About approval of the Instruction about the organization of transfer to lease and the conclusions of lease agreements of personal military estate

1. Approve the Instruction about the organization of transfer to lease and the conclusions of lease agreements of personal military estate which is applied.

2. Declare invalid the order of the Ministry of Defence of Ukraine on August 3, 2012 No. 514 "About approval of the Instruction about the organization of transfer to lease and the conclusions of lease agreements of personal military estate", registered in the Ministry of Justice of Ukraine on August 30, 2012 on No. 1465/21777.

3. This order becomes effective from the date of its official publication.

The instruction about the organization of transfer to lease and the conclusions of lease agreements of personal military estate

I. General provisions

1. This Instruction determines the mechanism of transfer to lease and the conclusions of lease agreements of personal military estate (further - personal military estate) which without damage of combat and mobilization readiness of troops (forces) is offered to transfer to lease by military units, institutions, organizations and the organizations of the Armed Forces of Ukraine (further - military units) which are registered as business entities in the Armed Forces of Ukraine and directly perform economic activity on transfer to lease of personal military estate.

2. The personal military estate, except for arms, small arms and ammunition, the military and special equipment provided that it will not do harm to combat and mobilization readiness (does not influence completeness, timeliness and quality of accomplishment of the tasks set for military unit in peace time and the special period), and also observance of requirements of the legislation on the state secret can be leased.

II. Forming of lists of personal military estate

1. The basis for transfer to lease of personal military estate is the list of personal military estate approved by the Minister of Defence of Ukraine which is offered to transfer to lease (further - the List).
