About the technical regulation of the Eurasian Economic Union "About safety of fish and fish products"

According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 29 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Council of the Eurasian economic commission decided:

1. Accept the enclosed technical regulation of the Eurasian Economic Union "About safety of fish and fish products" (TR EEU 040/2016).

2. Determine that the technical regulation of the Eurasian Economic Union "About safety of fish and fish products" (TR EEU 040/2016) becomes effective since September 1, 2017, except for Item 15 regarding control of content of remaining balance of veterinary medicines, growth factors of animals (including hormonal medicines), medicines (including antimicrobic means, except for levomitsetin (chloramphenicol), tetracycline group and bacitracin) in food products of aquaculture of animal origin based on information on their application provided by the manufacturer who becomes effective after development of the corresponding interstate standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of the specified requirement, and also techniques of researches (testing) and measurements (validirovanny) and approved according to the legislation state members of the Eurasian Economic Union, and their entering into the list of standards determined by item 4 of the Protocol on technical regulation within the Eurasian Economic Union certified (appendix No. 9 to the Agreement on the Eurasian Economic Union of May 29, 2014).

3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

The technical regulation of the Eurasian Economic Union "About safety of fish and fish products" (TR EEU 040/2016)

This technical regulation is developed according to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014.

This technical regulation establishes obligatory for application and execution in the territory of the Eurasian Economic Union (further – the Union) safety requirements of the food fish products released in the territory of the Union and the related requirements to production processes, storages, transportations, realization and utilizations, and also requirements to marking and packaging of food fish products for ensuring its free movement.

If concerning food fish products other technical regulations of the Union (technical regulations of the Customs union) establishing safety requirements of food fish products and the related requirements to production processes, storages, transportations, realization and utilizations and also requirements to marking and packaging of food fish products, food fish products and the related production processes, storages, transportations, realization and utilizations are accepted, and also marking and packaging of food fish products shall conform to requirements of all technical regulations of the Union (technical regulations of the Customs union) which action extends to them.

I. Scope

1. This technical regulation is developed for the purpose of protection of life and health of the person, animals and plants, property, the environment, the prevention of the actions misleading consumers of food fish products concerning its appointment and safety.

2. This technical regulation extends to the food fish products released in the territory of the Union.

Objects of technical regulation of this technical regulation are:

a) the food fish products received from catch of water biological resources and objects of aquaculture, plant and animal origin in the processed or not processed type, including the following types:

live fish and live water invertebrates;

fish raw (fresh), fresh water invertebrates, fresh water mammals, seaweed raw (fresh) and fresh water plants;

frozen-cooked water invertebrates, seaweed and other water plants;

the cooled food fish products;

the frozen food fish products;

frozen food fish products;

the pasteurized food fish products;

dried food fish products;

dried food fish products;

dried and dried food fish products;

marinated food fish products;

salty food fish products;

smoke-cured food fish products;

food fish products of cold smoking;

the slightly smoked food fish products;

provesny food fish products;

food fish products for baby food, including food products of feeding up on vegetable and fish basis, food products of feeding up on rybo-vegetable basis, food products of feeding up on fish basis;

fish culinary product;

fish culinary semifinished product;

forcemeat from food fish products;

fish canned food;

natural fish canned food;

natural fish canned food with oil addition;

semi-canned food fish;

preserved food;

granular caviar;

unscreened roe;

caviar grain;

the pasteurized caviar of fish;

pressed caviar;

screened salty caviar;

caviar fish product;

fat food of fish, water invertebrates and water mammals;

hydrolyzate from food fish products;

the imitated food fish products;

b) production processes, storages, transportations, realization and utilizations of food fish products.

This technical regulation "The food products regarding its marking" establish obligatory for application and execution in the territory of the Union of the requirement to marking and packaging of food fish products, the supplementing requirements of the technical regulation of the Customs union (TR CU 022/2011) accepted by the Decision of the Commission of the Customs union of December 9, 2011 No. 881 (further – the technical regulation of the Customs union "Food products regarding its marking" (TR CU 022/2011)), and the technical regulation of the Customs union "About safety of packaging" (TR CU 005/2011) accepted by the Decision of the Commission of the Customs union of August 16, 2011 No. 769 (further – the technical regulation of the Customs union "About the safety of packaging" (TR CU 005/2011)) and which are not contradicting them.

