According to part three of article 10 of the Agreement between the Government of Ukraine and the Government of the Republic of Belarus about guarantees of the rights of citizens in the field of provision of pensions of December 14, 1995 (further - the Agreement) the Pension fund of Ukraine and Social Security Fund of the population of the Ministry of social protection of the Republic of Belarus (further - the Parties) agreed about it:

General provisions

Article 1

According to part three of article 8 of the Agreement in case of resettlement of the pensioner from the territory of one state on the territory of another where under available conditions pension is not provided by the legislation, the state from where the pensioner moved, till that time continues to pay it until he has pension entitlements according to the legislation of the state on which territory he moved.

Transfer of pensions is made by both Parties.

Article 2

According to article 9 of the Agreement of disability pension and in case of loss of the supporter owing to labor mutilation are appointed and paid according to the legislation of the state in the territory of which the labor injuries, at the expense of means of the relevant Party were sustained.

Disability pensions and in case of loss of the supporter owing to occupational disease are appointed and paid according to the legislation which extended to workers during implementation of labor activity which led to this disease irrespective of in the territory of what state this disease was for the first time revealed, at the expense of means of the relevant Party.

Transfer of pensions is made by both Parties.

Article 3

Transfer of pensions, is performed only on condition of resettlement of the pensioner from the territory of one state on the territory of another for permanent residence.

Article 4

Transfer of pensions is made by the Parties into accounts of the servicing banks in US dollars at currency rate which is established respectively by the National Bank of Ukraine and National Bank of the Republic of Belarus on the date of transaction implementation.

Pension payment is carried out in national currency of the state in the territory of which constantly lives the receiver of pension.

Article 5

Payment of the help on burial and the pensioner of pension amount half-received in connection with death is carried out at the expense of means of the Party which financed pension payment.

Article 6

Transfer of pensions is made quarterly not later than the 10th day of the third month of quarter for which payment is carried out.

Article 7

Transfer of pensions is made since month to which pension was paid in the previous place of residence, but it is no more than in six months from that month in which the citizen addressed for pension.

Procedure for transfer of pensions

Article 8

Transfer and pension payment are performed based on the statement of the pensioner.

The pensioner can submit the application for transfer of pension for choice:

- in bodies which perform provision of pensions, in the previous place of permanent residence;

- in Social Security Fund of the population of the Ministry of social protection of the Republic of Belarus;

- in the Pension fund of Ukraine.

After in bodies which perform provision of pensions the statement for transfer of pension abroad arrives, pension payment in the previous place of residence stops, and pension case of the applicant with indication of the term on which pension is paid, and the mentioned statement are sent to the relevant Party which will finance pension payment.

In case of the address of the pensioner with the statement for transfer of pensions directly to one of the Parties, this Party independently requests pension case of the applicant.

The party which received pension case of the pensioner from the second Party and recognized the right to transfer of pension abroad prepares the sheet on pension payment.

Article 9

The sheet on pension payment is constituted on sample which is applied to this Agreement.

The Party which finances pension payment sends two copies of the sheet to pension payment to the Party which will perform their payment.

The party which performed pension payment returns one copy of the sheet to the Party which financed payment, with marks about pension payment and with indication of the reasons of their nonpayment.

Article 10

Sending to sheets, the Party which finances pension payment, transfers to the bank account the Parties which will perform pension payment, the amounts of the means noted in the sheet.

Unpaid within 30 days after receipt of payment of pension amount the Party which performed payment returns on the bank account to the Party which financed payment.

The expenses connected with transfer of pensions

Article 11

Receivers of pensions do not incur the expenses connected with transfer of pensions.

Expenses on fee on delivery and pension payment are financed by Side of the state in the territory of which receivers of pensions live.

Article 12

Social Security Fund of the population of the Ministry of social protection of the Republic of Belarus finances expenses, connected:

with transfer into the bank account of the Pension fund of Ukraine of the means for pension payment appointed in the Republic of Belarus, to persons who live in the territory of Ukraine;

with pension payment, appointed in Ukraine, to persons who live in the territory of the Republic of Belarus;

with return to the bank account of the Pension fund of Ukraine of the unpaid pensions granted in Ukraine.

Article 13

The pension fund of Ukraine finances expenses, connected:

with transfer into the bank account of Social Security Fund of the population of the Ministry of social protection of the Republic of Belarus of the means for pension payment appointed in Ukraine, to persons who live in the territory of the Republic of Belarus;

with pension payment, appointed in the Republic of Belarus, to persons who live in the territory of Ukraine;

with return to the bank account of Social Security Fund of the population of the Ministry of social protection of the Republic of Belarus of the unpaid pensions granted in the Republic of Belarus.

Article 14

The party which finances pension payment bears responsibility for full and timely translation of pensions.

The party which performs pension payment bears responsibility for timely and correct pension payment.
