The agreement between the Cabinet of Ministers of Ukraine and the Executive Authority of Georgia on cooperation in the field of the prevention of industrial accidents, catastrophic crashes, natural disasters and liquidation of their effects

Cabinet of Ministers of Ukraine and Executive Authority of Georgia, further Parties,

realizing danger which is born for both countries by industrial accidents, catastrophic crashes and natural disasters,

recognizing that the cooperation in the field of the prevention of industrial accidents, catastrophic crashes, natural disasters and liquidation of their effects can help welfare and safety of both states,

considering advantage which exchange of scientific and technical information in the field of the prevention of industrial accidents, catastrophic crashes, natural disasters and liquidation of their effects can have for the Parties,

accepting in attention possibility of emergency situations which effects cannot be liquidated by forces and means of one of the Parties, and the need for these circumstances for the coordinated actions of the Parties for the purpose of the prevention of emergency situations and liquidation of their effects,

agreed about the following:

Article 1

Terms which are used in this Agreement have such values:

The party which requests - the Party which appeals to other Party about the direction of rescue units, the corresponding equipment and materials of providing;

The party which provides - the Party which grants request of other Party for the direction of rescue units, the corresponding equipment and materials of providing;

rescue units - groups of specialists, including the military personnel of troops of civil defense which are intended for assistance and provided with the necessary equipment;

the equipment - materials, technical and vehicles, equipment of rescue units and personal equipment which is used for assistance;

providing materials - the appliances intended for free distribution among the population which suffered owing to natural disaster or accident;

competent authorities - bodies which are appointed by the Parties for coordination of the works connected with implementation of this Agreement.

Article 2

The parties based on the principles of equality and mutual aid according to the legislation of the states perform cooperation in such directions:

development of general system of measures concerning the prevention of industrial accidents, catastrophic crashes, natural disasters and liquidation of their effects;

development of general system of the early notification about industrial accidents, catastrophic crashes and natural disasters which create health hazard of the person, and cross-border pollution of the territory of the state of other Party;

the organization of operational exchange of information about requests and offers of the Parties concerning mutual assistance in case of industrial accidents, catastrophic crashes and natural disasters which took place in the territory of their states;

provision of mutual aid in mitigation of consequences of industrial accidents, catastrophic crashes and natural disasters that took place.

Article 3

The cooperation within this Agreement includes:

organization and implementation of monitoring of dangerous technogenic and ecological processes, and also natural phenomena;

forecasting of industrial accidents, catastrophic crashes, natural disasters and assessment of their effects;

exchange of information and technologies;

exchange of specialists and scientists;

organization of general conferences, seminars and working meetings;

general planning, development and implementation of research projects and their demonstration;

risk assessment for the environment and health of the population in connection with possible pollution owing to industrial accidents, catastrophic crashes and natural disasters;

assessment of cross-border influence of industrial accidents, catastrophic crashes and natural disasters on the environment;

preparation of publications, reports and case studies;

ensuring communication between competent authorities of the Parties;

training;

assistance in mitigation of consequences of industrial accidents, catastrophic crashes and natural disasters;

any other activities connected with the prevention of industrial accidents, catastrophic crashes, natural disasters and liquidation of their effects that can be approved by competent authorities of the Parties.

Article 4

Competent authorities are:

from the Ukrainian Side - the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash;

from the Georgian Side - Department of emergency situations and civil defense of the Ministry of Internal Affairs of Georgia.

Each of the Parties will immediately in writing inform other Party if the competent authority will be deprived of powers on accomplishment of the functions assigned to it, and in the shortest possible time, but not later than 60 days from the moment of the message, will in writing report to other Party about the legal successor of competent authority.

Article 5

For implementation of provisions of this agreement competent authorities of the Parties establish the General commission on cooperation questions in the field of the prevention of industrial accidents, catastrophic crashes, natural disasters and liquidation of their effects (further - the General commission).

The general commission holds the meetings in turn in Ukraine and in Georgia, as a rule, once a year, and in case of need under approval of competent authorities of the Parties.

Article 6

All activities concerning implementation of this Agreement are performed according to the legislation of the state of each of the Parties and availability in each of them of rescue units and the corresponding equipment.

The party which accepts representatives of other Party who take participation in the activities provided by this Agreement incurs all expenses on their stay and movement on the territory of the state if another is not approved by the Parties. Journey on the territory of the state of the Party which accepts and departure from this territory are paid by the Party which directed the representatives.

Article 7

Mitigation of consequences of industrial accidents, catastrophic crashes and natural disasters are performed by rescue units and the equipment of the Party in the territory of which state they arose.

If disaster scales such that the Party which suffered cannot independently cope with its localization and liquidation, then the help in carrying out rescue and other urgent works is provided by other Party in case of the official address to her for the help.

Rescue units and equipments of the Parties can be involved in accomplishment of the rescue and other urgent works necessary for mitigation of consequences of industrial accidents, catastrophic crashes and natural disasters, with the following compensation of the incurred expenses at the expense of the Party which requests, or according to the procedure of provision of the free help by agreement of the Parties.
