According to the subitem g) parts (2) article 7 of the Law on public service of water supply and the sewerage No. 303 of December 13, 2013 (The official monitor of the Republic of Moldova, 2014, No. 60-65, of the Art. 123), the Administrative board of the National agency on regulation in power DECIDES:

1. Approve Regulations on indicators of quality of public service of water supply and the sewerage it (is applied).

2. To impose control of observance of the approved Provision on divisions of the National agency on regulation in power.

Regulations on indicators of quality of public service of water supply and sewerage

Section 1 Scope

1. Regulations on indicators of quality of public service of water supply and the sewerage (further - the Provision) establish indicators of quality of the public service of water supply and the sewerage and condition provided by operators which shall be observed by them.

2. Requirements of this provision are applied in the relations between the operators providing public service of water supply and the sewerage and consumers. In case of consumers who have several places of consumption requirements of this provision are applied to each place of consumption separately.

3. Requirements of this provision are not applied:

a) in case of force majeure;

b) in case of the actions taken by the third parties leading to violation of provision of public service of water supply and the sewerage;

c) in need of increase in consumption of water in places where it is necessary to extinguish the fires.

Section 2 Basic concepts

4. In the this provision sense the used concepts and terms mean the following:

technical defect – violation of functioning of public water supply system and the sewerage in comparison with extreme values, technical, technological and normative working parameters;

indicators of quality of public service of water supply and the sewerage - parameters of public service of water supply and the sewerage which limits are set by value of the certain normative parameters obligatory for the operators providing this service;

informing – periodic provision to information users about the provided public service of water supply and the sewerage;

the planned break in provision of public service of water supply and the sewerage – the temporary break in water supply/acceptance of sewage with the prior notice of consumers caused by need of accomplishment by the operator of works on maintenance and/or the planned repair for public systems of the water supply/sewerage on connection/accession of internal installations of the water supply/sewerage of new consumers, without disconnection of internal installations of the water supply/sewerage of consumers from public network of the water supply/sewerage;

unplanned break in provision of public service of water supply and the sewerage – the temporary break in water supply, acceptance of sewage caused by accidents which happened in public water supply system and the sewerage, without disconnection of internal installations of the water supply/sewerage of consumers from public network of the water supply/sewerage;

public service of water supply and the sewerage – set of the types of activity necessary for intake of unboiled water from superficial or underground sources, processings of unboiled water, transportation of drinking and/or technological water, accumulating of water, distribution of drinking and/or technological water, collection, transportation and dumping of the sewage arriving from consumers into treatment facilities, sewage treatment and dumping of the purified water into the receiver;

the term of elimination of technical defects in public water supply system – the period calculated in hours from the moment of cutoff of water and before elimination of technical defect on which the claim, and return of public system to normative working parameters arrived;

the term of elimination of technical defects in public system of the sewerage - the period calculated in hours from stage of receipt by the operator of the claim to technical defect by provision of public service of the sewerage and to stage of elimination of technical defect on which the claim, and return of public system to normative working parameters arrived.

Section 3 Continuity of Provision of Public Service of Water Supply and Sewerage

5. Operators shall provide continuous and reliable provision of public service of water supply and the sewerage to consumers according to the quality indicators established by this Provision.

6. The operator registers all breaks in provision of public service of water supply and the sewerage. The planned and unplanned breaks are registered separately. Unplanned breaks are registered by means of the automated means of the operator providing public service of water supply and the sewerage or, in case of their absence, on the basis of messages and/or calls of the final consumers registered by the round-the-clock telephone service. Duration of break is estimated from the moment of its registration until service provision renewal. On each of unplanned breaks the break reason is registered:

a) force majeure or special weather conditions;

b) malfunctions in installations for consumption of final consumers;

c) the events caused by the third parties;

d) accident in networks and installations of water supply and/or the sewerage, and also sharp and strong quality degradation of water at fence source as a result of high concentration of pollutants in water, in this case needs the urgent termination of distribution of water and/or acceptance of sewage;

e) order of territorial authorities of sanitary inspection and environmental protection;

f) other reasons.

7. In each case of break marks about date and time, the period, and also marks about the number of the consumers affected by break, with indication of types of consumers are brought. In cases when functioning in the set parameters of public water supply system and the sewerage is not provided, consumers can make complaints to service quality.

8. Duration of the planned break in provision of public service of water supply and the sewerage shall not exceed:
