About approval of the Procedure for information exchange between the State register of the rights to real estate and the Unified register of documents which grant the right to accomplishment of preparatory and construction works and witness acceptance in operation finished with construction of facilities, data on return to completion, refusal in issue, cancellation and cancellation of the specified documents

According to Item 12 of the Procedure for state registration of the rights to real estate and their encumbrances approved by the resolution of the Cabinet of Ministers of Ukraine of December 25, 2015 No. 1127, and for the purpose of ensuring information exchange between the State register of the rights to real estate and the Unified register of documents which grant the right to accomplishment of preparatory and construction works and witness acceptance in operation finished with construction of facilities, data on return to completion, refusal in issue, cancellation and cancellation of the specified documents of PRIKAZYVAYEM:

1. Approve the Procedure for information exchange between the State register of the rights to real estate and the Unified register of documents which grant the right to accomplishment of preparatory and construction works and witness acceptance in operation finished with construction of facilities, data on return to completion, refusal in issue, cancellation and cancellation of the specified documents which is applied.

2. To the technical administrator of the State register of the rights to real estate and the State architectural building control department of Ukraine to take the adequate measures necessary for implementation of this order.

3. To department of private law of the Ministry of Justice of Ukraine () submit A.N. Ferens this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

4. This order becomes effective from the date of, its official publication following behind day.

5. To impose control of execution of this order:

in the Ministry of Justice of Ukraine - on the first deputy Minister Sevostyanova N. I.;

in the Ministry of Regional Development, Construction and Housing - on the deputy minister Partskhaladze L. R.

Procedure for information exchange between the State register of the rights to real estate and the Unified register of documents which grant the right to accomplishment of preparatory and construction works and witness acceptance in operation finished with construction of facilities, data on return to completion, refusal in issue, cancellation and cancellation of the specified documents

1. This Procedure determines the mechanism of information exchange between the State register of the rights to real estate (further the State register is right) and the Unified register of documents which grant the right to accomplishment of preparatory and construction works and witness acceptance in operation finished with construction of facilities, data on return to completion, refusal in issue, cancellation and cancellation of the specified documents (further the Unified register of documents).

In this Procedure terms are used in the values given in the Laws of Ukraine "About state registration of the rights to real estate and their encumbrances", "On regulation of town-planning activities" and other regulatory legal acts adopted according to the specified laws.

2. Information exchange is performed at the central level in electronic form on telecommunication channels.

3. Information exchange according to this Procedure is performed free of charge.

4. Information exchange is provided the technical administrator of the State register of the rights and the State architectural building control department of Ukraine.

5. The means of cryptographic information security having the certificate of conformity or the positive expert opinion by results of state examination in the field of cryptographic information security are applied to information security.

6. When implementing information exchange information systems are involved:

The Ministries of Justice of Ukraine - the State register is right;

The state architectural building control department of Ukraine - the Unified register of documents.

7. The information access about documents which are considered in the Unified register of documents is provided by forming by the state registrar of the rights to real estate by means of software of maintaining the State register of the rights of search query on type and number of the relevant document.

The technical administrator of the State register of the rights provides transfer to the Unified register of documents of data on the document which is specified in search query, along with forming of such request.

8. The state architectural building control department of Ukraine in real time transfers to the State register of the rights of the data on the document in case of its availability in the Unified register of documents by the criteria specified in search query.

The technical administrator of the State register of the rights provides to the state registrar of the rights to real estate access to the data received from the Unified register of documents.

9. The structure and format of the information files transferred and accepted according to the procedure of information exchange of the procedure of interaction of information systems and change in them are determined by the Ministry of Justice of Ukraine and the State architectural building control department of Ukraine by adoption of joint decisions which are drawn up by the separate protocols prepared based on this Procedure.

Information files shall contain complete up-to-date information about the document which is considered in the Unified register of documents.