3. Action of this technical regulation does not extend on:

a) processes of cultivation and cultivation (growing) of fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants;

b) specialized food fish products (except for food fish products for baby food);

c) dietary supplements to food and nutritional supplements which are made on the basis of fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants;

d) production processes, storages, transportations and utilizations of the food fish products of nonindustrial production intended for release into the stream of commerce in the territory of the Union;

e) the food fish products made by citizens in house conditions and (or) in personal subsidiary farms, and the takzheprotsessa of production, storage, transportation and utilization of such products intended only for private consumption and not intended for release into the stream of commerce in the territory of the Union;

e) products from Amphibia and reptiles;

g) non-food fish products.

II. Basic concepts

4. For the purposes of application of this technical regulation the concepts established by the technical regulation of the Customs union "About safety of food products" are used (TR CU 021/2011) made by the Decision of the Commission of the Customs union of December 9, 2011 No. 880 (further – the technical regulation of the Customs union "About safety of food products" (TR CU 021/2011)), the technical regulation of the Customs union "Food products regarding its marking" (TR CU 022/2011), and also concepts which mean the following:

"frozen-cooked water invertebrates" – the water invertebrates who are previously boiled thoroughly before complete coagulation of protein and refrigerated up to the temperature are not higher minus 18 degrees With;

"frozen-cooked seaweed and other water plants" – the seaweed and other water plants which are boiled thoroughly to elastic dense consistence and refrigerated up to the temperature are not higher
minus 18 degrees With;

"seaweed raw (fresh) and fresh water plants" – the seaweed and other water plants withdrawn from water and keeping color, smell, elasticity of fabrics and film of water inherent in them on surface;

"dried food fish products" – the food fish products made from previously salted fishes, water invertebrates, water mammals and other water animals in the course of jerking, with mass fraction of moisture at least 30 percent, having dense consistence and properties of the ripened product;

"hydrolyzate from food fish products" – the food fish products made of tissues of fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants in the course of hydrolysis;

"glazing" – process of formation of protective layer of ice on surface of frozen food fish products in case of irrigation or its immersion in drinking or clear water with the nutritional supplements dissolved in it or without them;

"deep dehydration of food fish products" – the loss of fabric juice on products surface from fish, water invertebrates, water mammals and other water animals which is shown in tarnishing of surface of frozen products, availability of white and (or) yellow spots which got into thickness of muscular tissue and are not removed mechanically without appearance violation;

"live fish" – the fish swimming in the natural or brought closer to her habitat with natural movements of body, jaws, branchiate covers;

"live water invertebrates" – erinaceouses, mollusks, cancroid with availability of characteristic reactions for each type to the made mechanical impacts which are stored in the conditions providing their life activity;

"fat food of fish, water invertebrates and water mammals" – the food fish products made of fat-containing raw materials of fish, water invertebrates and water mammals with addition or without addition of nutritional supplements and (or) fragrances;

"granular caviar" – the food fish products made of caviar grain of fish of family salmon or families sturgeon, processed by table salt or mix of table salt with nutritional supplements, with addition or without addition of vegetable oil;

"manufacturer" – the legal entity or physical person registered as the individual entrepreneur, including the foreign manufacturer performing on its own behalf production or production and realization of food fish products and responsible for its compliance to requirements of technical regulations of the Union (technical regulations of the Customs union);

"caviar fish product" – the food fish products made of the whole or cut on part roe films of caviar or of caviar grain of fish, mollusks and erinaceouses with addition of components of food products (food ingredients), ready
to the use;

"calves grain" – the berries of fish, mollusks and erinaceouses separated connecting fabric of yastyk;

"caviar unfiltered" – the food fish products made of the whole or cut on pieces roe films of fish, mollusks and erinaceouses in the cooled, frozen, salty, smoked or dried types;

 "the imitated food fish products" – the food fish products reproducing organoleptic indicators of the set simulated product (for example, "caviar analogs", "the products structured" "crabsticks");

"marinated food fish products" – the food fish products made of fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants, processed by mix of table salt, sugar, spices and food acid;

"frozen food fish products" – fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants, including products from them subjected to process of freezing up to the temperature in the thickness of product are not higher minus 18 degrees With;

"availability of parasites (parasitic defeats)" – availability of parasites, accumulations of the parasites or their remaining balance in food fish products having appearance, color and the size which allow to distinguish them from muscular tissue of fish, water invertebrates, water mammals and other water animals in case of visual inspection and (or) with use of other control methods;

