About procedure for recognition of the project documentation of reuse by the cost-efficient project documentation of reuse

1. Approve the enclosed Rules of recognition of the project documentation of reuse by the cost-efficient project documentation of reuse.

2. Determine that:

a) prior to maintaining the unified state register of experimental testimonies of the project documentation of capital construction projects:

the executive bodies and the organizations authorized on conducting state examination of the project documentation (further - the expert organizations) within 3 working days after issue of the positive conclusion of state examination of the project documentation post data on such documentation on the official site of the expert organization on the Internet (further - Internet network) in the form of electronic documents in the form approved by the Ministry of Construction and Housing and Communal Services of the Russian Federation;

the choice of the project documentation of reuse for recognition by its cost-efficient project documentation of reuse is performed on the basis of the data specified in the paragraph the second this subitem, and information obtained by the Ministry of Construction and Housing and Communal Services of the Russian Federation within realization of powers, stipulated in Item 3 parts 3 of article 6.1 of the Town-planning code of the Russian Federation;

in addition to the documents specified in subitems "an" - "in" Item 3 of the Rules approved by this resolution the project documentation of reuse and the positive conclusion of state examination of such project documentation is submitted to the Ministry of Construction and Housing and Communal Services of the Russian Federation;

the systematized data on the cost-efficient project documentation of reuse (with indication of information on persons submitting such documentation to the bodies and the organizations specified regarding the 2nd article 48.2 of the Town-planning code of the Russian Federation) are placed the Ministry of Construction and Housing and Communal Services of the Russian Federation on the website determined by it in Internet network;

b) operation of this resolution does not extend to the project documentation if it contains data, access to which is limited in accordance with the legislation of the Russian Federation;

c) realization of the powers provided by this resolution is performed within the number of employees of central office of the Ministry of Construction and Housing and Communal Services of the Russian Federation, and also budgetary appropriations provided to the Ministry in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

3. To the Ministry of Construction and Housing and Communal Services of the Russian Federation:

a) approve form for placement of data on the project documentation concerning which the positive conclusion of state examination, on the official site of the expert organization in Internet network is issued;

b) determine the website in Internet network for placement of the systematized data on the cost-efficient project documentation of reuse.

4. This resolution becomes effective after one month from the date of its official publication.

Rules of recognition of the project documentation of reuse by the cost-efficient project documentation of reuse

1. These rules establish procedure for recognition of the project documentation of reuse by the cost-efficient project documentation of reuse.

2. The Ministry of Construction and Housing and Communal Services of the Russian Federation based on information included in the unified state register of experimental testimonies of the project documentation of capital construction projects (further - the unified register, the project documentation), performs the choice of the project documentation taking into account feasibility of its reuse by preparation of the project documentation in relation to similar to destination and design capacity, natural and other conditions of the territory in which it is planned to perform construction, capital construction projects which construction is provided with the bodies and the organizations specified regarding the 2nd article 48.2 of the Town-planning code of the Russian Federation and sends to the builder (the technical customer) who provided preparation of such project documentation of reuse (further - the customer), the requirement about submission of data on the project documentation of reuse for form according to appendix (further - data) and the documents confirming reliability of data.

3. The documents confirming reliability of data include:

a) positive conclusion about reliability of determination of estimated cost of asset construction of capital construction;

b) the document confirming transfer of exclusive right on the project documentation of reuse or the right to its reuse (including for preparation on its basis of the project documentation) to the Russian Federation, the subject of the Russian Federation or municipality;

c) the document confirming the power of the person which signed and (or) provided the data and documents confirming reliability of data to the Ministry of Construction and Housing and Communal Services of the Russian Federation for making of such actions on behalf of the customer (except as specified accomplishment of the specified actions directly the customer).

4. Within 10 working days from the date of receipt of the requirement about provision of data and the documents specified in Item 3 of this resolution (further - supporting documents) the customer provides submission of data and supporting documents to the Ministry of Construction and Housing and Communal Services of the Russian Federation in the form of signed by the strengthened qualified digital signature of electronic documents which format shall conform to the requirements approved by the Ministry for the electronic documents submitted for conducting state examination of the project documentation and (or) results of engineering researches.

If supporting documents are included in the unified register, the customer represents data.
