About approval of standards of the state services rendered by bodies of diplomatic service of the Republic of Kazakhstan

According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:

1. Approve enclosed:

1) the standard of the state Service "Documents Acceptance and Their Forwarding on Production of Passports to the Citizens of the Republic of Kazakhstan Who Are Abroad and Entering into Their Passports of Necessary Records" according to appendix 1 to this order;

2) the standard of the state service "Execution by Foreign Institutions of the Republic of Kazakhstan of Documents on Getting Out of Nationality of the Republic of Kazakhstan" according to appendix 2 to this order;

3) the standard of the state service "Issue, Prolongation of Entry Visas to the Republic of Kazakhstan and Transit through the Territory of the Republic of Kazakhstan" according to appendix 3 to this order;

4) the standard of the state Service "Registration of the Children Who Are Citizens of the Republic of Kazakhstan, Transferred to Adoption (Adoption) to Foreigners" according to appendix 4 to this order;

5)  No. 11-1-4/565 is excluded according to the Order of the Minister of Foreign Affairs of the Republic of Kazakhstan of 31.10.2019;

6) the standard of the state service "Legalization of Documents" according to appendix 6 to this order;

7) the standard of the state service "Issue of the Interim Certificate on the Swimming Right under National Flag of the Republic of Kazakhstan in case of Acquisition of the Vessel Abroad" according to appendix 7 to this order;

8) the standard of the state Service "Creation of the Act of the Ship's Protest in case of Ship-wreck of the Courts of the Republic of Kazakhstan Which Are Abroad" according to appendix 8 to this order.

2. To provide to department of consular service of the Ministry of Foreign Affairs of the Republic of Kazakhstan:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on official Internet resource of the Ministry of Foreign Affairs of the Republic of Kazakhstan.

3. I reserve control of execution of this order.

4. This order becomes effective after ten calendar days after day of its first official publication.

Standard of the state Service "Documents Acceptance and Their Forwarding on Production of Passports to the Citizens of the Republic of Kazakhstan Who Are Abroad and Entering into Their Passports of Necessary Records"

Chapter 1. General provisions

1. The state Service "Documents Acceptance and Their Forwarding on Production of Passports to the Citizens of the Republic of Kazakhstan Who Are Abroad and Entering into Their Passports of Necessary Records" (further – the state service).

2. The standard of the state service is developed by the Ministry of Foreign Affairs of the Republic of Kazakhstan (further – the Ministry).

3. The state service appears the Ministry of Internal Affairs of the Republic of Kazakhstan and foreign institutions of the Republic of Kazakhstan.

Documents acceptance and issue of results of rendering the state service are performed through foreign institutions of the Republic of Kazakhstan (further – the service provider).

Chapter 2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the date of delivery of document package to the service provider:

execution of the passport of the citizen of the Republic of Kazakhstan (further - the passport) - 80 (eighty) calendar days, in need of carrying out additional studying or check the term of rendering service is prolonged no more than for 10 (ten) calendar days;

entering into passports of parents of record about children aged up to 16 (sixteen) years in departure cases together with parents abroad with gluing in of their photos (further - entering of record into the passport) - 3 (three) working days;

2) the most allowed time of expectation in queue for delivery of document package - 60 minutes;

3) the most allowed time of servicing - 10 minutes.

5. Form of rendering the state service: paper.

6. Result of rendering the state service – execution of the passport of the citizen of the Republic of Kazakhstan or entering of record into the passport.

Form of provision of result of rendering the state service: paper.

7. The state service is rendered to physical persons (further - uslugopoluchatel) on paid basis at the rates of the consular fee according to the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget (Tax code)".

Payment of the consular fee is performed in cash or non-cash form through the banks of the second level or the organization performing separate types of banking activities.

The state service is rendered free of charge:

1) to Heroes of the Soviet Union, heroes of Socialist Work;

2) to the persons awarded with awards of Glory of three degrees and Labour Glory of three degrees, "the Three-copecks piece Kyran", Otan, awarded ranks "Halyk Kaharmany", "Kazakstannyn Enbek Er _";

3) to mothers having many children awarded the ranks "Mother heroine" awarded with suspension brackets "Three-copecks piece of alg", "Kumis of alg";

4) to participants of the Great Patriotic War and persons equated to them, persons awarded with awards and medals of the former Union of Soviet Socialist Republics (further - the USSR) for dedicated work and faultless military service in the back in days of the Great Patriotic War, to the persons who worked (served) at least six months from June 22, 1941 to May 9, 1945 and are not awarded with awards and medals of the former USSR for dedicated work and faultless military service in the back in days of the Great Patriotic War to disabled people, and also one of the disabled person's parents since the childhood;

5) aged, living in medico-social organizations for aged and disabled people of general type, to the orphan children and children without parental support who are on complete state providing, living in orphanages and (or) boarding schools;

6) to the citizens who were injured owing to the Chernobyl catastrophic crash.

