About approval of Single rules and regulations of providing quarantine of plants on customs area of the Eurasian Economic Union

According to Item 19 of the Protocol on use of sanitary, veterinary and sanitary and quarantine phytosanitary measures (appendix № 12 to the Agreement on the Eurasian Economic Union of May 29, 2014) and Item 59 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Council of the Eurasian economic commission decided:

1. Approve the enclosed Single rules and regulations of providing quarantine of plants on customs area of the Eurasian Economic Union.

2. This Decision becomes effective since July 1, 2017.

Single rules and regulations of providing quarantine of plants on customs area of the Eurasian Economic Union

I. General provisions

1. This document is developed according to Item 19 of the Protocol on use of sanitary, veterinary and sanitary and quarantine phytosanitary measures (appendix № 12 to the Agreement on the Eurasian Economic Union of May 29, 2014).

2. Concepts which mean the following are hereunder used:

"harmful organism" – the any kind, version or biotype of plants, animal or pathogenic agents harmful to plants or vegetable products;

"quarantine phytosanitary inspection" – the event held by authorized body on quarantine of plants of state member of the Eurasian Economic Union during certain limited period of time for identification of the quarantine objects which are present at this territory in this production site or other quarantinable object;

"the center of quarantine object" – the revealed isolated population of quarantine object or sharp significant increase in number of population of the acclimatized quarantine object in this zone;

"the owner (user) of quarantinable object" – the owner of quarantinable object or the other person authorized on implementation of transactions and (or) other actions on behalf of the owner of quarantinable object.

3. Other concepts used hereunder are applied in the values established by the Agreement on the Eurasian Economic Union of May 29, 2014, the Customs Code of the Customs Union and the International convention on quarantine and protection of plants against December 6, 1951 (further – the Convention).

II. Quarantine phytosanitary inspections

4. Quarantinable objects are subject to quarantine phytosanitary inspections.

5. Quarantine phytosanitary examinations are conducted by authorized body on quarantine of plants of state member of the Eurasian Economic Union (further respectively – authorized body, state member, the Union) in the following purposes:

a) early identification of quarantine objects;

b) establishment (refining) of borders of the center of quarantine objects;

c) updating of the single list of quarantine objects of the Union (further – the single list) and the single quarantine phytosanitary requirements imposed to quarantine products and quarantinable objects on customs border and on customs area of the Eurasian Economic Union (further – single quarantine phytosanitary requirements).

6. Quarantine phytosanitary examinations are conducted according to the plan approved by authorized body.

7. Planning of actions for carrying out quarantine phytosanitary inspections of quarantinable objects is determined:

a) administrative-territorial division of state member;

b) biology of quarantine object and (or) harmful organism;

c) distribution of the plants owners (cultivated and wild-growing), struck by quarantine objects;

d) in the possible ways of penetration and distribution of quarantine object;

e) storage locations, productions, conversions, realization and utilizations of quarantine products;

e) places of concentration of the reaped crop;

g) the used grades of cultural plants.

8. During the planning and organization of events on carrying out quarantine phytosanitary inspections of special attention require:

a) the places and sites of production intended for cultivation of seed and landing material;

b) the crops and landings executed by import seed and landing material.

9. Time of carrying out quarantine phytosanitary inspections is determined:

a) cycle of development of quarantine objects;

b) phases of development of the plants struck by quarantine objects;

c) time of carrying out programs of localization and liquidation of the centers of quarantine objects.

10. Quarantine phytosanitary examinations are conducted according to techniques of carrying out quarantine phytosanitary inspections.

11. Results of quarantine phytosanitary inspections are drawn up according to the legislation of state members and are the basis for establishment of quarantine phytosanitary condition of the territories of state members.

12. Owners (users) of quarantinable objects shall conduct examination of quarantinable objects on availability of quarantine objects and in case of their identification to inform on it authorized body of state member in the territory of which there are such quarantinable objects.

13. Actions for identification of quarantine objects and fight against them, and also for localization and liquidation of their centers are performed at the expense of means, stipulated by the legislation state members.

14. Authorized bodies annually communicate about quarantine phytosanitary condition of the territories of the states, and also provide the specified information in the Eurasian economic commission for publication on the official site of the Union in the Internet.