"natural fish canned food" – the food fish products made of fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants, with addition or without addition to the main components of spices, in hermetically to the corked packaging, without preliminary thermal treatment of components, subjected to sterilization;

"natural fish canned food with oil addition" – the food fish products made of fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants without preliminary thermal treatment with addition of vegetable oil, either pork fat, or fat of liver in which the mass fraction of sediment in oil is not normalized, in hermetically the corked packaging, subjected to sterilization;

"not processed food fish products" – the food fish products made of fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants, which did not undergo conversion (processing);

"not processed food fish products of animal origin" - the food fish products made of fish, water invertebrates, water mammals and other water animals, which did not undergo conversion (processing);

"the cooled food fish products" – fish, water invertebrates, water mammals and other water animals, and also the seaweed and other water plants subjected to chilling process without reaching temperature of freezing of fabric juice, and also products from them subjected to process of chilling up to the temperature in the thickness of product is not higher than 5 degrees With;

"pasteurization" – the thermal treatment of products at temperature from 60 degrees With to 100 degrees With ensuring it safety and microbiological stability at certain temperature of storage during limited expiration date;

"the pasteurized caviar of fish" – the food fish products made of caviar grain of fish, processed by table salt or mix of table salt with nutritional supplements, in hermetically to the corked packaging, subjected to pasteurization;

"the pasteurized food fish products" – the food fish products made with addition or without addition of garnishes, sauces, fillings, in hermetically to the corked packaging, subjected to pasteurization;

"pressed caviar" – the food fish products made from salted in the warmed-up saturated solution of table salt of caviar grain with the subsequent pressing before receipt of homogeneous mass;

"the processed food fish products" – the food fish products made of fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants, which underwent conversion (processing);

"the processed food fish products of animal origin" - the food fish products made

from catch of water biological resources of animal origin and food products of aquaculture of animal origin, undergone conversion (processing);

"conversion (processing)" – heat treatment (except freezing and chilling), smoking, conservation, maturing, the ambassador, drying, pickling, concoction, extraction, extrusion or combination of these processes;

"food products of aquaculture of animal origin" - the fish, water invertebrates, water mammals and other water animals taken (caught) from semi-free conditions their contents, cultivation or artificially created habitat;

"food products of aquaculture of plant origin" - the seaweed and other water plants taken (caught) from semi-free conditions their contents, cultivation or artificially created habitat;

"food products of feeding up on vegetable and fish basis" – the food fish products for baby food intended
for food of children of early age, made of vegetable components (fruits, vegetables, grain, flour) and from fish of different types, containing from 8 to 18 percent of muscular tissue of fish from product lump;

"food products of feeding up on fish basis" – the food fish products for baby food intended for food of children of early age, made of fish of different types, containing over 40 percent of muscular tissue of fish from product lump;

"food products of feeding up on rybo-vegetable basis" – the food fish products for baby food intended for food of children of early age, made of fish of different types with addition of vegetable components (fruits, vegetables, grain, flour), containing over 18 to 40 percent of muscular tissue of fish from product lump;

"food fish products" – fish (including live fish and fish raw (fresh)), water invertebrates (including live and fresh water invertebrates), water mammals (including fresh water mammals) and other water animals, and also seaweed (including seaweed raw (fresh)) and other water plants (including fresh water plants), including products from them, in not processed or processed (processed) type which are intended for the use by the person in food;

"smoke-cured food fish products" – the food fish products made from previously salted fishes, water invertebrates, water mammals and other water animals in the course of smoke-cured and having in color, smell and taste of smoked products, completely boiled thoroughly;

"food fish products for baby food" – the food fish products intended for baby food (for children of early age from 8 months to 3 years, children of preschool age from 3 to 6 years, children of school age of 6 years also is more senior), which are meeting the corresponding physiological requirements of children's organism and not doing harm to health of the child of the corresponding age;

"food fish products of plant origin" - the food fish products made of catch of water biological resources of plant origin and food products of aquaculture of plant origin;

 "food fish products of cold smoking" – the food fish products made from previously salted fishes, water invertebrates, water mammals and other water animals in the course of the smoke, smokeless or mixed methods of cold smoking and having in color, smell and taste of smoked products;

 "the slightly smoked food fish products" – the food fish products made from previously salted fishes, water invertebrates, water mammals and other water animals in the course of the smoke, smokeless or mixed methods of cold smoking and having light smell and taste of smoked products;

