About approval of the Regulations on the Central expert and qualification commission under the Ministry of Justice of Ukraine and certification of court experts

According to Articles 8, 17 Laws of Ukraine "About judicial examination" and for the purpose of the proper organization of work on certification of court experts order:

1. Approve Regulations on the Central expert and qualification commission under the Ministry of Justice of Ukraine and certification of court experts which is applied.

2. Declare invalid the order of the Ministry of Justice of Ukraine of August 9, 2005 No. 86/5 "About approval of the Regulations on the qualification commissions and certification of court experts", registered in the Ministry of Justice of Ukraine on August 11, 2005 on No. 882/11162 (with changes).

3. To provide to department of judicial work and expert ensuring justice (Pampukh G. G.) submission of this order on state registration in the procedure established by the legislation.

4. The certificates on assignment of qualification of the court expert granted to employees of research establishments of judicial examinations before entry into force of this order are valid before the termination of the effective period specified in these certificates provided that person who grants these certificates are employees of research establishments of judicial examinations.

After the termination of effective period of these certificates confirmation of qualification of the court expert to employees of research establishments of judicial examinations is performed according to the procedure, the established Regulations on the Central expert and qualification commission under the Ministry of Justice of Ukraine and certification of court experts approved by this order.

5. To give to directors of research establishments of judicial examinations of the Ministry of Justice of Ukraine within 10 days from the date of entry into force of this order to Department of judicial work and expert ensuring justice on approval of the program of training of specialists which intend to receive (to confirm) qualification of the court expert.

6. This order becomes effective in 30 days from the date of its official publication.

7. I reserve control of execution of this order.

Regulations on the Central expert and qualification commission under the Ministry of Justice of Ukraine and certification of court experts

I. General provisions

1. This Provision according to Articles 10, of 14, of 16, "About judicial examination" determines 17 and 21 Laws of Ukraine:

1) organizational bases, tasks and procedure for activities of the Central expert and qualification commission under the Ministry of Justice of Ukraine (further - TsEKK);

2) procedure for preparation and passing of training of specialists who intend to receive or confirm qualification of the court expert;

3) procedure for carrying out certification for the purpose of assignment and confirmation of qualification of the court expert;

4) procedure for issue of the certificate on assignment of qualification of the court expert, its duplicate, amendment to the certificate on assignment of qualification of the court expert, renewal and cancellation of the certificate;

5) procedure for consideration of questions of disciplinary responsibility of court experts.

2. In the activities TsEKK is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine, regulatory legal acts of the Ministry of Justice of Ukraine, and also this Provision.

II. The organizational principles, tasks and procedure for activities of the central expert and qualification commission under the Ministry of Justice of Ukraine

1. TsEKK is the collegiate organ operating under the Ministry of Justice of Ukraine.

2. The main objectives of TsEKK are:

1) carrying out certification for the purpose of determination of level of professional readiness of employees of research establishments of judicial examinations of Ministry of Justice (further - NIUSE) who intend to receive and/or confirm qualification of the court expert;

2) carrying out certification for the purpose of determination of level of professional readiness of specialists who are not employees of the public specialized agencies and intend to receive and/or confirm qualification of the court expert;

3) consideration of questions of disciplinary responsibility of court experts.
