About standardization and certification

This Decree determines legal and economic basis of systems of standardization and certification, establishes organizational forms of their functioning in the territory of Ukraine.

Section I General provisions

Article 1. Decree scope

Operation of the Decree extends to the companies, organizations and the organizations irrespective of the patterns of ownership and types of activity operating in the territory of Ukraine and also to citizens - subjects of business activity.

Provision of the Decree do not extend to obligatory certification of products which is foodstuff.

The Section IV Certification of Products in the state system of certification

Article 13. Types and purpose of certification of products in the state system of certification

Certification of products in the state system of certification shares on obligatory and voluntary.

Certification of products in the state system of certification is performed by the certification bodies appointed to that - the companies, organizations and the organizations on purpose:

prevention of sales of products, life-threatening, health and property of citizens and surrounding environment;

assistance to the consumer in the competent choice of products;

creations of conditions for participation of subjects of business activity in international economic, sci-tech cooperation and international trade.

Article 14. State system of certification

1. The central executive body providing forming of state policy in the sphere of technical regulation:

determines the basic principles, structure and rules of the state system of certification;

approves the list of products which are subject to obligatory certification and determines terms of its implementation;

establishes requirements to the appointed certification bodies in the state system of certification (further - the appointed body);

establishes rules of recognition of certificates of conformity of other states;

performs other powers determined by the laws of Ukraine.

2. The central executive body realizing state policy in the sphere of technical regulation:

appoints the certification bodies accredited by national authority of Ukraine on accreditation and if the national authority of Ukraine on accreditation does not perform accreditation on the corresponding types of activity on certification, - national authority on accreditation of other state;

considers matters of argument on carrying out certification;

exercises the state supervision of observance by certification bodies of rules and procedure for certification of products by carrying out scheduled and unscheduled inspections;

keeps the Register of the state system of certification (further - the Register);

will organize information support concerning certification;

performs other powers determined by the laws of Ukraine.

Article 14-1. Register and introduction in it of data on certificates of conformity and certificates on recognition of compliance

1. Certificates of conformity and certificates on recognition of compliance are registered in the Register on a grant basis based on the decision on issue of certificates of conformity and certificates on recognition of compliance made by certification bodies.

2. Requirements to contents of information on the made decisions on issue, refusal in issue, cancellation, suspension of action of certificates of conformity or certificates on recognition of compliance which moves for inclusion in the register, and procedure for maintaining the Register are established by the central executive body, providing forming of state policy in the sphere of technical regulation.