"the frozen food fish products" – fish, water invertebrates, water mammals and other water animals, and also the seaweed and other water plants subjected to process of freezing up to the temperature at 1 degrees With or 2 degrees From lower than temperature of freezing of fabric juice in them;

"fish semi-canned food" – the food fish products in hermetically to the corked packaging subjected to the thermal treatment providing death of the not heat-resistant, asporous microflora reducing quantity of spore-forming microflora and guaranteeing microbiological stability and safety of product at temperature of storage is not higher than 6 degrees With during the expiration date established by the manufacturer;

"preserved food" – salty food fish products which content from net weight constitutes at least 65 percent for fish, 55 percent – for water invertebrates, caviar, water mammals and other water animals, and also seaweed and other water plants, with mass fraction of table salt no more than 8 percent, with addition or without addition of nutritional supplements, garnishes, sauces, fillings, in densely and (or) hermetically to the corked consumer packaging, subject to storage in accordance with the terms, established by the manufacturer;

"screened salty caviar" – the food fish products made of caviar grain of fish (except for fishes of family sturgeon and families of salmons), mollusks, erinaceouses, processed by table salt or mix of table salt with nutritional supplements;

"provesny food fish products" – the food fish products made from previously salted fishes, water invertebrates, water mammals and other water animals in the course of drying jerking to the established mass fraction of moisture, having slightly condensed juicy consistence and properties of the ripened product;

"the distribution and cleaning center" – installation with clear flowing or drinking water in which place live clams for time necessary for their biological cleaning, sorting and packing;

"(fresh) fish raw" – the fish without life signs who is at temperature is not higher than temperature of the habitat or cooled;

"fish culinary product" – the food fish products made with addition or without addition of food components and (or) nutritional supplements ready to consumption after thermal treatment or without it;

"fish canned food" – the food fish products made of fish, water invertebrates, water mammals and other water animals, and also seaweed and other water plants which mass fraction from net weight constitutes at least 50 percent with addition or without addition of nutritional supplements and fragrances, sauces, garnishes, fillings, in hermetically to the corked packaging, subjected to sterilization;

"fish waste" – food (food) raw materials, unsuitable for production of food fish products, or not used remaining balance of these products formed in production process of food fish products;

"fish culinary semifinished product" – food fish products with addition or without addition of food components and (or) nutritional supplements, passed one stage of culinary processing or more, without bringing to readiness;

"fresh water invertebrates" – the Crustacea, mollusks and erinaceouses withdrawn from water, keeping the life signs which are at temperature close to habitat temperature;

"fresh water mammals" – the water mammals without life signs who are at temperature are not higher than temperature of the habitat or cooled;

"the owner of food fish products" - the physical person or legal entity having the property right, acting as the owner, the manager or the user of food fish products;

"salty food fish products" – the food fish products processed by table or sea salt with addition or without addition of spices, their extracts, sugar, nutritional supplements, ready to the use;

"sterilization of canned food" – the thermal treatment of products at temperature over 100 degrees With providing industrial sterility of canned food under the storage conditions established by the manufacturer, transportations and realization during the limited term of their validity;

"dried food fish products" – the food fish products made from previously salted fishes, water invertebrates, water mammals and other water animals, and also seaweed and other water plants in the course of drying to mass fraction of moisture no more than 20 percent;

"dried and dried food fish products" – the food fish products made from previously salted fishes, water invertebrates, water mammals and other water animals in the course of drying jerking to mass fraction of moisture over 20 to 30 percent;

"catch of water biological resources of animal origin" - the fish, water invertebrates, water mammals and other water animals taken (caught) of the native habitat;

"catch of water biological resources of plant origin" - the seaweed and other water plants taken (caught) of the native habitat;

 "person authorized by the manufacturer" – the legal entity or physical person registered in the procedure established by the legislation of state member of the Union in its territory as the individual entrepreneur which based on the contract with the manufacturer, including the foreign manufacturer, perform actions on behalf of this manufacturer in case of assessment of conformity and release into the stream of commerce of food fish products in the territory of the Union and also bear responsibility for discrepancy of food fish products to requirements of this technical regulation and other technical regulations of the Union (technical regulations of the Customs union) which action extends to it;

"forcemeat from food fish products" – the food fish products made of fish, water invertebrates, water mammals and other water animals in the course of crushing to homogeneous mass;

"fikotoksina" – the natural toxic agents produced by some types of seaweed and microseaweed and capable to accumulate in mollusks (except cephalopods) and internals of crabs;

"clear water" – sea or fresh water, including the disinfected (purified) water which does not contain microorganisms, hazardous, radioactive materials and toxic plankton in the quantities capable to cause damage to safety of food fish products.

