According to the laws of Ukraine "About heat supply", "About state regulation in the field of utilities", "About licensing of types of economic activity" and "About the National commission performing state regulation in the field of power and utilities" the National commission performing state regulation in spheres of power and utilities decides:

1. Approve Licensed conditions of implementation of economic activity in the field of heat supply which are applied:

Licensed conditions of implementation of economic activity on production of heat energy;

Licensed conditions of implementation of economic activity on transportation of heat energy by the high-level and local (distribution) thermal networks;

Licensed conditions of implementation of economic activity on delivery of heat energy.

2. The term during which the licensees performing economic activity on production of heat energy on combined heat and power plants, thermal power plant, the NPP, cogeneration installations and installations with use nonconventional or renewable energy resources and/or production of heat energy (except activities for production of heat energy on combined heat and power plants, thermal power plants, nuclear power plants and cogeneration installations and installations with use nonconventional or renewable energy resources), and/or transportation of heat energy by the high-level and local (distribution) thermal networks and/or on delivery of heat energy, shall bring the economic activity into accord with requirements of this resolution and file to body of licensing documents and data determined by part three of article 15 of the Law of Ukraine "About licensing of types of economic activity" constitutes two months from the effective date of this resolution.

3. This resolution becomes effective from the date of, its publication following behind day in the official printing publication - the Pravitelstvenny Kuryer newspaper.

Licensed conditions of implementation of economic activity on production of heat energy

1. General provisions

1.1. These Licensed conditions are developed according to the laws of Ukraine "About heat supply", "About state regulation in the field of utilities", "About licensing of types of economic activity", "About the National commission performing state regulation in the field of power and utilities".

1.2. The licensee shall fulfill requirements of these Licensed conditions, and the license applicant - it to correspond.

1.3. In these Licensed conditions terms are used in the following values:

installed capacity of production facilities - the amount of rated power of all heatgenerating installations which are on objects in the field of heat supply which are intended for production of heat energy and are in concession, property or use of the licensee (license applicant), determined in Gcal/h respectively in technical data sheets of the heatgenerating installations (or other documents) confirming their technical characteristics;

policy tool of economic activity - the heatgenerating installation established on object in the field of heat supply intended for production of heat energy (taking into account the changes in documents given the licensee in the procedure established by these Licensed conditions);

information - any data and/or data which can be kept on material carriers or are reflected in electronic form, the reporting;

the place of implementation of activities - the object arrangement territory in the field of heat supply where the heatgenerating installations within which production of heat energy is made and which is noted in the sheet about places of implementation of economic activity on production of heat energy are placed (taking into account the changes in documents given the licensee in the procedure established by these Licensed conditions);

cross subsidizing - movement of the income from implementation of economic activity on production of heat energy for financial support of other type of economic activity within one subject of managing.

Other terms provided in these Licensed conditions are used in the values given in the laws of Ukraine "About heat supply", "About licensing of types of economic activity", the Instructions for use heat energy approved by the resolution of the Cabinet of Ministers of Ukraine of October 03, 2007 No. 1198, and Rules of technical operation of the thermal installations and networks approved by the order of the Ministry of Fuel and Energy of Ukraine of February 14, 2007 No. 71.

1.4. The national commission performing state regulation in spheres of power and utilities (further - NKREKP), performs licensing of economic activity on production of heat energy of subjects of managing if the subject of managing:
