About approval of Aviation rules of certification of experimental aircrafts, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines of experimental aircraft of the Republic of Belarus

Based on article 6 of the Air code of the Republic of Belarus, subitem 9.42 of Item 9 of the Regulations on the State military-industrial committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 8, 2009 No. 602 "About some questions of activities of the State military-industrial committee" and the resolution of Council of Ministers of the Republic of Belarus of August 6, 2015 No. 665 "About approval procedure of the aviation rules regulating activities in the field of experimental aircraft, and the list of positions of aviation personnel of experimental aircraft of the Republic of Belarus" the State military-industrial committee of the Republic of Belarus DECIDES:

1. Approve the enclosed Aviation rules of certification of experimental aircrafts, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines of experimental aircraft of the Republic of Belarus.

2. Declare invalid the resolution of the State military-industrial committee of the Republic of Belarus of October 23, 2015 No. 5 "About approval of Aviation rules of certification of experimental aircrafts, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines of experimental aircraft of the Republic of Belarus" (The national legal Internet portal of the Republic of Belarus, 12.11. 2015, 8/30332).

3. This resolution becomes effective in 15 working days after its signing.

Aviation rules of certification of experimental aircrafts, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines of experimental aircraft of the Republic of Belarus

Chapter 1 general provisions

1. These Aviation rules developed according to the Air code of the Republic of Belarus (further - the Air code), based on subitem 9.42 of Item 9 of the Regulations on the State military-industrial committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 8, 2009 No. 602 "About some questions of activities of the State military-industrial committee" (The national register of legal acts of the Republic of Belarus, 2009, No. 301, 1/11188), and resolutions of Council of Ministers of the Republic of Belarus of August 6, 2015 No. 665 "About approval procedure of the aviation rules regulating activities in the field of experimental aircraft, and the list of positions of aviation personnel of experimental aircraft of the Republic of Belarus" (The national legal Internet portal of the Republic of Belarus, 11.08. 2015, 5/40900), the procedure for certification of experimental aircrafts, aviation engines, air screws, onboard and land aeronautical equipment, aviation is determined

2. Action of these Aviation rules extends to all developers and aircraft manufacturers, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines of experimental aircraft of the Republic of Belarus.

3. In these Aviation rules the following terms and their determinations are applied:

acoustic or issued change - the change of standard design influencing noise level on areas or issue and requiring additional certification on compliance to requirements to environmental protection;

pilotless aviation complex (further - BAK) - set functionally connected and used together with the unmanned aerial vehicle (further - BLA) means of land management, providing, maintenance and preparation for application on purpose;

minor change - the change of standard design of the aircraft (further - VS) which is insignificantly influencing its flight validity;

the main change - the change of standard design of VS significantly influencing its flight validity;

the holder of the certificate of copy - the legal (physical) entity who received the certificate of the copy belonging to it on the property right, the right of economic maintaining or operational management or other bases, stipulated by the legislation or the agreement;

the holder of the certificate of type - the legal entity who received the certificate of type on the object of experimental aircraft created by it;

evidential documentation - the documentation containing results of checks, testing, researches and estimates of technical condition of object of experimental aircraft, establishing its compliance to requirements of certified basis, which is drawn up and approved according to these Aviation rules;

the applicant - the legal (physical) entity who filed petition in the State military-industrial committee (further - Goskomvoyenprom) for carrying out certification of object of experimental aircraft;

the manufacturer (producer) - the legal entity performing production (production) of object of experimental aircraft;

component of object of experimental aircraft - any its component;

design documentation (further - KD) - set of the design documents containing depending on their appointment this, necessary for development, production, control, acceptance, delivery, operation, repair of products;

modification - any main thing, the minor acoustic or issued change of standard design of object of aircraft affecting its characteristics (for VS - the flight validity) influencing the environment;

discrepancy - failure to meet requirements of certified basis and widespread regulations (criteria) of the flight validity established to object of experimental aircraft and its components;

discrepancies of category "1" - the discrepancies which are directly influencing safety of flights and not allowing to provide compliance of object of experimental aircraft and its components to requirements of certified basis, and durability of its design (for VS) - to the requirements to the flight validity distributed to it;

