1. Approve the enclosed Rules of carrying out certification of administrative government employees of the case "B".

2. Carry out certification of administrative government employees of the case "B" till July 1, 2017.

3. And to anti-corruption together with the central state and local executive bodies to provide to the agency of the Republic of Kazakhstan for public service carrying out:

1) certifications of administrative government employees of the case "B";

2) explanatory work on questions of procedure for carrying out certification of administrative government employees of the case "B".

4. To impose control of execution of this Decree on Administration of the President of the Republic of Kazakhstan.

5. This Decree becomes effective from the date of its first official publication.

Rules of carrying out certification of administrative government employees of the case "B"

1. General provisions

1. These rules of carrying out certification of administrative government employees of the case "B" (further – Rules) are developed according to Item 1 of article 63 of the Law of the Republic of Kazakhstan of November 23, 2015 "About public service of the Republic of Kazakhstan" (further – the Law) and determine procedure for carrying out certification of administrative government employees of the case "B" (further – the serving cases "B").

2. The purpose of certification is determination of the professional training level and compliance to posts of employees of the case "B".

3. Certification there undergo the serving cases "B", except for:

1) serving cases "B" which at the time of certification had two and less years before achievement of the retirement age established by the Law of the Republic of Kazakhstan "About provision of pensions in the Republic of Kazakhstan".

Approach of the term specified in part one of this subitem during the period from January 5 to June 30, 2017 inclusive is the basis for release forming cases "B" from certification passing;

2) serving cases "B", being on maternity leave, and also on child care leave;

3) the expectant mothers who provided the medical certificate about pregnancy, the women having the children under three years, lonely mothers who are bringing up the child aged up to fourteen years (the handicapped child up to eighteen years), the other persons cultivating the specified category of children without mother;

4) the persons for the first time appointed to managerial state position, having years of service of public service less than six months at the time of interviewing in the corresponding certifying commission;

4-1) employees of the case "B" whose positions are transformed from positions of the case "A";

5) serving cases "B", consisting in personnel reserve of classified public service of the case "A".

4. The general schedule of certification of employees of the case "B" providing terms of carrying out stages of certification (further – the general schedule) affirms authorized body for public service (further – authorized body) and is placed on its Internet resource.

State bodies and local executive bodies on the basis of the general schedule independently approve schedules of carrying out certification of employees of the case "B".

5. Provision of annual labor leaves serving cases "B", subject to certification, the direction them in official journeys, on training, and also rates of retraining and advanced training is performed taking into account the schedule of carrying out certification.

Participation of the employees of the case "B" who are subject to certification passing in tenders, and also their appointment to managerial state position according to the procedure of the translation is allowed only in the presence of the made decision of the corresponding certifying commission, the cases "B" of Administration of the President of the Republic of Kazakhstan, Prime minister's department of the Republic of Kazakhstan and offices of chambers of Parliament of the Republic of Kazakhstan except for serving.

This requirement does not extend to persons holding temporary vacant positions.

6. The serving cases "B" being during certification on educational leave, leave non-paid, long business trip or being absent from work owing to disease, and also attached to the international and other organizations, undergo certification within six months after appearance at work until the end of 2017.

The personnel of diplomatic service directed to work in foreign institutions of the Republic of Kazakhstan shall undergo certification until the end of 2017.

Persons attached to state bodies undergo certification according to provisions of these rules.

7. Depending on category of posts the serving cases "B" undergo certification in certifying commissions of appropriate level:

at the first level – the Highest certifying commission in case of the President of the Republic of Kazakhstan (further – VAK);

at the second level – certifying commissions of the central state bodies, their departments, territorial subdivisions of the central state bodies and their departments in areas, the city of republican value, the capital, and also offices of akims of areas, the city of republican value, the capital;

at the third level – certifying commissions of territorial subdivisions of the central state bodies and their departments in areas, areas in the city and the cities of regional value, and also offices of akims of areas, areas in the city and the cities of regional value.

8. The deputy manager of Administration of the President of the Republic of Kazakhstan, the Chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption, the head of Prime minister's department of the Republic of Kazakhstan, deputies of Parliament of the Republic of Kazakhstan on the parity basis representing the Senate and the Majilis of Parliament of the Republic of Kazakhstan, heads of structural divisions of Administration of the President of the Republic of Kazakhstan, representatives of the academic circle and public associations are part of VAK.
