About Advisory council of the Ministry of Finance of the Republic of Kazakhstan concerning entrepreneurship

1. Approve enclosed:

1) Regulations on Advisory council of the Ministry of Finance of the Republic of Kazakhstan concerning entrepreneurship according to appendix 1 to this order;

2) Structure of Advisory council of the Ministry of Finance of the Republic of Kazakhstan concerning entrepreneurship according to appendix 2 to this order.

2. Working body of Advisory council of the Ministry of Finance of the Republic of Kazakhstan concerning entrepreneurship to determine Department of legal service of the Ministry of Finance of the Republic of Kazakhstan.

3. Repeal some orders of the Minister of Finance of the Republic of Kazakhstan according to appendix 3 to this order.

4. This order becomes effective from the date of signing.

Regulations on Advisory council of the Ministry of Finance of the Republic of Kazakhstan concerning entrepreneurship

1. General provisions

1. This Regulations on Advisory council of the Ministry of Finance of the Republic of Kazakhstan concerning entrepreneurship (further - the Provision) are developed according to the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 (further - the Code) and determine procedure for forming and activities of Advisory council of the Ministry of Finance of the Republic of Kazakhstan (further - the Ministry) concerning entrepreneurship (further - Advisory council).

2. Advisory council concerning private entrepreneurship (further - advisory council) - the advisory advisory body created under the central state, representative and local executive bodies (further - state bodies) for the organization of work on:

to receipt of expert opinions from accredited associations of subjects of private entrepreneurship and the interested non-profit organizations on projects of regulatory legal acts, drafts of international treaties of the Republic of Kazakhstan, and also international treaties which participant the Republic of Kazakhstan intends to become, infringing on interests of entrepreneurship;

to development of offers on enhancement of activities of state bodies for the purpose of support and protection of entrepreneurship, including to elimination of administrative barriers;

to development of suggestions for improvement of the legislation of the Republic of Kazakhstan infringing on interests of entrepreneurship.

3. The advisory council performs the activities according to the Constitution of the Republic of Kazakhstan, the Code, other regulatory legal acts of the Republic of Kazakhstan, and also this Provision.

4. The advisory council performs the following functions:

considers projects of regulatory legal acts, drafts of international treaties of the Republic of Kazakhstan, and also international treaties which participant the Republic of Kazakhstan, infringing interests of entrepreneurship (further - the project) developed and provided by state bodies after their obligatory publication (distribution) in mass media including official Internet resources of state bodies, except for projects of the regulatory legal acts containing the state secrets intends to become;

performs the code of expert opinions of members of advisory council to the specified projects;

develops offers on enhancement of activities of state bodies for the purpose of support and protection of private entrepreneurship, including elimination of administrative barriers.

2. Procedure for forming of Advisory council

4. The structure of advisory council is created of representatives of National chamber of entrepreneurs of the Republic of Kazakhstan (further - National chamber), associations of subjects of private entrepreneurship, the non-profit organizations accredited according to the procedure, established by the legislation, and also state body.

Accredited associations of subjects of private entrepreneurship and non-profit organizations are part of advisory council under state bodies as the collective member and are effective through the representative whose power is confirmed by the power of attorney.

5. The structure of advisory council consists of the chairman, his deputy, the secretary and members of council.

The structure of advisory council affirms the order of the Minister of Finance.

The chairman of Advisory council is the responsible secretary.

In need of meeting of Advisory council the vice-chairman can see off.

3. Procedure for activities of Advisory council

6. Member of Advisory council:

Access to materials of Advisory council has 1);

2) participates in discussion of the materials brought on meeting of Advisory council;

Initiates 3):

holding meeting of Advisory council on the considered projects of regulatory legal acts;

inclusion in the agenda of meeting of the questions entering competence of the relevant state body;

4) makes recommendations about development of offers on enhancement of activities of state bodies for the purpose of support and protection of private entrepreneurship, including to elimination of administrative barriers;

5) requires holding internal meeting of Advisory council.

7. Working body of advisory council:

during the period between meetings of advisory council will organize its work;

sends projects to accredited associations of subjects of private entrepreneurship, National chamber, non-profit organizations and/or places them on official Internet resource of state body;

performs preparation of project materials, brought on meeting of advisory council;

provides preparation and signing of the protocol following the results of meeting of advisory council.

8. The chairman of Advisory council performs management of Advisory council approves the agenda of the regular meeting of Advisory council, convokes in need of its meeting, signs protocols of meetings.

During absence of the chairman of Advisory council its functions are performed by the deputy.

9. Decisions of advisory council are drawn up in the form of the protocol in form, according to appendix to this Provision which is signed by the chairman and the secretary of advisory council, and have advisory nature.

The secretary is not member of advisory council and has no right to vote in case of adoption of decisions by advisory council.

This protocol goes to members of advisory council and is the annex to the project.

10. Meetings of advisory councils are held at least once a quarter.
