Some questions of issue (refusal in issue, cancellation) import permits of the publishing products having origin or are made and/or it is imported from the territory of the state aggressor, temporarily occupied territory of Ukraine

According to part three of article 28-1 of the Law of Ukraine "About publishing" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for issue (refusal in issue, cancellation) import permits of the publishing products having origin or it is made and/or it is imported from the territory of the state aggressor, temporarily occupied territory of Ukraine which is applied.

2. Ceased to be valid according to the Resolution of the Cabinet of Ministers of Ukraine of 24.10.2018 No. 960.

3. To the public fiscal service to develop special program and information complex for ensuring interaction of the State committee of television and broadcasting and the Public fiscal service in case of control of import of publishing products according to the Procedure approved by this resolution.

4. This resolution becomes effective in 30 days from the date of its publication.

Procedure for issue (refusal in issue, cancellation) import permits of the publishing products having origin or are made and/or it is imported from the territory of the state aggressor, temporarily occupied territory of Ukraine

1. This Procedure determines the procedure of issue (refusal in issue, cancellation) import permits of the publishing products having origin or is made and/or is imported from the territory of the state aggressor, temporarily occupied territory of Ukraine (further - permission), except publishing products which are imported by citizens in hand luggage or the accompanied baggage total quantity no more than 10 copies.

2. Import of the publishing products having origin or it is made and/or it is imported from the territory of the state aggressor, temporarily occupied territory of Ukraine (further - publishing products), performed on allowing basis.

Issue (refusal in issue, cancellation) permissions is performed by Goskomteleradio.

3. The application for issue of permission in form according to appendix 1 is submitted by the subject of managing (authorized by it body or person):

in paper form personally or mailing to the administrator of the center of provision of administrative services;

electronically Goskomteleradio through the Single state portal of administrative services who is drawn up according to requirements of the laws in the field of electronic documents.

If documents are filed personally, the passport of the citizen of Ukraine, the temporary certificate of the citizen of Ukraine or the passport document of the foreigner is shown. In case of submission of documents by the representative the document certifying its powers is in addition filed.

The subject of managing submits the application for issue of permission and documents to the Center of provision of administrative services in the location or the place of implementation of activities.

The statement for issue of permission is registered Goskomteleradio in day of its receipt.

After the receipt of the statement and documents necessary for issue of permission, Goskomteleradio checks completeness and correctness of their registration, and also compliance of content of publishing products to criteria for evaluation of publishing products which is resolved to distribution in the territory of Ukraine, affirm Goskomteleradio's order, and in case of lack of notes issues to the subject of managing permission by the method determined by Item 8 of this Procedure.

4. For receipt of permission the subject of managing files the following documents:

the statement for issue of permission in which the complete name of the edition in original language and in Ukrainian, the manufacturing country, year of issue, number of copies which are imported on customs area of Ukraine are specified;

one copy of the original of the edition which is imported;

the original or the copy notarized in accordance with the established procedure of the agreement signed with the owner of the rights to the edition confirming provision of the right to distribution of publishing products in the territory of Ukraine together with the translation into Ukrainian certified notarially

the review constituted in state language by the specialist (expert), concerning assessment and the characteristic of contents of the edition, certified by the signature of the owner of the rights to the edition.

The specified list of the documents submitted by the subject of managing is exhaustive.

5. In case of identification of signs of discrepancy of publishing products to criteria for evaluation of publishing products which are resolved to distribution in the territory of Ukraine the documents necessary for issue of the import permit are submitted to advisory council of Goskomteleradio concerning the analysis and assessment of publishing products on its reference to such which is not permitted to distribution in the territory of Ukraine (further - advisory council).

On analysis results and estimates of the provided edition the advisory council provides to Goskomteleradio the conclusion about reference of publishing products to permitted or not permitted to distribution in the territory of Ukraine.

The conclusion about reference of publishing products to permitted or not permitted to distribution in the territory of Ukraine, is the basis for issue (refusal in issue) permissions.

6. Issue (provision of refusal in issue) permissions is performed free of charge within 10 calendar days from the date of the receipt of the statement and documents necessary for issue of permission, in Goskomteleradio.

7. The basis for refusal in issue of permission are:

representation by the subject of managing not in full document package, necessary for receipt of permission, according to the list determined in item 4 of this Procedure;

identification in the documents filed by the subject of managing, false information;

negative conclusion of advisory council.

The refusal in issue of permission on the bases which are not provided by this Item is not allowed.

Goskomteleradio reports to the subject of managing in paper form through the Center of provision of administrative services about refusal in issue of permission in form according to appendix 3.
