Approve the Procedure for issue of permissions to the right of import to the territory of Ukraine, export from the territory of Ukraine or transit through the territory of Ukraine of drugs, psychotropic substances and precursors it (is applied).

Procedure for issue of permissions to the right of import to the territory of Ukraine, export from the territory of Ukraine or transit through the territory of Ukraine of drugs, psychotropic substances and precursors

General provisions

1. This Procedure determines the mechanism of issue of permissions to the right of import to the territory of Ukraine, export from the territory of Ukraine of drugs, psychotropic substances and precursors by the companies, organizations and the organizations (further - subjects of managing), bodies and divisions of civil protection (in the amounts necessary for delivery of health care injured with emergency situations; medical support of the bodies and divisions of civil protection sent to other states for participation in actions for mitigation of consequences of emergency situations, carrying out rescue and other urgent works, and also demonstration during the international indicative doctrines (trainings) and for passing of the international certification (recertification) in the presence they have licenses for implementation of the corresponding types of activity in the field of drug trafficking, psychotropic substances and precursors or the license for production, wholesale, retail trade by medicines (for the medicines containing small amount of drugs, psychotropic substances and precursors), and also determines the mechanism of issue of permissions to the transit right through the territory of Ukraine of drugs, psychotropic substances and precursors.

Action of this Procedure does not extend to cases of import to the territory of Ukraine of the medicines containing drugs, psychotropic substances and precursors which performs person authorized on implementation of purchases in the field of health care on result of the purchase which is carried out by person authorized on implementation of purchases in the field of health care for means of the government budget. In case of lack of the license for implementation of economic activity on drug trafficking, psychotropic substances and precursors of person authorized on implementation of purchases in the field of health care ensuring compliance with article 24 of the Law of Ukraine "About drugs, psychotropic substances and precursors" is performed by attraction by person authorized on implementation of purchases in the field of health care, subjects of managing which have license for activities on drug trafficking, psychotropic substances and precursors, with observance of requirements of the Law of Ukraine "About public purchases".

Action of this Procedure does not extend to cases of import to the territory of Ukraine, export from the territory of Ukraine or transit through the territory of Ukraine with use of form 302, of Ukraine provided by the Customs code, the medicines containing drugs, psychotropic substances and precursors for medical support of divisions of Armed forces of state members of the European Union, state members of the North Atlantic Treaty Organization and other states which in the procedure established by the law are allowed on the territory of Ukraine, divisions of the Armed Forces directed under the law to other states.

2. Import and export of drugs, psychotropic substances and precursors is performed by subjects of managing on condition of receipt of permission to each separate transaction which is issued by Gosleksluzhboy. Issue of permission is performed in coordination with the SSU.

Issue (refusal in issue, renewal, issue of the duplicate, cancellation) permissions is performed according to the Law of Ukraine "About authorization system in the field of economic activity".
