About approval of the Code of medical ethics of the health worker and druggist

Based on Item l) parts (1) article 17 of the Law No. 264-XVI of October 27, 2005 on profession of a physician (The official monitor of the Republic of Moldova, 2005, Art. No. 172-175, 839), with subsequent changes and amendments, for the purpose of accomplishment of the Action plan for 2016 on realization of National anti-corruption strategy for 2011-2016 approved by the Resolution of Parliament No. 90 of May 12, 2016. (The official monitor of the Republic of Moldova, 2016, Art. No. 184-192, 405), the Government DECIDES:

Approve the Code of medical ethics of the health worker and druggist it (is applied).

Code of medical ethics of the health worker and druggist

Chapter I. General provisions. Subject, purpose and sphere of regulation

1. The code of medical ethics of the health worker and druggist (further – the Code) regulates regulations of professional behavior, the basic ethical principles and moral values according to which the profession of the health worker and druggist in the territory of the Republic of Moldova is performed.

2. This Code pursues the following aims:

a) setting standards of professional behavior of health workers and druggists of the Republic of Moldova;

b) increase in prestige and strengthening of the authority of profession of the health worker and druggist;

c) establishment of single standards of behavior for all health workers and druggists;

d) informing citizens on standards of behavior by which all health workers and druggists of the Republic of Moldova shall be guided.

e) prevention of possible moral violations.

3. The code expresses joining of health workers and druggists to the Universal Declaration of Human Rights accepted by the General Assembly of the United Nations on December 10, 1948, the Convention on the human rights protection and fundamental freedoms accepted on November 4, 1950 in Rome, to other international treaties and conventions which party the Republic of Moldova is and is implemented by means of the following tasks:

a) protection of the rights of patients;

b) observance of professional obligations;

c) acceptance of the corresponding behavior by all members of medical community;

d) protection of advantage and prestige of profession of the health worker and druggist.

4. This Code is applied to all health workers and druggists of the Republic of Moldova who perform activities as individually, and within the legal entities providing medical services or giving help in pharmaceutical area irrespective of form of business and type of property.

5. Regulations of this Code are based on provisions of the legislation of the Republic of Moldova, international treaties and conventions which party the Republic of Moldova is, at the same time provisions of the regulations regulating professional activity of the health worker and druggist are not excluded or replaced.

Chapter II. The principles of behavior in medical and pharmaceutical activities

6. The health worker and the druggist shall be example of ethic and professional behavior.

7. When implementing profession the health worker and the druggist are guided by the following principles:

1) professionalism:

a) the health worker and the druggist shall fulfill the job responsibilities responsibly, competently, effectively, quickly and correctly;

b) the health worker and the druggist when implementing profession give priority to interests of the patient which prevail over other interests;

c) the health worker and the druggist shall show the maximum vigilance when rendering medical services, not allow the expected complications at the patient who is under its observation;

d) implementation by the health worker or druggist of the actions degrading profession of the doctor is forbidden. Health workers and druggists shall abstain, including in time off, from the acts compromising image of the health worker;

2) professional independence – the health worker and the druggist use professional independence, freedom of medical instructions and acts which considers necessary, within the approved standards, with prohibition of judgments of benefit of economic or administrative nature;

3) honesty:

a) the health worker and the druggist shall perform medical acts correctly according to the received professional qualification;

b) when implementing profession the health worker and the druggist shall show respect for the human person, be effective and discuss frankly and correctly any questions;

4) decency:

a) the health worker and the druggist shall support physical and mental health of the person, propagandize healthy lifestyle, prevent diseases and alleviate suffering, respecting the right to life and advantage of the human person, without discrimination on signs of age, sex, race, ethnic origin, language, religion, nationality, social conditions, ideology, political affiliation or for any other reasons both in peace, and in wartime;

b) the health worker and the druggist shall create and maintain the professional relations with other health workers and druggists;

5) respect and acceptance:

a) when implementing profession the health worker and the druggist shall show tolerance, attention and understanding in relation to other people, to their opinion and values;

b) the relation of the health worker and druggist with patient and his legal representative shall be based on mutual respect, trust, confidentiality and tolerance;

c) the respect for the person does not stop also after his death;

6) responsibility, goodwill and care:

a) when implementing medical activities the health worker and the druggist assume complete responsibility for the made decisions;

b) the health worker and the druggist when implementing medical activities shall pay special attention to quality of the medical act, wellbeing of the patient and provision of care at the highest level;

c) the health worker and the druggist shall participate in continuous training;

d) the health worker and the druggist has the right to cooperate and interact with colleagues for the benefit of wellbeing of the patient;

7) trust – professional qualification and moral level of the health worker and druggist shall inspire trust in patients;

8) confidentiality – the health worker and the druggist shall keep confidentiality of information on the state of health of patients which became to professional activity, known in the course of implementation;

9) loyalty:

a) the health worker and the druggist act honesty in organization in which performs the activities, and also in the relations with the patient;