discrepancies of category "2" - the discrepancies which are not allowing to provide compliance of object of experimental aircraft and its components to requirements of certified basis, but directly not influencing safety of flights, ensuring the flight validity (for VS) and connected directly with departure from the established procedures and standards;

airworthiness standards - the requirements to design, parameters and flight qualities of VS and their components aimed at safety of flights;

object of aircraft - VS, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines;

working design documentation (further - RKD) - set of the documents containing depending on their appointment, this, necessary for development, production, control and acceptance of object of experimental aircraft;

developer - the organization performing process of creation of new type of object of aircraft, development of technical documentation on prototype and production of prototype;

assembly sets - sets of ready details from which objects of aircraft will be collected;

the certificate of the flight validity of VS - the document certifying compliance of VS of standard design (operational documentation) specified in the certificate of type (the certificate of copy), and being necessary condition of the admission to flight operation of this VS with the restrictions set for it;

the certificate of copy - the document confirming certification and compliance of copy(copies) of object of aircraft and its components to certified basis;

certification tests - set of the actions for check of compliance of the declared sample of object of experimental aircraft to certified basis which are carried out by the certified center, the applicant and Goskomvoyenprom;

certified basis - complex of requirements to object of experimental aircraft, and also in the field of environmental protection, extending to this type (copy);

the certified center - the organization (structural division of the organization) which is performing certified works and having appropriate authority on carrying out certification tests;

structural division - the division of Goskomvoyenprom performing function of specially authorized body in the field of experimental aircraft;

the table of correspondences - the document containing data on compliance of sample of object of experimental aircraft to certified basis;

standard design - design of object of aircraft, including the characteristic and operational restrictions (for VS - flight characteristics) which compliance to requirements of certified basis is established during certification;

operational documentation (further - ED) - documentation which separately or in total with other documentation determines service regulations of object of aircraft and (or) reflects the data certifying the values of key parameters and characteristics (properties) of object of aircraft, and also guarantee and the data guaranteed by the manufacturer on its operation during fixed term of service.

Other terms and their determinations are applied in these Aviation rules in the values specified in the Air code and aviation rules regulating activities in the field of experimental aircraft.

4. The objects of experimental aircraft developed (made, modernized) in the Republic of Belarus, are subject to certification according to these Aviation rules.

The objects of aircraft imported into the Republic of Belarus for implementation of types of activity in experimental aircraft and which do not have the certificate of type, the export certificate of the flight validity recognized in the Republic of Belarus are subject to obligatory certification according to requirements of these Aviation rules.

5. Expenses on certification of object of experimental aircraft, except for the expenses of the republican budget allocated for maintenance of specially authorized body in the field of experimental aircraft (structural division) are born by the applicant regardless of results and the made decisions.

Chapter 2. General questions of certification

6. Certification of objects of experimental aircraft includes the following stages:

giving by the applicant to Goskomvoyenprom statements for carrying out certification;

the analysis Goskomvoyenprom of the submitted documents, results of preliminary tests and the direction them in the certified center;

the analysis the certified center of the submitted documents, results of preliminary tests, the project of certified basis, determination of amounts of checks and testing, development of certified basis, the program and plan of certification tests of object of experimental aircraft, their coordination with the applicant, submission on approval to Goskomvoyenprom;

approval by Goskomvoyenprom of certified basis, program and plan of certification tests;

adoption by Goskomvoyenprom of the decision on the organization of certification tests of object of experimental aircraft and purpose of test crew (if necessary);

bringing decisions of Goskomvoyenprom to the applicant and certified center;

carrying out by the certified center, applicant and Goskomvoyenprom of certification tests;

analysis certified center of results of certification tests of object of experimental aircraft, execution of the conclusion, its submission to Goskomvoyenprom;

adoption by Goskomvoyenprom of the decision on issue of the certificate of type, certificate of copy, certificate of the flight validity;

registration and issue by Goskomvoyenprom to the applicant of the certificate of type, certificate of copy, certificate of the flight validity.

7. For carrying out certification the applicant submits to Goskomvoyenprom the application in form according to appendix 1.

Are enclosed to the application:

the specification of object of experimental aircraft including the short technical description, schematic diagrams of systems, the main characteristics, and also the expected operating conditions and restrictions in which range certification tests will be carried out;
