According to article 7 of the Law of the Republic of Kazakhstan of July 9, 1998 "About natural monopolies" PRIKAZYVAYU:

1. Approve:

1) Rules of placement by the subject of natural monopoly of information on rates and tariff estimates on regulated services (goods, works), according to appendix 1 to this order;

2) Rules of annual placement by the subject of natural monopoly of the activities report on provision of regulated services (goods, works) before consumers and other interested persons, according to appendix 2 to this order;

3) Rules of annual placement by the subject of natural monopoly of the activities report on provision of regulated utilities (goods, works) before consumers and other interested persons, according to appendix 3 to this order.

2. To committee on regulation of natural monopolies, protection of the competition and the rights of consumers of the Ministry of national economy of the Republic of Kazakhstan to provide in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in printing and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of placement by the subject of natural monopoly of information on rates and tariff estimates on regulated services (goods, works)

Chapter 1. General provisions

1. These rules of placement by the subject of natural monopoly of information on rates and tariff estimates on regulated services (goods, works) (further – Rules) are developed according to subitem 7-8) of article 7 of the Law of the Republic of Kazakhstan of July 9, 1998 "About natural monopolies".

2. Rules determine procedure for placement by the subject of natural monopoly of information on rates and tariff estimates on regulated services (goods, works) (further – Information) on Internet resource of the subject of natural monopoly or on Internet resource of local executive body or on Internet resource of department of authorized body or territorial subdivision of department of authorized body (by the place of its inclusion in the State register of subjects of natural monopolies), according to the Rules of inclusion and exception of the State register of subjects of natural monopolies approved by the order of the Chairman of the Agency of the Republic of Kazakhstan on regulation of natural monopolies of March 28, 2014 No. 64-OD registered in the Register of state registration of regulatory legal acts for No. 9404 (further – Rules No. 64-OD), or on Internet resource of authorized body in separate industries.

3. In these rules the following main terms and concepts are used:

1) territorial authorized body – territorial subdivision of department of authorized body;

2) authorized body in separate industries – the state body exercising control and regulation in spheres of natural monopolies in separate industries;

3) the subject of natural monopoly – the individual entrepreneur or the legal entity occupied with production of goods, performance of works and (or) the consumer service delivery in the conditions of natural monopoly;

4) regulated services (goods, works) of the subject of natural monopoly – the services (goods, works) provided by the subject of natural monopoly in the field of natural monopoly and which are subject to state regulation of authorized body by department including cases of provision of services (goods, works) in the form of transfer of certain goods to the consumer;

5) the tariff estimate – the indicators approved by authorized body by regulated services (goods, works) about income and expense items, about amounts of the rendered regulated services (goods, works) and other economic indicators of activities of the subject of natural monopoly in the form approved by authorized body according to the subitem 21) article 3 of the Law of the Republic of Kazakhstan "About natural monopolies";

6) authorized body – the state body performing management in spheres of natural monopolies;

7) department of authorized body – the department of state body performing management in spheres of natural monopolies.

Other concepts and terms used in these rules are applied according to the legislation of the Republic of Kazakhstan on natural monopolies.

Chapter 2. Procedure for placement of information

4. Information is placed the subject of natural monopoly on the Internet resource no later than 5 (five) calendar days from the date of approval of rate and the tariff estimate on regulated service (goods, works) of the subject of natural monopoly in time.
