About approval of the Procedure for implementation of the arrangement between Ukraine and the Republic of Uzbekistan concerning cooperation in permission of questions of nationality of the deported persons and their descendants

In pursuance of the Order of the President of Ukraine of August 22, 1998 "About measures concerning permission of questions of nationality of the deported persons and their descendants who return from the Republic of Uzbekistan to Ukraine" PRIKAZYVAYEM:

Approve the Procedure for implementation of the arrangement between Ukraine and the Republic of Uzbekistan concerning cooperation in permission of questions of nationality of the deported persons and their descendants it (is applied).

Procedure for implementation of the arrangement between Ukraine and the Republic of Uzbekistan concerning cooperation in permission of questions of nationality of the deported persons and their descendants

For the purpose of implementation of the arrangement between Ukraine and the Republic of Uzbekistan concerning cooperation in permission of questions of nationality of the deported persons and their descendants to establish the following:

1. The deported persons and their descendants (children, grandsons) who are in nationality of the Republic of Uzbekistan and wish to receive confirmation about not belonging to nationality of the Republic of Uzbekistan, showed willingness to acquire citizenship of Ukraine according to part 1 of article 8 of the Law of Ukraine "About citizenship of Ukraine", submit to divisions of passport service of law-enforcement bodies of Ukraine in the place of residence or to diplomatic representations or consular establishments of Ukraine abroad the statement questionnaire for getting out of nationality of the Republic of Uzbekistan completed by hand in duplicate (appendix 1), for receipt of the document on the termination or lack of nationality of the Republic of Uzbekistan, and the documents provided by part 3 of the Section II of the Procedure for production according to statements and provisions concerning citizenship of Ukraine and accomplishment of the made decisions N 215, approved by the Presidential decree of Ukraine of 27.03.2001 except for obligations to stop foreign citizenship.

The deported persons can receive forms of questionnaires statements about exit from nationality of the Republic of Uzbekistan in local government bodies, notary offices or passport divisions of law-enforcement bodies in the place of their permanent residence. Authenticity of signatures of applicants and members of their families (in case of availability of signatures of members of families in the corresponding graphs of the questionnaire statement) notarially makes sure persons of executive bodies of village, settlement, city councils authorized on it (of settlements in which there are no notary offices), notaries of offices of notary public without use of special forms of notarial documents by making by hand of notarial text of such content: "I witness authenticity of signatures (surnames and initials of persons which signatures are witnessed are specified further)". Also the place, date of execution of the document, position and surname of the authorized person of executive body of village, settlement, city council, the notary public which signatures are certified by the corresponding seal are specified. Record concerning collection of the state fee on questionnaires statements is not performed.

2. Passport divisions of law-enforcement bodies check correctness of document creation concerning establishment of belonging to citizenship of Ukraine and together with questionnaires statements about exit from nationality of the Republic of Uzbekistan and the list of persons who gave them (appendix 2), transfer to 7-day time in head departments of the Ministry of Internal Affairs of Ukraine in the Autonomous Republic of Crimea, the city of Kiev, Kiev region, Regional Offices of the Ministry of Internal Affairs of Ukraine in areas and the city of Sevastopol (further - UMVS).

3. Noted documents are studied in departments of passport, registration and migratory work of UMVS based on what the decision on possibility of belonging of the corresponding persons to citizenship of Ukraine is made.

After receipt of documents on exit of the corresponding person from nationality of the Republic of Uzbekistan or about not belonging to nationality of the Republic of Uzbekistan UMVS determine belonging to citizenship of Ukraine.

4. Questionnaires statements about getting out of nationality of the Republic of Uzbekistan or about confirmation of not belonging to nationality of the Republic of Uzbekistan of persons concerning whom the decision on possibility of establishment of their belonging to citizenship of Ukraine is made together with the corresponding lists are sent to 5-day time to Management of passport, registration and migratory work of the Ministry of Internal Affairs of Ukraine which generalizes the received documents and in 5-day time transfers to the Ministries of Foreign Affairs of Ukraine.

5. The department of consular service of the Ministry of Foreign Affairs of Ukraine transfers to the 7-day time of the questionnaire statement and the corresponding lists to Embassy of the Republic of Uzbekistan in Ukraine.

6. On getting out of nationality of the Republic of Uzbekistan or confirmation of the fact about not belonging to nationality of the Republic of Uzbekistan the Department of consular service of the Ministry of Foreign Affairs of Ukraine after receipt of data through diplomatic channels informs on results of consideration by the Uzbek Side of questionnaires statements in 3-day time Management of passport, registration and migratory work of the Ministry of Internal Affairs of Ukraine which brings these data to UMVS in 3-day time.

7. In case of obtaining by the applicant directly from the Uzbek Side of the certificate of getting out of nationality of the Republic of Uzbekistan or about confirmation of the fact about not belonging to nationality of the Republic of Uzbekistan such reference (appendix 3) goes to passport service of local authorities of internal affairs for transfer of UMVS.
