Agreement on development of trade and economic cooperation between the Government of Ukraine and Government of the Republic Georgia

Government of Ukraine and Government of the Republic Georgia (daleestorona),

considering features of stages of economic reforms in each state;

aiming at integration of economies of the Parties in the world economic relations;

in view of process of liberalization of economy which happens;

realizing special value of deepening of the established traditional trade and economic relations;

being guided by the principles of equality, mutual advantage and interest;

based on the principles of international law agreed about it:

Article 1

The parties will take all necessary measures for ensuring development and expansion of trade and economic relations on the long-term stable and balanced basis and to strengthen economic cooperation within real opportunities and according to the current legislation of everyone from the Parties.

Article 2

For the purpose of providing mutually advantageous conditions of economic cooperation, the Party will provide each other the mode of the greatest assistance.

Article 3

The parties agreed to perform at the level of the Governments regulation of deliveries of the major types of products and goods according to the approved list.

Authorized state bodies of the Parties till October 1 every year approve and sign "amounts of mutual deliveries of products and goods the next year" that will be integral part of this Agreement.

The nomenclature and supply rates of products and goods can be changed or added by mutual consent of the Parties.

Article 4

The parties create favorable conditions to economic subjects in preserving and development of mutual deliveries of products and goods, cooperation, specialization in production of goods, creation of joint businesses and other forms of cooperation taken in world practice.

Article 5

The parties agreed to charge to the relevant ministries, departments and other economic subjects of Ukraine and the Republic Georgia to complete the conclusion of delivery agreements of products which are included in agreed volumes of deliveries till December 1, 1992. Economic subjects can sign delivery contracts of products and the goods which are not included in agreed volumes. The parties will promote agreement signature and protocols in other directions of trade and economic cooperation which will be of mutual interest.

Article 6

All calculations and payments for deliveries of goods and provision of services will be performed according to conditions of the payment agreement that it will be concluded between the relevant authorized banks of the Parties in a month. Adjustment of cost of products of the Parties which are delivered at the rate of the prices which is constituted is allowed.

Article 7

The parties agreed that in case of implementation of national currency any from the Parties, the procedure of payments and payments will be regulated by the free supplementary agreement which will be signed among themselves by authorized banks of the Parties not later than in 30 days after the announcement of such implementation.

Article 8

The parties agreed in a month to determine procedure for transportation and transit of loads through the territories of both states.

Article 9

The parties will encourage participation of regions, physical persons and legal entities of the states in the international exhibitions and fairs, cooperation of Chambers of Commerce and Industry, contracts of entrepreneurs, exchange of information, will develop other forms of trade and economic cooperation.

Article 10

In case of disputes on interpretation or application of provisions of this agreement of the Party will solve them by negotiations taking into account rules of international law.

Article 11

By agreement the Parties changes or additions can be made to this Agreement.

Article 12

This agreement is signed for five years and becomes effective from day of signing. Its action is automatically prolonged for the subsequent five-year periods if any of the Contractual Parties in six months prior to the end of the corresponding period in writing does not report to other Contractual Party about the desire to stop its action.

It is put into Tbilisi on August 6, 1992 in duplicate, everyone in the Ukrainian and Georgian languages, at the same time both texts are equally authoritative.
