also about the phytosanitary measures and measures of fight against quarantine objects taken in this regard;

regulatory legal acts in the field of quarantine of plants and other documents regulating import and export of quarantine products, this about results of scientific research in the field of quarantine of plants.

Based on arrangements and according to the existing procedures of the Party:

perform joint research operations, including carrying out inspections, perform exchange of agents of biological fight and collections of quarantine objects in the research and diagnostic purposes, carry out testing of pheromones of quarantine objects;

give each other scientific and technical help in area of quarantine of plants.

Article 6

Provisions of this agreement extend to all quarantine products which are imported/exported on the territory/territory of one of the State Parties of this agreement including arriving as gift or for the scientific purposes, and also intended for diplomatic, consular and other representations.

Authorized bodies carry out phytosanitary quarantine control (supervision) of quarantine products when importing, exporting and transit of quarantine products according to the legislation of the State Parties of this agreement.

Each batch of quarantine products of high phytosanitary risk imported from the territory of one State Party of this agreement on the territory of other State Party of this agreement shall conform to phytosanitary requirements in the field of quarantine of plants of the importing State Party of this agreement and be followed by the phytosanitary certificate of the sample established by the Convention issued by authorized body of the exporting State Party of this agreement. Import of quarantine products of low phytosanitary risk from the territory of one State Party of this agreement on the territory of other State Party of this agreement is performed without maintenance by the phytosanitary certificate.

Availability of the phytosanitary certificate does not exclude the right of the Parties to carry out phytosanitary quarantine control (supervision) of quarantine products according to national phytosanitary requirements.
