About transitional provisions of the technical regulation of the Eurasian Economic Union "About safety of fish and fish products" (TR EEU 040/2016)

According to Item 2 of article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014, Item 3 of the Regulations on the Euroasian economic commission (appendix №1 to the Agreement on the Eurasian Economic Union of May 29, 2014) and Item 11 of appendix №2 to the Regulations of work of the Euroasian economic commission approved by the Decision of the Supreme Euroasian economic council of December 23, 2014 № 98, taking into account the paragraph of the fifth Item 38 of the Procedure for development, acceptance, change and cancellation of technical regulations of the Eurasian Economic Union approved by the Decision of Council of the Euroasian economic commission of June 20, 2012 №48, Board of the Euroasian economic commission decided:

1. Determine that:

a) documents on assessment of conformity to the mandatory requirements established by the acts entering the right of the Eurasian Economic Union (further – the Union), or the legislation of state member of the Union (further – state member), issued or accepted concerning products which are object of technical regulation of the technical regulation of the Eurasian Economic Union "About safety of fish and fish products" (about day of entry into force of the technical regulation, are valid TR EEU 040/2016) (further respectively – products, the technical regulation) before the termination of term of their action, but no later than September 1, 2019.

From the date of entry into force of the technical regulation issue or adoption of documents on assessment of conformity of products to the mandatory requirements which are earlier established by the acts entering the right of the Union or the legislation of state member is not allowed;

b) till March 1, 2019 production and release into the stream of commerce in the territories of state members of products which were not subject about day of entry into force of the technical regulation to obligatory assessment of conformity to the mandatory requirements established by the acts entering the right of the Union or the legislation of state member without documents on obligatory assessment of conformity of products and not marked national mark of conformity (market access mark) are allowed;

c) till September 1, 2019 production and release into the stream of commerce in the territories of state members of products according to the mandatory requirements which are earlier established by the acts entering the right of the Union or the legislation of state member in the presence of the documents on assessment of conformity of products specified to mandatory requirements, issued or accepted about day of entry into force of the technical regulation are allowed.

Products are marked by national mark of conformity (market access mark) according to the legislation of state member. Marking of such products single market circulation mark of the Union is not allowed;

d) the product circulation, specified in subitems "b" and "v" of this Item, is allowed during the expiration date of such products established according to the legislation of state member.

2. Ask the Government of the Republic of Kazakhstan to provide together with state members development and submission to the Eurasian economic commission about day of entry into force of the technical regulation:

a) the draft of the program for development (modification, review) of the interstate standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of requirements of the technical regulation and implementation of assessment of conformity of objects of technical regulation;

b) the draft of the list of products concerning which submission of the customs declaration is followed by submission of the document on assessment of conformity to requirements of the technical regulation.

3. To the member of Board (Minister) of technical regulation of the Euroasian economic commission Koreshkov V. N. till September 1, 2017 to provide preparation and idea for consideration of the Euroasian economic commission of the draft decision of Board of the Euroasian economic commission by Board of modification of the Decision of the Commission of the Customs union of May 28, 2010 to №299 regarding application concerning products of Single sanitary and epidemiologic and hygienic requirements to the goods which are subject to sanitary and epidemiological surveillance (control).

4. This Decision becomes effective from the effective date Decisions of Council of the Eurasian economic commission on adoption of the technical regulation of the Eurasian Economic Union "About safety of fish and fish products", but not earlier than after 30 calendar days from the date of official publication of this Decision.
