About approval of Sanitary standards and the rules "Requirements to Atmospheric Air of Settlements and Places of Mass Rest of the Population" and recognition No. 77 which voided resolutions of the Ministry of Health of the Republic of Belarus of June 30, 2009

Based on article 13 of the Law of the Republic of Belarus of January 7, 2012 "About sanitary and epidemiologic wellbeing of the population", paragraph two of subitem 8.32 of Item 8 of the Regulations on the Ministry of Health of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 28, 2011 No. 1446 "About some questions of the Ministry of Health and measures for implementation of the Presidential decree of the Republic of Belarus of August 11, 2011 No. 360" the Ministry of Health of the Republic of Belarus DECIDES:

1. Approve the enclosed Sanitary standards and the rules "Requirements to Atmospheric Air of Settlements and Places of Mass Rest of the Population".

2. Declare invalid the resolution of the Ministry of Health of the Republic of Belarus of June 30, 2009 No. 77 "About approval of Sanitary standards, rules and hygienic standard rates "Hygienic requirements to quality assurance of atmospheric air of settlements and vacation spots of the population" and recognition No. 146 which voided resolutions of the Chief state health officer of the Republic of Belarus of December 30, 2002".

3. This resolution becomes effective in fifteen working days after its signing.

Sanitary standards and rules "Requirements to Atmospheric Air of Settlements and Places of Mass Rest of the Population"

Chapter 1. General provisions

1. These Sanitary standards and rules establish sanitary and epidemiologic requirements to atmospheric air of settlements and places of mass rest of the population in case of placement, design, construction and operation of the objects of social, production, transport, engineering infrastructure connected with emissions of pollutants in atmospheric air (further, unless otherwise specified, - objects).

2. For the purposes of these Sanitary standards and rules the main terms and their determinations in the values established by the Law of the Republic of Belarus of January 7, 2012 "About sanitary and epidemiologic wellbeing of the population" are used (The national register of legal acts of the Republic of Belarus, 2012, No. 8, 2/1892), the Law of the Republic of Belarus of December 16, 2008 "About protection of atmospheric air" (The national register of legal acts of the Republic of Belarus, 2009, No. 4, 2/1554), and also the following terms and their determinations:

the place of mass rest of the population - the territory in borders of the resort area, resorts, natural and recreational zones (rest areas), recreational zones of settlements, zones of recreation of water objects, and also in borders of objects of sanatorium treatment and improvement, intended for the organization of sanatorium treatment, improvement, tourism and rest of the population;

the settlement - compactly populated part of the territory of the Republic of Belarus, the permanent address of citizens having life activities of citizens, necessary for providing, residential and other buildings and constructions, the name and borders established in the appropriate order.

3. These Sanitary standards and rules are obligatory for observance by state bodies, other organizations, physical persons, including individual entrepreneurs.

4. The state sanitary inspection behind respect for these Sanitary standards and rules is performed according to the procedure, established by the legislation of the Republic of Belarus.

5. Perpetrators bear responsibility according to legal acts of the Republic of Belarus for violation of these Sanitary standards and rules.

Chapter 2. Requirements to atmospheric air in case of placement, design, construction and operation of objects

6. In the territories of living, public and business, recreational areas of settlements and places of mass rest of the population exceeding of standard rates of threshold limit values of pollutants in atmospheric air (further - maximum allowable concentration) or approximate safe levels of impact of pollutants in atmospheric air of settlements and places of mass rest of the population is not allowed (further - HAVING PUT).

7. Or HAVING PUT on respect for maximum allowable concentration it shall be provided taking into account effects of summation of the contaminating chemicals in atmospheric air.

8. The parcel of land for placement, design and construction of facilities shall be chosen taking into account the aero climatic characteristic, land relief, patterns of distribution of emissions of the pollutants in atmospheric air providing including the requirement to atmospheric air of settlements and places of mass rest of the population.

9. In case of placement, design, construction and operation of objects measures for decrease in emissions of pollutants in atmospheric air to the indicators providing observance of standard rates of maximum allowable concentration shall be taken or HAVING PUT, with use of low-waste and wasteless technologies, and also actions for decrease or prevention, including neutralization, emissions of pollutants.

10. It is not allowed to place, design, perform construction and operation of objects as a part of which emissions there are pollutants:

not having approved in the procedure for maximum allowable concentration established by the legislation of the Republic of Belarus or HAVING PUT;

which content exceeds standard rates of maximum allowable concentration or HAVING PUT in the corresponding territory.

11. The organizations and individual entrepreneurs in case of operation of objects shall:

develop and implement plans of the organizational and technical or other actions directed to prevention and decrease in levels of chemical, biological impacts on atmospheric air of settlements and places of mass rest of the population;

carry out acceptance for operation of construction objects, their separate queues, processing lines, and also expansion or increase in capacity of objects after receipt of the positive sanitary and hygienic conclusion issued by the bodies and organizations exercising the state sanitary inspection by results of the state sanitary and hygienic examination;

perform carrying out production supervision within the competence;

provide reducing or exception of emissions of pollutants in atmospheric air in case of exceeding of standard rates of maximum allowable concentration or HAVING PUT;

ensure smooth operation of systems and the equipment on cleaning of emissions of pollutants in atmospheric air;
