Certification about products and services

(as amended on 20-01-2016)

This Law establishes legal, economic and organizational basis of certification of products, services and other objects including production processes, systems of management, the specialists applying for participation in the field of assessment of conformity in quality personnel (further - products) in the Republic of Uzbekistan, and also the rights, obligations and responsibility of participants of certification.

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are applied:

"national system of certification" - the system which is operating at the national level, having own rules of procedure and managements for carrying out certification;

"certification of products" (further - certification) - activities for confirmation of conformity of products to the established requirements;

"certificate of conformity" - the document issued by rules of system of certification for confirmation of conformity of the certified products to the established requirements;

"mark of conformity" - the sign registered in accordance with the established procedure which marks products or documentation on services, for specifying of the fact that these products or service conform to the specific standard or other regulating document;

"system of certification of products (works, services) "the system of certification relating to certain products, works or services to which the same specific standards and rules are applied;

"the expert-auditor in quality" - the specialist certified in the procedure established by the legislation, having the corresponding qualification for work in the field of assessment of conformity;

"inspection certification body" - the legal entity accredited in the procedure established by the legislation, exercising at the request of certification bodies inspection check-up behind the certified products;

"certified products inspection check-up" - the procedure of periodic repeated assessment of the certified products performed for the purpose of confirmation of its compliance to the requirements established in case of certification;

Article 2. Purposes and tasks of certification

Certification is performed for the purpose of:

control of sales of products, life-threatening, human health, property of legal entities and physical persons, environment;

ensuring product competitiveness in the world market;

creations of conditions for participation of domestic and joint businesses, entrepreneurs in international economic, sci-tech cooperation and international trade;

consumer protections from bad faith of the manufacturer (the seller, the contractor);

confirmations of the indicators of product quality declared by the manufacturer (the seller, the contractor).

Certification has binding and voluntary nature.

Article 3. Legislation on certification

The relations in the field of certification are governed by this Law and other acts of the legislation of the Republic of Uzbekistan issued according to it, and in the Republic of Karakalpakstan - also the legislation of the Republic of Karakalpakstan.

Article 4. International contracts and agreements

If the international treaty or the agreement establish other rules, than stipulated by the legislation about certification, then rules of the international treaty or the agreement are applied.

Article 5. Bodies of the Republic of Uzbekistan on certification

The Uzbek agency of standardization, metrology and certification (further the Uzstandart agency) is national authority on certification of the Republic of Uzbekistan.

The Uzstandart agency according to this Law:

performs state policy in the field of certification, establishes general rules on carrying out certification, publishes official information on them;

develops drafts of programs for enhancement of system of certification and their representation for consideration of the government;

in coordination with the Cabinet of Ministers of the Republic of Uzbekistan makes decisions on accession to the international systems of certification, and also signs agreements on mutual recognition of results of certification, represents the Republic of Uzbekistan in relations with other states and in the international organizations for certification;

determines the list of products which are subject to obligatory certification and submits it for approval in the Cabinet of Ministers of the Republic of Uzbekistan;

keeps the state registers of the certified products, the certified experts-auditors for quality;

exercises the state supervision of observance of requirements of obligatory certification;

suspends and cancels certificates of conformity and marks of conformity for violation of regulations of the legislation on certification.

Sources of financing of activities of the Uzstandart agency in the field of certification are the means of the Government budget of the Republic of Uzbekistan, and also service fee rendered by the Uzstandart agency.

Accredited bodies on certification of products:

create systems of certification of products and provide their functioning;

will organize and carry out certification;

draw up, issue the national or recognize foreign certificates of conformity;

exercise control of the certified products.

Test laboratories (centers) accredited in the procedure established by the corresponding system of certification perform testing of specific products or specific types of testing and issue protocols for the purposes of certification.

The Uzstandart agency has the right to delegate part of the functions to certification bodies of products and test laboratories (centers).

Article 6. Objects and subjects of certification

Subject to certification are products, including program and other scientific and technical products.

Subjects of certification are the Uzstandart agency, accredited bodies on certifications, test laboratories (centers), inspection certification bodies, experts-auditors in quality, the personnel which are taking part in activities for assessment of conformity and also legal entities and physical persons which products are subject to certification.

Chapter II. General requirements to activities for certification

Article 7. Certificate of conformity and mark of conformity

In case of confirmation of conformity of products to the established requirements by the certification body issues the certificate of conformity based on which the manufacturer has the right to use mark of conformity.

Samples of certificates of conformity, forms and the sizes of national mark of conformity used in system of certification affirm by the Uzstandart agency.
