Approve the Procedure for maintaining the register of the heatsupplying and heatgenerating organizations, the companies of centralized water supply and water disposal participating in the procedure of settlement of debt and use of the specified register which is attached.

Procedure for maintaining the register of the heatsupplying and heatgenerating organizations, the companies of centralized water supply and water disposal participating in the procedure of settlement of debt and use of the specified register

1. This Procedure determines the mechanism of forming, maintaining the register of the heatsupplying and heatgenerating organizations, the companies of centralized water supply and water disposal participating in the procedure of settlement of debt (further - the register), and also uses of its data.

2. In this Procedure terms are used in the value given in the Law of Ukraine "About the measures directed to settlement of debt of the heatsupplying and heatgenerating organizations and the companies of centralized water supply and water disposal" (further - the Law).

3. The register is created for the purpose of ensuring collection, accumulating, processing, protection, accounting and provision of information on the heatsupplying and heatgenerating organizations, the companies of centralized water supply and water disposal participating in the procedure of settlement of debt according to the Law (further - the companies).

4. Forming and maintaining the register is performed by the Ministry of Infrastructure in the way:

data collection and processing about the companies;

entering of data into the register and changes to them, and also exceptions of such data from the register.

5. The decision on inclusion of the company in the register or on refusal in its inclusion is accepted by the head of the Ministry of Infrastructure or the official authorized by it during one calendar month from the date of receipt of the statement for inclusion of the company in the register and is posted on the official site of the Ministry of Infrastructure, except cases of restriction of open access to the register, stipulated by the legislation.

6. Ministry of Infrastructure:

provides technical functioning of the register, preserving information and protection it from unauthorized access and damage;

creates and keeps the register;

reports to the companies about inclusion them in the register, decision making about refusal in such inclusion (with indication of cause of failure), change of data on the specified companies in the register and exception of it;

performs acceptance, accounting and processing of requests of users of the register;

performs acceptance, accounting and document storage, received in the course of forming and maintaining the register;

uses information containing in the register for accomplishment of provisions of the Law;

provides placement of the register and decisions on inclusion in the register, exception of it or refusal in inclusion in the register of the companies on the official site of the Ministry of Infrastructure.

The Ministry of Infrastructure provides timely forming of the register, compliance of the data on the company entered in it to documents based on which registration and storage of information connected with its forming and maintaining is performed.

The Ministry of Infrastructure determines the list of persons having the right to enter data in the register, to change data in the register, to process and store the documents connected with its functioning.

7. Performance of works, connected with forming and maintaining the register, is performed within the means provided on content of the office of the Ministry of Infrastructure.

8. For inclusion of the companies in the register (on each creditor separately) and modification of the company of it submit to the Ministry of Infrastructure the application to which enclose the documents provided in paragraphs the second - the seventh part two of article 3 of the Law.

The submitted documents are signed certified) by person, the representative to act on behalf of the company (the documents confirming powers of such person are attached to document package), and the companies are sealed (in the presence).

9. The Ministry of Infrastructure can refuse to the company inclusion in the register for the bases determined by paragraphs the twelfth - the fourteenth parts two of article 3 of the Law.

10. The exception of the company of the register is performed on the bases determined by paragraphs the second - the fourth part three of article 3 of the Law, on each creditor separately.

The decision on exception of the company of the register is made by the head of the Ministry of Infrastructure or the official authorized by it in ten-day time from the date of receipt of the reasonable address from the corresponding creditor.

The company is considered excluded from the register on certain creditors (record is made in the corresponding line), from the next day after acceptance by the head of the Ministry of Infrastructure or the official of the decision on exception of such company of the register and introduction of the corresponding record authorized by it in it.

11. The information system of the register is data set and the documents providing forming and maintaining the register. The specified system consists from:

the supporting documents determined by part two of article 3 of the Law.

12. The register is kept in electronic form and stored on electronic media.

All entries in the register are carried out in Ukrainian.

13. The register is kept with ensuring preserving the documents which formed the basis for its forming and introduction in it of changes, and also possibility of recovery of the data on the companies entered in it.

The data containing in the register remain the Ministry of Infrastructure at least three years from the moment of the termination of maintaining the register.

14. In the register the following data on the company are specified:

full name of the legal entity;

code according to EGRPOU;

the paragraph the fourth is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 20.10.2021 No. 1097
