According to part 16.1 of article 34 of the Federal law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" Government of the Russian Federation decides:

1. Approve enclosed:

Rules of the conclusion of contracts which subject is at the same time performance of works on designing, construction and commissioning of capital construction projects;

Regulations on carrying out technological and price audit of reasons for the investments performed in investment projects on creation of capital construction projects concerning which the conclusion of contracts which subject is at the same time performance of works on designing, construction and commissioning of capital construction projects is planned;

changes which are made to acts of the Government of the Russian Federation.

2. Determine that:

financing of the expenses connected with preparation of reasons for the investments performed in investment projects on creation of capital construction projects of federal property concerning which the conclusion of contracts which subject is at the same time performance of works on designing, construction and commissioning of capital construction projects (further - respectively the contract, the investment project, reasons for investments) is planned and carrying out technological and price audit of reasons for investments is performed by the federal executive bodies which are the state customers of such objects within the budgetary appropriations of the federal budget allocated for their current maintenance. Financing of the expenses connected with preparation of reasons for investments and carrying out technological and price audit of reasons for investments concerning investment projects on creation of capital construction projects of state-owned property of the subject of the Russian Federation or municipal property concerning which the conclusion of contracts is planned is performed according to the procedure, determined by regulatory legal act of the subject of the Russian Federation or local government body;

preparation of reasons for investments and carrying out technological and price audit of reasons for investments for the purpose of the conclusion of the contract is not required if concerning the investment project public technological and price audit of the large investment project with the state participation according to the procedure, No. 382 provided by the order of the Government of the Russian Federation of April 30, 2013 "About carrying out public technological and price audit of large investment projects with the state participation and about introduction of amendments to some acts of the Government of the Russian Federation" is booked.

3. To the Ministry of Construction and Housing and Communal Services of the Russian Federation till July 1, 2017 to approve:

standard form of the conclusion of technological and price audit of reasons for investments and requirement to execution of such conclusion;

procedure for maintaining the register of the issued conclusions of technological and price audit of reasons for investments and provision of information containing in the register concerning investment projects which technological and price audit of reasons for investments is booked by the Ministry of Construction and Housing and Communal Services of the Russian Federation or subordinated to it state (budget or autonomous) organization;

response form concerning the reasons for investments represented during its public discussion, and also the requirement to format of response and procedure for its representation;

standard form of design assignment of capital construction project and requirement to its preparation.

4. This resolution becomes effective since July 1, 2017, except for Item 3 of this resolution which becomes effective from the date of official publication of this resolution.

1. These rules establish procedure and the bases of the conclusion of contracts which subject is at the same time performance of works on designing, construction and commissioning of capital construction projects (further - the contract).
