About the Program of forming of the total electrical power market of the Eurasian Economic Union

1. Approve the enclosed Program of forming of the total electrical power market of the Eurasian Economic Union.
2. To state members of the Eurasian Economic Union together with the Eurasian economic commission to prepare and submit for review by Eurasian intergovernmental council:
till April 1, 2017 – the offer on use of the trading floors existing in state members, including on their upgrade (if necessary), or about creation of new trading floors for the organization of centralized trade by electrical energy within the total electrical power market of the Eurasian Economic Union, and also about the mechanism of attraction of non-budgetary sources for financing of upgrade or creation of such trading floors;
till May 1, 2017 – the offer on financing of actions for forming of the total electrical power market of the Eurasian Economic Union (except for actions for forming of the information exchange system providing interaction of subjects of the total electrical power market of the Eurasian Economic Union) with indication of the preliminary amounts of financing on appropriate sources of financing;
till January 1, 2018 – offers on possibility of use of the integrated information system of the Eurasian Economic Union and (or) others (including existing) mechanisms for forming of the information exchange system providing interaction of subjects of the total electrical power market of the Eurasian Economic Union, and also the offer on financing of actions for forming of such information exchange system.

The total electrical power market of the Eurasian Economic Union (further – the Union) is the system of the relations between subjects of the domestic wholesale electrical power markets of state members of the Union (further – state members) on the basis of in parallel the working electric utility systems connected with purchase and sale of electrical energy (capacity), which is acting on the basis of the acts regulating the total electrical power market of the Union, and the relevant contracts between subjects of the total electrical power market of the Union.
Forming of the total electrical power market of the Union is performed based on the principles specified in Item 5 of the Protocol on ensuring access to services of subjects of natural monopolies in the field of power industry including bases of pricing and tariff policy (appendix No. 21 to the Agreement on the Eurasian Economic Union of May 29, 2014).
According to articles 81 and 104 of the Agreement on the Eurasian Economic Union of May 29, 2014 (further – Dorovor) the Decision of the Supreme Eurasian economic council of May 8, 2015 No. 12 approves the Concept of forming of the total electrical power market of the Eurasian Economic Union (further – the Concept).
This Program is developed on the basis of the Concept according to Item 2 of article 81 of the Agreement.
Item 2 of article 104 of the Agreement determines the following terms of forming of the total electrical power market of the Union:
approval of this Program – till July 1, 2016;
accomplishment of actions of this Program – till July 1, 2018.
The purposes of accomplishment of this Program are ensuring readiness of state members for participation of subjects of the electrical power markets of state members in the total electrical power market of the Union and creation of conditions for effective functioning of the total electrical power market of the Union.
This Program includes complex of the interconnected organizational, technological and other actions providing forming of the total electrical power market of the Union, the sequence of actions, terms of their realization, contractors, financing sources, and also development of acts of the bodies of the Union regulating the total electrical power market of the Union.
As a result of accomplishment of actions of this Program the subject structure, methodical, organizational, infrastructure, technological and legal bases of the total electrical power market of the Union will be created.
The concepts used in this Program are applied in the values determined in the Agreement and the Concept.
1. Stages of forming of the total electrical power market of the Union
The Section XIII of the Concept determines the following stages of forming of the total electrical power market of the Union:
stage I (2015 – I and II quarters 2016) – development and approval of this Program;
stage II (III and IV quarters 2016 – I and II quarters 2018) – accomplishment of actions of this Program. Creation of all necessary legal, institutional, technological and other conditions providing functioning of the total electrical power market of the Union shall become the main result of this stage.
At this stage it is necessary including:
create technological basis of the total electrical power market of the Union;
divide competitive and exclusive types of activity in vertically integrated structures;
draft the acts regulating the total electrical power market of the Union according to the actions plan on forming of the total electrical power market of the Union according to appendix;
