For the purpose of enhancement of implementation process of assets (property) of insolvent banks and being guided by Item 10 parts one, part five Items 1-1 and 2, part six of article 12 of the Law of Ukraine "About system of guaranteeing household deposits", and also implementation of requirements of part nine of Article 38 and article 51 of the Law of Ukraine "About system of guaranteeing household deposits" and providing the rights and the interests of potential buyers of assets (property) of banks protected by the law which are removed from the market or are liquidated, executive directorate of Fund of guaranteeing household deposits of RESHILA:

1. Approve Regulations on the commission on consideration of claims and preparation of offers on the organization and carrying out open tenderings (auctions) for asset sale (property) of banks which are removed from the market or are liquidated which is applied.

2. To department of the consolidated asset sale in 10-day time from the date of entry into force of this decision to prepare the draft of the order of Fund of guaranteeing household deposits on creation and statement of structure of the commission on consideration of claims and preparation of offers on the organization and carrying out open tenderings (auctions) for asset sale (property) of banks which are removed from the market or are liquidated.

3. To provide to department of strategy and normative and methodological providing together with legal department submission of this decision to the Ministry of Justice of Ukraine for state registration.

4. To provide to department of public relations and financial education placement of this decision on the official page of Fund on the Internet after its state registration.

5. This decision becomes effective from the date of, its official publication following behind day.

6. I reserve control over the implementation of this decision.

Regulations on the commission on consideration of claims and preparation of offers on the organization and carrying out open tenderings (auctions) for asset sale (property) of banks which are removed from the market or are liquidated

I. General provisions

1. This Provision is developed according to the Law of Ukraine "About system of guaranteeing household deposits" (further - the Law), regulatory legal acts of Fund of guaranteeing household deposits (further - Fund).

2. This Provision determines organizational and procedural bases of activities of the commission on consideration of claims and preparation of offers on the organization and carrying out open tenderings (auctions) for asset sale (property) of banks which are removed from the market or are liquidated (further - the Commission), and also the rights and obligations of her members, the secretary of the Commission.

3. The commission is permanent collegiate organ under Fund which is created and liquidated according to the decision of executive directorate of Fund.

4. Material logistics of activities of the Commission performs Fund.

II. main objectives of the commission

1. The main objectives of the Commission are:

1) consideration of claims on the organization and carrying out open tenderings (auctions) for asset sale (property) of banks which are removed from the market or are liquidated, arrived in Fund, and decision making by results of consideration of such claims;

2) development of recommendations for the purpose of enhancement of process of the organization and carrying out open tenderings (auctions) and the direction of their executive directorate of Fund, to structural divisions of Fund, the administrator of electronic trading system (further - the administrator);

3) acceptance by results of consideration of claims (addresses) of measures for the prevention and elimination of violations of normative and legal and internal documents of Fund, the regulations of work of electronic trading system on the organization and carrying out open tenderings (auctions) for asset sale (property) of insolvent banks (further - regulations of ETS).

2. The commission carries out other tasks assigned to it by Regulations of ETS and/or regulatory legal acts of Fund.

III. structure of the commission, right, obligation and responsibility of her members, secretary of the commission

1. The commission chairman, his deputy and members of the commission are part of the Commission.

2. The personal and quantitative structure of the Commission affirms the order of Fund and is created taking into account the main objectives of the Commission. Changes in quantitative and staff of the Commission are brought by the order of Fund.

3. The chairman, and in case of its absence - the vice-chairman or person who by order of fulfills duties of the vice-chairman of the Commission is presiding over commission sessions.

4. In case of absence of one of members of the commission - representatives of Fund (leave, business trip, the period of temporary disability simple) execution of its obligations (with voting power) it is assigned to his deputy (person, authorized to fulfill its duties according to the order of Fund).

5. Responsible person for the organization of activities of the Commission is the secretary of the Commission who is determined in the order of Fund along with statement of personal and quantitative structure of the Commission. In case of absence of the secretary of the Commission (leave, business trip, the period of temporary disability, simple) execution of its obligations is assigned to person determined by the order of Fund on statement of personal and quantitative structure of the Commission.

6. Treats powers of the Commission:

1) the address in the procedure established by the legislation for receipt of consultations and expert opinions in state bodies, the experts and specialists having special knowledge through the corresponding coordinators in Fund (in the presence).
