1. Approve enclosed:

1) the commitment form on provision of investment preferences within implementation of the special investment project, according to appendix 1 to this order;

2) Regulations of Admission and registration of the request for provision of investment preferences within implementation of the special investment project, according to appendix 2 to this order.

2. To provide to committee on investments of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in printing and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective from the date of its first official publication.

Regulations of Admission and registration of the request for provision of investment preferences within implementation of the special investment project

Chapter 1. General provisions

1. These rules of acceptance and registration of the request for provision of investment preferences within implementation of the special investment project (further - Rules) are developed according to Item 1-1 of article 292 of the Entrepreneurial code of the Republic of Kazakhstan and determine procedure for acceptance and registration of the request for provision of investment preferences within implementation of the special investment project.

2. In these rules the following concepts are used:

1) the applicant - the legal entity of the Republic of Kazakhstan who submitted the application for provision of investment preferences within implementation of the special investment project;

2) the special investment project - the investment project implemented (implemented) by the legal entity of the Republic of Kazakhstan registered as the participant of special economic zone or the owner of free warehouse according to the customs legislation of the Republic of Kazakhstan, and (or) acquired at the participant of special economic zone or implemented by the legal entity of the Republic of Kazakhstan who signed the agreement on industrial assembly of motor vehicles.

Chapter 2. Procedure for acceptance and registration of the request for provision of investment preferences within implementation of the special investment project

3. The applicant to authorized body according to the conclusion of special investment contracts (further - Authorized body) electronically or on paper submits the application for provision of investment preferences within implementation of the special investment project (further - the request) in form according to appendix 1 to this order.

4. The following documents are attached to the request:

1) certificate of state registration (re-registration) of the legal entity;

2) the copy of the registration certificate as the participant of special economic zone for the participant of special economic zone, or the statement from the register of owners of free warehouses or the copy of the order on inclusion in the register of free warehouses for the owner of free warehouse;

3) for the implemented projects - copies of the documents confirming input of the fixed assets;

for implementable projects - copies of the documents proving the estimated cost of installation and construction works and purchase costs of the fixed assets, the raw materials and (or) materials used in case of implementation of the investment project, certified by the signature of the head and seal (in the presence) of the legal entity.
