Based on part two of Item 16 of the Regulations on implementation of activities in the field of the gaming approved by the Presidential decree of the Republic of Belarus of January 10, 2005 No. 9, the Ministry of Taxes and Tax Collection of the Republic of Belarus DECIDES:

1. Approve the enclosed Instruction about procedure for entering of data into the list of the physical persons limited in visit of gambling institutions, virtual gambling institutions and participation in gamblings, maintaining and finishing it to data of organizers of gamblings and also provisions of access to it.

2. Declare invalid the resolution of the Ministry of Taxes and Tax Collection of the Republic of Belarus of November 30, 2012 No. 36 "About procedure for maintaining and bringing to data of organizers of gamblings of the list of the physical persons limited in visit of gambling institutions" (The national legal Internet portal of the Republic of Belarus, 27.12.2012, 8/26667).

3. This resolution becomes effective since February 28, 2017.

The instruction about procedure for entering of data into the list of the physical persons limited in visit of gambling institutions, virtual gambling institutions and participation in gamblings, maintaining and finishing it to data of organizers of gamblings and also provisions of access to it

Chapter 1 General provisions

1. This Instruction establishes procedure for introduction of information about the physical persons limited in visit of gambling institutions, virtual gambling institutions and participation in gamblings (further - data), in the list of the physical persons limited in visit of gambling institutions, virtual gambling institutions and participation in gamblings (further - the list), maintaining, finishing it to data of organizers of gamblings, and also provision of access to it.

2. For the purposes of this Instruction terms and their determinations in the values determined by the Regulations on implementation of activities in the field of gaming approved by the Presidential decree of the Republic of Belarus of January 10, 2005 No. 9, Regulations on procedure for functioning of the special computer cash system providing control of turnovers in the field of gaming, and the monitoring center in the field of gaming for its servicing, with the approved resolution of Council of Ministers of the Republic of Belarus of December 29, 2011 to No. 1762 are used.

3. Maintaining the list, finishing it to data of organizers of gamblings and provision of access to it are performed by "Monitoring Center for Gaming" limited liability company (further - the monitoring center) by means of use of the special computer cash system providing control of turnovers in the field of gaming (further - SKKS), according to the requirements established by this Instruction, and also the regulations of functioning of SKKS.

Entering into the list of information about the physical persons who submitted the application for restriction of in visit of gambling institutions, virtual gambling institutions and participation in gamblings (further - the statement), is performed by authorized workers of the organizer of gamblings.

Entering into the list of information about the physical persons limited in visit of gambling institutions, virtual gambling institutions and participation in gamblings according to decisions or determinations of courts is performed by authorized employees of the monitoring center.

Adjustment of the data containing in the list is performed by authorized employees of the monitoring center.

4. When maintaining the list by the monitoring center it is provided:

4.1. possibility of entering of data into the list by authorized workers of the organizer of gamblings;

4.2. the round-the-clock provision to authorized workers of organizers of gamblings in real time access to the data containing in the list including for the purpose of check and identification of the physical persons limited in visit of gambling institutions, virtual gambling institutions and participation in gamblings;

4.3. possibility of introduction by authorized employees of the monitoring center of data:

on decisions of the courts about restriction of physical person in visit of gambling institutions, virtual gambling institutions and participation in gamblings (further - decisions of the courts);

by determinations of courts about acceptance concerning physical person of measure for ensuring execution of the executive document in the form of temporary restriction in visit of gambling institutions, virtual gambling institutions and participation in gamblings or about cancellation of such measure (further - determinations of courts);

4.4. possibility of adjustment by authorized employees of the monitoring center of the data containing in the list, according to the procedure, established by this Instruction;

4.5. information security in case of its obtaining, transfer, use, processing, storage, representation according to requirements of the legislation on information, informatization and information security;

4.6. use of means of cryptographic protection of data according to requirements of technical regulatory legal acts.

5. Are brought in the list:

surname, own name, middle name (if that is available) the physical person limited in visit of gambling institutions, virtual gambling institutions and participation in gamblings;

data of the identity document of the physical person limited in visit of gambling institutions, virtual gambling institutions and participation in gamblings (the name of the document, series (in the presence), number, date of issue, the name of the state body which issued the document (if the document is issued by state body of the Republic of Belarus), identification number (if that is available), the official name of the foreign state which issued the document);

term of refusal of physical person of visit of gambling institutions, virtual gambling institutions and participation in gamblings;

date of submission of the statement by physical person;

the term of restriction of physical person in visit of gambling institutions, virtual gambling institutions and participation in gamblings by a court decision;

the name of the court which passed the judgment, date and number (in the presence) of the judgment;

the name of the court which took out determination of court, date and number (in the presence) of determination of court, the date of entry into force of determination of court;

date of inclusion in the list of data;