8. Working schedule of the service provider: Monday through Friday inclusive, from 9:00 till 18:30 o'clock with lunch break from 13:00 till 14:30 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

Documents acceptance is performed from 09:30 till 12:30 o'clock, and issue of results of rendering the state service from 16:00 till 17:00 o'clock. Environment not visiting day.

9. List of the documents necessary for rendering the state service in case of the personal address of uslugopoluchatel to the service provider:

1) for execution of the passport:

the statement constituted in any form;

the certificate of birth (in case of receipt of the passport by the child which did not reach 16-year age);

the passport of the citizen of the Republic of Kazakhstan (in case of exchange of the passport);

four color photos the size 3, 5kh 4,5 of centimeters (further - cm) (photos shall correspond to age of uslugopoluchatel at the time of execution of the document and are executed strictly in fullface on light background with neutral look and the closed mouth in which person occupies about 75% of total area of the photo. Photos are carried out by photo printing method from one negative on dense photographic paper. Use of the images made by method of computer scanning, modeling or photocopying is not allowed);

the passport of sample of 1974 (the former USSR) - when obtaining for the first time passports the citizen of the Republic of Kazakhstan (in case of confirmation of nationality of the Republic of Kazakhstan);

the all-foreign passport (the former USSR) - when obtaining for the first time passports the citizen of the Republic of Kazakhstan (in case of confirmation of nationality of the Republic of Kazakhstan);

the document confirming the fact of permanent residence, training, work abroad, marital status (the original and the copy);

the certificate of lack of nationality from competent authority of adoptive state if possibility of receipt of such reference it is stipulated by the legislation adoptive states;

the original document, the consular fee confirming payment.

2) for entering of record into the passport:

the statement constituted in any form;

certificate of birth of the child;

passport of the citizen of the Republic of Kazakhstan;

two color photos size 3, 5kh cm 4,5;

the original document, the consular fee confirming payment.

Documents which are issued or attested competent organization of foreign state or specially on that the authorized person, within its competence and in the established form sealed official foreign state are adopted only after passing procedures of the special certificate (legalization or apostilization).

In case of delivery uslugopoluchatel of all necessary documents to the service provider confirmation of adoption of the statement on paper is the mark in its copy with indication of date of its obtaining, surname, name, middle name (in case of its availability) the accepted person and time of acceptance of document package.

9-1. The service provider refuses rendering the state services in the following bases:

1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

2) discrepancy of uslugopoluchatel and (or) provided supplied and the information necessary for rendering the state service, to requirements of the Law of the Republic of Kazakhstan "About identity documents", "Rules of registration, issue, replacement, delivery, withdrawal and destruction of the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan, the residence permit of the foreigner in the Republic of Kazakhstan, certificates of the stateless person and the certificate of the refugee", approved by the order of the Government of the Republic of Kazakhstan of August 26, 2013 No. 852;

3) the negative reply of authorized state body to request about coordination which is required for rendering the state service.

In case of provision by uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 these standards of the state service, and (or) documents with the expired effective period the service provider refuses reception of an application, at the same time the service provider issues the receipt on refusal in documents acceptance.

Chapter 3. Procedure for appeal, actions (bezdeystviye) of the central state body, and also the service provider and (or) his officials concerning rendering the state service

10. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials concerning rendering the state services: the claim is submitted addressed to the head of the service provider to the address specified in Item 12 of the present of the state service of the standard.

The claim is submitted purposely through office of the service provider, in writing by mail or by means of the web portal of "the electronic government".

Confirmation of adoption of the claim is its registration (stamp, the entering number and date) in office of the service provider with indication of surname and initials of person which accepted the claim, term and the place of receipt of the answer to the made complaint.

In the claim of uslugopoluchatel its surname, name middle name, the postal address, reference number and date is entered. The claim is signed by uslugopoluchatel.

The claim of uslugopoluchatel which arrived to the service provider or the Ministry is subject to consideration within five working days from the date of its registration.

In case of disagreement with results of the rendered state service the uslugopoluchatel can address with the claim to authorized body

by assessment and control of quality of rendering the state services.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is considered within fifteen working days from the date of its registration.

11. In disagreement cases with results of the rendered state service, the uslugopoluchatel has the right to take a legal action in the procedure established by the legislation of the Republic of Kazakhstan.

Chapter 4. Other requirements taking into account features of rendering the state service

12. Addresses of places of rendering the state service are placed on the Internet resource of the Ministry: www.mfa.gov.kz.

13. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service by means of single contact center concerning rendering the state services.

14. Contact telephone numbers of service desks concerning rendering the state service are specified the Internet the www.mfa.gov.kz resource., the Section "State Services", single contact center concerning rendering the state services: 1414, 8 800 080 7777.
