About approval of Rules of advanced training of court experts

(as amended on 03-01-2024)

According to the subitem 21) of article 12 of the Law of the Republic of Kazakhstan of February 10, 2017 "About judicial and expert activities" I ORDER:

1. Approve Rules of advanced training of court experts.

2. To provide to department of the organization of expert activities of the Ministry of Justice of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction of its copies in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising deputy minister of justice of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of advanced training of court experts

Chapter 1. General provisions

1. These rules of advanced training of court experts are developed according to the Law of the Republic of Kazakhstan of February 10, 2017 "About judicial and expert activities" and determine procedure for advanced training of court experts of body of judicial examination (further - court experts), and also persons performing judicial and expert activities based on the license (further – licensees).

2. Advanced training of court experts and licensees is performed for the purpose of development and deepening of the professional knowledge and skills necessary for accomplishment of the functions by them as court experts and licensees.

3. The basic principles of advanced training of court experts and licensees are systemacity, continuity, succession of training in combination with self-education.

4. Coordination of activities for questions of advanced training of court experts, and also licensees is performed by body of judicial examination with the assistance of Chamber of court experts of the Republic of Kazakhstan (further - Chamber).

5. Advanced training of court experts, and also licensees is carried out in the form of the training seminars, professional development course, the training trainings, "master classes", practical learning (training) in:

1) bodies of judicial examination;

2) state and non-state organizations;

3) educational educational institutions;

4) production bases, as in the Republic of Kazakhstan, and abroad.

6. Advanced training of court experts in the field of the forensic medicine, forensic psychiatry and narcology having medical education is performed according to Rules of additional and informal education of specialists of health care, qualification requirements to the organizations realizing educational programs of additional and informal education in the field of health care and also rules of recognition of the results of training received by the specialists in the field of health care through additional and informal education approved by the order of the Minister of Health of the Republic of Kazakhstan of December 21, 2020 No. KR DSM-303/2020 (it is registered in the Register of state registration of regulatory legal acts for No. 21847).

Chapter 2. Procedure for advanced training of court experts

7. For ensuring proper professional level court experts and licensees once in five years undergo advanced training.

8. The five-year period begins since the year following after year of receipt of the certificate of competency of the court expert and licensee.

The five-year period does not join break in service of court experts and licensees, and also leave non-paid on child care before achievement of three-year age by it.

9. Information on the planned actions for advanced training of court experts and licensees is posted on the official site of body of judicial examination by the head of body of judicial examination, or person fulfilling its duties and also on the website of Chamber by the head of Chamber, or person fulfilling its duties.

10. The head of body of judicial examination, or person fulfilling its duties the list of court experts, and also the list of licensees on representation of Chamber affirms.

11. After approval of the list of the court experts undergoing advanced training, the head of body of judicial examination, or person fulfilling its duties without delay informs territorial subdivisions of body of judicial examination on date and the venue of training. Licensees on date and the venue of advanced training are informed by Chamber.

12. Advanced training constitutes 120 hours of training from which:

60 obligatory class periods of training court experts pass 1) according to the procedure, stipulated in Item 5 these rules;

60 hours of additional hours pass 2) according to the procedure, stipulated in Item 15 these rules.

13. Obligatory hours of advanced training include studying of theoretical and practical questions directly on expert specialty.

14. Additional hours of advanced training are spent for the purpose of development of professional, intellectual, special and functional knowledge, skills.

15. Additional hours, except different forms of advanced training, stipulated in Item 4 these rules, join publication of scientific works, Articles, reports, participation at the conferences, seminars, forums estimated by system of recalculation of test units according to appendix to these rules

16. Court experts of territorial subdivisions undergo advanced training according to the plans approved by the head of body of judicial examination, or person fulfilling its duties. Licensees undergo advanced training according to the plans approved by the head of Chamber, or person fulfilling its duties.

17. Upon termination of professional development course court experts represent to body of judicial examination, and licensees in Chamber the following documents:

1) copy of the document on advanced training passing;

2) report on advanced training passing.