III. Identification of food fish products

5. Identification of food fish products is carried out by one or several of the following methods:

a) method according to the name - by comparison of the name of food fish products specified in marking on consumer packaging, shipping package and (or) the accompanying document with the name specified in determination of type of food fish products, established by this technical regulation;

b) visual method – by comparison of appearance of food fish products with the signs specified in determination of such food fish products in this technical regulation and (or) in the document according to which products are made;

c) organoleptic method - by comparison of organoleptic indicators of food fish products with the signs specified in determination of such food fish products in this technical regulation and (or) in the document according to which products are made;

d) analytical method - by check of compliance of morphological, physical, chemical, biochemical and microbiological indicators of food fish products to the signs specified in determination of such food fish products in this technical regulation and (or) in the document according to which products, and establishments of identity of indicators to authentic natural samples, including using methods of specific identification of fish, water invertebrates and other water animals, and also seaweed and other water plants are made.

6. The organoleptic method is applied if food fish products cannot be identified by method according to the name and visual method.

7. The analytical method is applied if food fish products cannot be identified by method according to the name, visual or organoleptic by methods.

IV. Rules of the address of food fish products in the territory of the Union

8. Food fish products are released in the territory of the Union in case of its compliance to requirements of this technical regulation and other technical regulations of the Union (technical regulations of the Customs union) which action extends to it and provided that it underwent assessment of conformity according to the Section XI of this technical regulation.

9. In case of the address in the territory of the Union not processed food fish products of animal origin are followed by the veterinary certificate issued by authorized body of state member of the Union (further – state member), and the shipping documentation.

The processed food fish products of animal origin under control to veterinary control (supervision) moved between state members imported from the third countries or made in the territory of the Union are followed by the veterinary certificate issued by authorized body of state member without conducting veterinary and sanitary examination which confirms epizootic wellbeing.

The food fish products of plant origin which are in circulation shall be followed by the shipping documentation providing traceability of such products.

Each batch of food fish products of animal origin under control to veterinary control (supervision) is imported on the territory of the Union in the presence of the veterinary certificate issued by competent authority of the country of departure.

10. The food fish products which are conforming to requirements of this technical regulation and other technical regulations of the Union (technical regulations of the Customs union) which action extends to it, and underwent assessment of conformity are marked by single market circulation mark of the Union.

11. The address in the territory of the Union of the food fish products which are not conforming to requirements of this technical regulation and other technical regulations of the Union (technical regulations of the Customs union) which action extends to it, including food fish products expired is not allowed.

12. The food fish products which are not conforming to requirements of this technical regulation and other technical regulations of the Union (technical regulations of the Customs union) which action extends to it including food fish products expired, and also food fish products which owner cannot confirm origin of food fish products for ensuring its traceability are subject to retirement by the owner of food fish products independently or according to the instruction of authorized bodies of the state control (supervision) of state member.

V. Safety requirements of food fish products

13. Food fish products shall conform to the safety requirements established by this Section, to safety requirements according to appendices No. 1, and also to requirements of the technical regulation of the Customs union "About safety of food products" (TR CU 021/2011).

14. Food fish products shall be made of water biological resources, data of the planned monitoring of safety of the water biological resources performed by authorized bodies of state members, and the objects of aquaculture coming from farms (companies) safe in the veterinary relation. Taken (caught) of safe areas of production (catch) according to data of monitoring shall be posted on the Internet on the official sites of authorized bodies of state members.

15. The food products of aquaculture shall not contain natural or synthetic hormonal substances and genetically modified organisms.

The most admissible levels of content of remaining balance of veterinary medicines, growth factors of animals (including hormonal medicines), medicines (including antimicrobic means) which content in food products of aquaculture of animal origin is controlled based on information on their application (except for levomitsetin (chloramphenicol), tetracycline group and bacitracin) provided by the manufacturer (authorized by the manufacturer person, the importer) in case of its release in the address in the territory of the Union, shall not exceed the admissible levels established by appendix No. 2 to this technical regulation.

16. The following food fish products are not allowed to the address in the territory of the Union:
