DECISION OF EXECUTIVE DIRECTORATE OF FUND OF GUARANTEEING HOUSEHOLD DEPOSITS OF UKRAINE

of February 10, 2017 No. 503

About approval of the Procedure replacement of vacant positions in Fund of guaranteeing household deposits

According to Items 9, 10 parts one of article 12 of the Law of Ukraine "About system of guaranteeing household deposits" executive directorate of Fund of guaranteeing household deposits of RESHILA:

1. Approve the Procedure for replacement of vacant positions in Fund of guaranteeing household deposits which is applied.

2. To provide to department of strategy and normative and methodological providing together with legal department submission of this decision to the Ministry of Justice of Ukraine for state registration.

3. This decision becomes effective from the date of, its official publication following behind day.

4. To provide to department of public relations and financial education placement of this decision on the official page of Fund of guaranteeing household deposits on the Internet after its state registration.

5. I reserve control over the implementation of this decision.

Procedure for replacement of vacant positions in Fund of guaranteeing household deposits

I. General provisions

1. This Procedure determines the mechanism of replacement of vacant positions in Fund of guaranteeing household deposits (further - Fund), procedure for matching of candidates for replacement of vacant positions in Fund (further - the candidate) and checks of reliability of information provided by them, the procedure of submission of documents by candidates for execution of an employment agreement with Fund, procedure for passing by candidates of testing in case of employment in Fund.

2. Replacement of vacant positions in Fund is performed according to the legislation of Ukraine.

3. The terms used in this Procedure are applied in the values given in the Labor code of Ukraine, the Laws of Ukraine "About system of guaranteeing household deposits" and "About prevention of corruption".

4. The procedure of replacement of vacant positions in Fund performs and coordinates structural division to which management functions by personnel of Fund are assigned.

5. This Procedure extends to all structural divisions of Fund and is obligatory for execution.

II. Implementation of matching of candidates and check of reliability of information provided by them

1. Matching of candidates is performed by the head of the structural unit of Fund in which there are vacant positions, and structural division to which management functions by personnel of Fund are assigned.

2. Heads of structural divisions of Fund are forbidden to involve any persons in performance of works in Fund, including students during practical training, before signing of the relevant order of Fund on acceptance for work, the order on practical training and so forth.

3. The head of the structural unit Fonda in whom there are vacant positions informs structural division to which management functions by personnel of Fund are assigned, about completion of matching of candidates and directs the selected candidate for structural division to which management functions by personnel of Fund, for check of compliance of the candidate to the qualification characteristics determined by the corresponding job description, regulations on the relevant structural division of Fund and the Reference book of qualification characteristics of professions of workers approved by the order of the Ministry of Labour and Social Policy of Ukraine of December 29, 2004 No. 336 are assigned.

4. Each selected candidate for avoidance of conflict of interest can provide information on the form given in appendix 1 to this Procedure.

5. The structural division to which management functions by personnel of Fund are assigned provides the acquired information, the stipulated in Item 4 presents of the Section, together with the summary (or the copy of the service record) the candidate to structural division to which safety functions, no later than the next working day from the date of receipt of the specified documents from the candidate are assigned.

6. The structural division to which safety functions are assigned based on information provided by the candidate performs check of its reliability and researches availability or absence at the candidate of conflict of interest.

7. Information provided by the candidate relatively is subject to check of reliability and the analysis:

involvement of the candidate to criminal liability, including for corruption offenses, availability of unspent conviction, etc.;

availability or lack of the fact of imposing on the candidate of administrative punishments for corruption offenses;

availability/no conflict of interest;

availability at the candidate of corporate laws;

education level;

observance by candidates of the legislation on conscription and military service.

8. It is performed in time, not exceeding ten working days from the date of giving by the candidate for structural division to which management functions by personnel of Fund, the relevant documents and information are assigned.

9. In case of failure to provide information by the candidate, the stipulated in Item 4 presents of the Section, and/or information which reliability is subject to check check of accuracy of the information, stipulated in Item 7 these Sections, is not made.

10. The structural division to which safety functions are assigned draws the conclusion by results of check in structural division to which management functions by personnel of Fund, in the form of the service record are assigned.

11. The decision on replacement with the candidate of vacant position in Fund is made by structural division to which management functions by personnel of Fund, taking into account the conclusion determined by Item 10 of these rules are assigned.

12. The division to which management functions by personnel of Fund are assigned notifies:
