About approval of the Instruction on the organization of collection of means and transportation of currency values of banks in Ukraine

According to Articles 7, of 15, 33 and 56 Laws of Ukraine "About the National Bank of Ukraine", for the purpose of establishment of single requirements to the organization of collection of means and transportation of currency values for banks and licensed legal entities the Board of the National Bank of Ukraine decides:

1. Approve the Instruction on the organization of collection of means and transportation of currency values of banks in Ukraine which is applied.

2. No. 922 "About modification of the Instruction on the organization of collection of means and transportation of currency values in bank institutions in Ukraine" to exclude Item 1 of the resolution of Board of the National Bank of Ukraine of December 23, 2015.

3. Recognize invalid:

1) the resolution of Board of the National Bank of Ukraine of February 14, 2007 No. 45 "About approval of the Instruction on the organization of transportation of currency values and collection of means in bank institutions of Ukraine", registered in the Ministry of Justice of Ukraine on March 3, 2007 at No. 181/13448;

2) the resolution of Board of the National Bank of Ukraine of September 16, 2008 No. 283 "About introduction of amendments to the resolution of Board of the National Bank of Ukraine of February 14, 2007 No. 45", registered in the Ministry of Justice of Ukraine on October 10, 2008 on No. 966/15657;

3) the resolution of Board of the National Bank of Ukraine of July 10, 2009 No. 399 "About approval of Changes in the Instruction on the organization of transportation of currency values and collection of means in bank institutions in Ukraine", registered in the Ministry of Justice of Ukraine on July 29, 2009 on No. 712/16728;

4) the resolution of Board of the National Bank of Ukraine of January 30, 2012 No. 26 "About approval of Changes in the Instruction on the organization of transportation of currency values and collection of means in bank institutions in Ukraine", registered in the Ministry of Justice of Ukraine on February 20, 2012 on No. 254/20567;

5) the resolution of Board of the National Bank of Ukraine of June 3, 2013 No. 191 "About approval of Changes in the Instruction on the organization of collection of means and transportation of currency values in bank institutions in Ukraine", registered in the Ministry of Justice of Ukraine on June 25, 2013 at No. 1056/23588;

6) the resolution of Board of the National Bank of Ukraine of November 27, 2014 No. 750 "About modification of the Instruction on the organization of collection of means and transportation of currency values in bank institutions in Ukraine".

4. Oblige banks:

To stop 1) by January 1, 2020 use of the operational motor transport acquired till 2012 inclusive, pantsirovanny on 1 and 2 classes of protection according to requirements of State standard of Ukraine GSTU 3975-2000 "Protection armored specialized cars. General technical requirements", the State standard of Ukraine approved by the order of July 07, 2000 No. 429 (further - GOST 3975-2000);

2) to establish the maximum amount of currency values when transporting regular risks by operational motor transport:

1 class of protection in accordance with GOST 3975-2000 - in the amount of 1200 minimum wages;

2 classes of protection in accordance with GOST 3975-2000 - in the amount of 2500 minimum wages.

5. To information directorate and public communications (Bondarenko N. M.) to place this resolution on the page of Official Internet representative office of the National Bank of Ukraine.

6. To department of currency circulation (Zayvenko V. P.) to bring contents of this resolution to the attention of banks of Ukraine.

7. To banks till September 1, 2017 to bring internal documents into accord with requirements of this resolution.

8. The resolution becomes effective from the date of, its official publication following behind day.

The instruction on the organization of collection of means and transportation of currency values of banks in Ukraine

I. General provisions

1. This Instruction is developed according to the Laws of Ukraine "About banks and banking activity", "About the National Bank of Ukraine", other regulatory legal acts, including regulatory legal acts of the National Bank of Ukraine (further - National Bank), and establishes the regulations determining procedure of collection of means and transportation of currency and other values of banks and their clients in Ukraine.

Requirements of this Instruction extend on:

1) banks of Ukraine, their branches (departments), branches of foreign banks and clients of these banks;

2) the legal entities providing to banks services in collection based on the corresponding license of National Bank obtained according to requirements of the Regulations on procedure for issue to legal entities of the license for provision to banks of services in collection approved by the resolution of Board of the National Bank of Ukraine of December 24, 2015 No. 926 (with changes) (further - legal entities);

3) divisions of transportation of values of National Bank (if other is not regulated by administrative acts of National Bank).

2. The bank or the legal person who belongs division of collection of means and transportation of currency values (further - division of collection) bears responsibility for failure to provide of safety of the currency and other values entrusted by banks and their clients (further - values) in case of provision of services on collection of collection by division.

3. The head of bank or the legal entity according to the procedure, established by the legislation, bears responsibility for failure to provide of protection of life and health of employees of divisions of collection when rendering services in collection, for failure to carry out of other requirements of this Instruction.

4. In this Instruction terms are used in the following values:

1) bank - banks of Ukraine, their branches (departments), branches of foreign banks;

2) the box of collection - rooms (complex of rooms) which are closed from the middle and are adapted for arrival of operational motor transport for loading (unloading) of values which design excludes external observation of work of collectors with values;

3) collection crew - the employees of division of collection determined by the head of this division of collection for accomplishment of tasks by provision of services on collection;

4) currency values (means) - national currency (hryvnia), foreign currency and bank metals:

bank metals - the gold, silver, platinum, metals of platinum group brought (affined) to the highest tests according to the international standards in ingots and powders which have the quality certificate, and also coins made of precious metals;

foreign currency - the bank notes of monetary units of foreign states in the form of banknotes, treasury notes, coins which are in circulation and being legal means of payment in the territory of the corresponding foreign state or group of foreign states, and also withdrawn or withdrawn from circulation, but subject to exchange for the bank notes which are in circulation;

national currency - bank notes of monetary unit of Ukraine (hryvnia) in the form of banknotes, coins, including turnover, commemorative and anniversary coins and in other forms which are in circulation and being legal means of payment in the territory of Ukraine, and also to exchange for the bank notes withdrawn or withdrawn from circulation, but subject which are in circulation.
