About approval of some regulations to destination and pension payment to government employees

(as amended on 14-12-2020)

The government DECIDES:

1. Approve:

Regulations on procedure for appointment and pension payment to government employees according to appendix No. 1;

The list of the public authorities operating before entry into force of the Civil service law N 443-XIII of May 4, 1995 and the state positions of these bodies according to appendix No. 2 (option in the Moldavian language).

2. Declare invalid the Order of the Government N 693 of July 24, 1997. "About approval of the Regulations on procedure for appointment and pension payment to government employees" (The official monitor of the Republic of Moldova, 1997, N 49-50, Art. 536).

Regulations on procedure for appointment and pension payment to government employees

I. General provisions

1. This Provision regulates procedure for appointment and pension payment to government employees since January 1, 2017 according to part provisions (6) articles VIII of the Law No. 290 of December 16, 2016 on modification and amendments in some legal acts.

1-1. The appointment conditions provided by this Provision are applied to government employees who for January 1, 2017 confirm insurance years of service in 33 years for men, 30 years for women and at least 15 years in public service according to the provisions of Chapters V and VI of the Pensions act of the national social insurance No. 156-XIV of October 14, 1998 operating till January 1, 2017.

II. Purpose of pensions

2. Insured persons with the status of the government employee have pension entitlement according to Item 11 in case of achievement of the retirement age provided in the table 1, and in case of confirmation of the necessary insurance years of service provided in table 2.

3. Also the insured persons which do not have the status of the government employee, reached retirement age 62 years for men and 57 years for women having for January 1, 2017 insurance years of service 33 years for men and 30 years for women and confirming at least 15 years of insurance years of service in public service have pension entitlement.

Since July 1, 2017 the pension entitlement is appointed in case of confirmation of the necessary insurance years of service provided in table 2.

4. The size of the pension established according to Items 2 and 3 of this provision constitutes 75% of the average monthly insured income determined according to Chapter IV of this provision.

5. The pension entitlement of the government employee is granted by territorial cash desk of social insurance (further - territorial cash desk) at the place of residence of person having this right.

6. For award of pension person having pension entitlement of the government employee submits the application for award of pension and the following documents to territorial cash desk:

a) the identity certificate in the original and in the copy;

b) the service record in the original and the statement from the service record in the copy;

c) the diploma about education in the original and in the copy;

d) the military ID in the original and the statement from the military ID in the copy;

e) the certificate of the gained income issued by accounts department of the organization, organization, the company from place of employment;

f) if necessary and other documents.
