About ensuring effective use of gas-distribution systems or their components

According to the paragraph to the second part one of article 37 of the Law of Ukraine "About the natural gas market", Article 5, to Item "About management of objects of state-owned property" and article 179 of the Economic code of Ukraine the Cabinet of Ministers of Ukraine decides 16 parts one of article 6 of the Law of Ukraine:

1. Approve enclosed:

Standard agreement of lease of gas-distribution systems or their components;

Approximate agreement of operation of gas-distribution systems or their components.

2. Determine the Department of Energy governing body of gas-distribution systems which owner is the state, or their compound (further - gas-distribution systems).

3. Bring in the resolution of the Cabinet of Ministers of Ukraine of May 25, 1998 No. 747 "About creation of National joint stock company "Naftogaz of Ukraine" - with the changes made by resolutions of the Cabinet of Ministers of Ukraine of August 20, 2012 No. 770 (The Official Bulletin of Ukraine, 2012, No. 63, the Art. 2576) and of September 30, 2015 No. 796 (The Official Bulletin of Ukraine, 2015, No. 81, the Art. 2700), changes which are applied.

4. To the Ministry of Energy and Coal Industry together with operators of gas-distribution systems for the purpose of settlement of use of gas-distribution systems before entry into force of paragraph two of Item 1 of this resolution to accept stipulated by the legislation measures, in particular for the conclusion till April 10, 2017 of agreements of operation of gas-distribution systems or their components which will become effective since May 1, 2017.

5. To provide to the Ministry of Energy and Coal Industry together with Fund of state-owned property carrying out:

1) till December 1, 2017:

inventory counts of gas-distribution systems which are considered on balance of operators of gas-distribution systems;

verifications of presence of documents of title on the state-owned property used for distribution of natural gas, and in case of need their recoveries according to results of the inventory count which is carried out according to the paragraph the second this subitem;

2) in the procedure established by the legislation till December 31, 2018 of certification of gas-distribution systems.

6. To provide to fund of state-owned property together with the Ministry of Energy and Coal Industry carrying out in accordance with the established procedure independent assessment of gas-distribution systems according to results of the inventory count which is carried out according to the paragraph to the second the subitem 1 of Item 5 of this resolution.

7. This resolution becomes effective from the date of its publication, except Item paragraph two 1, which becomes effective along with entry into force of the law on removal of prohibition on transfer of gas-distribution systems to lease.

Changes which are made to the resolution of the Cabinet of Ministers of Ukraine of May 25, 1998 No. 747

2. In appendix 3 to the resolution:
