About approval of the Instruction on the organization and conducting checks of office activities of bodies (divisions) of National police

According to the Law of Ukraine "About National police", and for the purpose of ensuring control of office activities of bodies (divisions) of National police I order to the Regulations on National police approved by the resolution of the Cabinet of Ministers of Ukraine of October 28, 2015 No. 877,:

1. Approve the Instruction on the organization and conducting checks of office activities of bodies (divisions) of National police which is attached.

2. Declare invalid the order of the Ministry of Internal Affairs of Ukraine of August 21, 2013 No. 808 "About approval of the Instruction about procedure for the organization and conducting complex inspections, target and control checks of office activities of bodies and divisions of internal affairs of Ukraine", registered in the Ministry of Justice of Ukraine on October 23, 2013 at No. 1802/24334.

3. To department of forming of policy for authorities under control to the Minister and monitoring of the Ministry of Internal Affairs (Bodnar V. E.) provide submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

4. To impose control of execution of this order on the Chairman of National police of Ukraine.

5. This order becomes effective from the date of its official publication.

Instruction on the organization and conducting checks of office activities of bodies (divisions) of National police

I. General provisions

1. This Instruction determines the organization and conducting checks of office activities of structural divisions of the office of the central governing body of police, interregional territorial authorities of National police and their territorial (isolated) subdivisions, territorial authorities of police and their territorial (isolated) subdivisions, and also the companies, organizations relating to the sphere of management of National police of Ukraine (further - bodies (divisions) of police).

Checks are subdivided into inspection, target and control checks.

2. In this Instruction terms are used in the following values:

inspection - check of office activities of bodies (divisions) of police in all areas of work;

control check - check of office activities of bodies (divisions) of police in all areas of work and results of the measures taken for remedial action revealed during conducting the previous inspection;

target check - check of office activities of bodies (divisions) of police which covers one or several areas of work;

the plan task - in advance constituted list of questions on which check of activities of bodies (divisions) of police will be performed.

3. Inspection and control inspections are carried out according to plans of the main actions of National police of Ukraine, head departments of National police in the Autonomous Republic of Crimea and Sevastopol, areas, Kiev (further - GUNP) under the orders signed respectively by the Chairman of National police of Ukraine, his first deputy or deputies, heads of GUNP or persons fulfilling their duties.

4. Unplanned inspections of bodies (divisions) of police are carried out according to the decision of the chairman of National police of Ukraine, heads of GUNP or persons fulfilling their duties in the presence of one of the following circumstances:

establishments of the facts which are the basis for conducting office investigation concerning heads of bodies (divisions) of police;

the reasonable appeal of physical persons or legal entities about violation by officials of bodies (divisions) of police of requirements of the legislation;

at the request of the President of Ukraine, the Cabinet of Ministers of Ukraine, the Minister of Internal Affairs of Ukraine.

5. Target inspections are carried out under the orders signed by the Chairman of National police of Ukraine, his first deputy or deputies, heads of interregional territorial authorities of National police and their territorial (isolated) subdivisions, territorial authorities of police and their territorial (isolated) subdivisions, their first deputies or deputies according to their competence.

Conducting target checks in subordinate divisions is also allowed by order of, signed by the head of the territorial (isolated) subdivision (managements, department) GUNP or person fulfilling its duties.

6. Check of office activities of divisions of Department of internal security of National police of Ukraine (further - DVB) is performed by the order of the Chairman of National police of Ukraine or person who fulfills its duties, and under approval of the head of DVB.

II. Objects and subjects of checks

1. Objects of checks are structural divisions of the office of the central governing body of police, interregional territorial authorities of National police and their territorial (isolated) subdivisions, territorial authorities of police and their territorial (isolated) subdivisions, and also the companies, organizations and institutions relating to the sphere of management of National police of Ukraine.

2. Subjects of checks are the commissions on conducting inspections, control and target checks (further - the commission).

The commissions of the office of the central governing body of police are authorized on check of all bodies (divisions) of police according to the plan task.

The commissions of GUNP check the structural divisions of the device and the territorial (isolated) subdivisions subordinated to them.

The commissions of interregional territorial authorities of National police perform target check (isolated) subdivisions subordinated to them territorial.

The commissions of the territorial (isolated) subdivisions of police (managements, departments) GUNP check subordinate departments, departments of police.
