Being guided by Items 8 and 39 of the Protocol on measures of the state support of agricultural industry (appendix №29 to the Agreement on the Eurasian Economic Union of May 29, 2014) and according to Item 77 of appendix №1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 №98, Council of the Eurasian economic commission decided:

1. Approve enclosed:

Methodology of calculation of allowed level of the measures of the state support of agricultural industry making the distorting impact on mutual trade of state members of the Eurasian Economic Union in agricultural goods;

notification form of the programs of the state support of agricultural industry planned in the current year;

form of the notification on the provided state support of agricultural industry in reporting year.

2. Declare invalid the Decision of Board of the Eurasian economic commission of July 2, 2014 №96 "About form of the notification on amounts of the state support of agricultural industry of state member of the Customs union and the Common economic space".

3. This Decision becomes effective after 30 calendar days from the date of its official publication.

Methodology of calculation of allowed level of the measures of the state support of agricultural industry making the distorting impact on mutual trade of state members of the Eurasian Economic Union in agricultural goods

1. This Methodology is developed according to the paragraph the second Item 8 of the Protocol on measures of the state support of agricultural industry (appendix №29 to the Agreement on the Eurasian Economic Union of May 29, 2014) (further – the Protocol) for the purpose of unification in state members of the Eurasian Economic Union (further respectively – state members, the Union) procedure of payments of amount and level of the measures of the state support of agricultural industry making the distorting impact on mutual trade of state members in agricultural goods (further – the support measures distorting trade).

2. State members are guided by this Methodology when calculating obligations of the state members provided by the paragraph 3 Item 8 of the Protocol and preparation of notifications according to the Section VI of the Protocol.

3. Classification of measures of the state support of agricultural industry is performed according to the Protocol.

4. For the purposes of this Methodology concepts which mean the following are used:

"base period" – the period determined during consultations and negotiations of state members lasting at least 3 years in a row for which indicators are used for calculation of annual average amount of the measures of support distorting trade;

"admissible threshold level" – the threshold value established as a percentage within which the supports given measure do not join in final amount of the measures of support distorting trade;

"the allowed level died supports, distorting trade" – the most admissible level died supports, distorting trade, established in the form of limiting absolute value and (or) size of admissible threshold level of support.

5. Calculation of amount died supports, distorting trade, is performed according to Item 10 of the Protocol in national currency and in US dollars on the annual average official rate.

8. Admissible threshold level is calculated as the relation:

amount of the measures of support distorting trade, connected with specific agricultural goods to total cost of production of such goods (the total cost of production of the goods (goods) received (received) as a result of processing of agricultural products is equal to the cost of the corresponding type of the agricultural products directed for production of it (these) of goods (goods));

amount of the measures of support distorting trade, which are not connected with specific agricultural goods to total cost of production of agricultural products.

9. Admissible threshold level is determined during consultations and negotiations of state members and cannot constitute less than 5 percent.

10. When calculating price support in quality of the posted world price its fixed value is applied (before approval of obligations of state member on allowed level of the measures of support distorting trade – its size for the accounting period).

The fixed posted world price is average price on delivery conditions of FOB of agricultural goods in base period if the state member is net exporter of these goods, or average price on delivery conditions of CIF of agricultural goods in base period if the state member is net importer of these goods, or taking into account other delivery conditions according to data of customs statistics of state members.
