About approval of the Regulations on personnel reserve of federal state body, personnel reserve of body of the public power of the federal territory

(as amended on 19-09-2024)

According to part 11 of article 64 of the Federal Law of July 27, 2004 "About the public civil service of the Russian Federation" I decide No. 79-FZ:

1. Approve the enclosed Regulations on personnel reserve of federal state body, personnel reserve of body of the public power of the federal territory.

2. This Decree becomes effective from the date of its official publication.

Regulations on personnel reserve of federal state body, personnel reserve of body of the public power of the federal territory

I. General provisions

1. This Provision determines procedure for forming of personnel reserve of federal state body, personnel reserve of body of the public power of the federal territory (further also - personnel reserve) and works with them.

2. The personnel reserve is created for the purpose of:

a) ensuring equal access for citizens of the Russian Federation (further - citizens) to Federal public civil service (further - Federal civil service);

b) timely replacement of positions of Federal civil service;

c) assistance to forming of highly professional personnel structure of Federal civil service;

d) assistance to the official growth of federal government civil servants (further - civil servants).

3. The principles of forming of personnel reserve are:

a) voluntariness of inclusion of civil servants (citizens) in personnel reserve;

b) publicity when forming personnel reserve;

c) respect for equal rights of citizens in case of their inclusion in personnel reserve;

d) priority of forming of personnel reserve on competitive basis;

e) accounting of the current and perspective demand in replacement of positions of Federal civil service in federal state body or body of the public power of the federal territory (further also - state body);

e) interrelation of official growth of civil servants with results of assessment of their professional level;

g) the personal responsibility of the head of state body (further - the employer's representative) for quality of selection of civil servants (citizens) for inclusion in personnel reserve and creation of conditions for the official growth of civil servants;

h) objectivity of assessment of professional level, professional and personal qualities of civil servants (citizens) applying for inclusion in personnel reserve taking into account experience of their work in federal state bodies, bodies of the public power of the federal territory, state bodies of subjects of the Russian Federation, local government bodies, the organizations.

4. Ceased to be valid according to the Presidential decree of the Russian Federation of 19.09.2024 No. 813

5. Information on forming of personnel reserve and work with it is posted on the official sites of state body and the state information system in the field of public service on the Internet (further - Internet network) according to the procedure, determined by the Government of the Russian Federation.

II. Procedure for forming of personnel reserve

6. The personnel reserve is created by the employer's representative.

7. The personnel work connected with forming of personnel reserve, the organization of work with it and its effective use is performed by division of state body concerning public service and personnel.

8. Join in personnel reserve:

a) the citizens applying for replacement of vacant position of Federal civil service:

by results of tender on inclusion in personnel reserve;

by results of tender on replacement of vacant position of Federal civil service with the consent of the specified citizens;

b) the civil servants applying for replacement of vacant position of Federal civil service according to the procedure of official growth:

by results of tender on inclusion in personnel reserve;

by results of tender on replacement of vacant position of Federal civil service with the consent of the specified civil servants;

by results of certification according to Item 1 of part 16 of article 48 of the Federal Law of July 27, 2004 No. 79-FZ "About the public civil service of the Russian Federation" with the consent of the specified civil servants;

c) the civil servants dismissed from Federal civil service:

on the basis, stipulated in Item 8.2 or 8.3 parts 1 of article 37 of the Federal Law of July 27, 2004 No. 79-FZ "About the public civil service of the Russian Federation", - according to the decision of the representative of the employer of state body in which positions of Federal civil service, or state body to which functions of the abolished state body, with the consent of the specified civil servants are transferred are reduced;

on one of the bases provided by part 1 of article 39 of the Federal Law of July 27, 2004 No. 79-FZ "About the public civil service of the Russian Federation" with the consent of the specified civil servants;

in case of impossibility of the translation of the specified civil servants according to Items 3 - 5, 9, 12 - 14 parts 5 of article 28 of the Federal Law of July 27, 2004 No. 79-FZ "About the public civil service of the Russian Federation" to other position of Federal civil service in connection with its absence or in case of their refusal of the translation according to article 28 of the called Federal Law, - according to the decision of the representative of the employer with the consent of the specified civil servants.

9. Competition on inclusion of civil servants (citizens) in personnel reserve is held according to the regulations provided by the Section III of this provision.

10. Civil servants (citizens) who are specified in paragraph three of the subitem "an" and the paragraph third the subitem "b" of Item 8 of this provision and did not become winners of tender on replacement of vacant position of Federal civil service, however professional level which professional and personal qualities were highly appreciated by the contest committee, according to the recommendation of this commission from their consent join in personnel reserve for replacement of positions of Federal civil service of the same group to which the vacant position of Federal civil service on which replacement competition was held belonged.

11. Civil servants who are specified in paragraph four of the subitem "b" of Item 8 of this provision and who by results of certification are acknowledged as certifying commission corresponding to the replaced position of Federal civil service and are recommended by it for inclusion in personnel reserve for replacement of vacant position of Federal civil service according to the procedure of official growth, from their consent join in personnel reserve within one month after carrying out certification.
