About approval of the Instruction on the organization of work of Service of fire safety of the Ministry of Internal Affairs

According to part seven of article 61 of the Code of civil protection of Ukraine, to the resolution of the Cabinet of Ministers of Ukraine of October 28, 2015 No. 878 "About approval of the Regulations on the Ministry of Internal Affairs of Ukraine", for the purpose of implementation of single and system control over the implementation of fire safety regulations on objects of the Ministry of Internal Affairs of Ukraine I order:

1. Approve the Instruction on the organization of work of Service of fire safety of the Ministry of Internal Affairs which is attached.

2. To department of state-owned property and resources of the Ministry of Internal Affairs (Shaliyevskaya L. I.) provide submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. This order becomes effective from the date of its official publication.

4. To impose control of execution of this order on the deputy minister of internal affairs - the chief of staff Takhtaya of A.V.

Instruction on the organization of work of Service of fire safety of the Ministry of Internal Affairs

I. General provisions

1. This Instruction determines the main requirements for the organization and control by officials of Service of fire safety of the Ministry of Internal Affairs of Ukraine (further - SPB the Ministry of Internal Affairs) behind accomplishment of fire safety regulations in the office of the Ministry of Internal Affairs, territorial authorities, organizations, institutions and the companies belonging to the sphere of the Department of MIA and also in the territories in which they are located (further - objects of the Ministry of Internal Affairs).

2. This Instruction is developed according to requirements of the Code of civil protection of Ukraine and the resolution of the Cabinet of Ministers of Ukraine of October 28, 2015 No. 878 "About approval of the Regulations on the Ministry of Internal Affairs of Ukraine".

3. Officials of SPB the Ministry of Internal Affairs and officials of SPB in National guard of Ukraine (further - NSU), higher educational institutions of the Ministry of Internal Affairs (further - HIGHER EDUCATION INSTITUTION) exercise control in the field of fire safety by carrying out scheduled and unscheduled inspections of condition of observance (accomplishment) requirements of the legislation in the field of fire safety on objects of the Ministry of Internal Affairs.

4. Protection of life and health of workers are performed for the purpose of control of observance on objects of the Ministry of Internal Affairs of requirements of the legislation concerning fire safety, identification of violations and prevention of emergence of the fires and ignitions.

5. Officials of SPB the Ministry of Internal Affairs and officials of SPB in NSU and HIGHER EDUCATION INSTITUTIONS exercise control of fire protection systems, fireproof processing of building constructions (products, materials).

6. Are performed on the location of objects of the Ministry of Internal Affairs in the working hours established by employment policies and procedures in the presence of the head or person authorized by it.

7. Heads of objects of the Ministry of Internal Affairs shall allow freely officials of SPB for implementation of survey (inspection) of buildings, rooms, constructions, the equipment, the territory, to file for acquaintance documents, product samples, explanations, references, data, materials on the questions arising in case of control in the specified sphere, and also their copy.

8. SPB the Ministry of Internal Affairs and divisions of SPB in NSU, HIGHER EDUCATION INSTITUTIONS in the activities are guided by the Code of civil protection of Ukraine, Regulations on the Ministry of Internal Affairs of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of October 28, 2015 No. 878, the Fire safety regulations in Ukraine approved by the order of the Ministry of Internal Affairs of December 30, 2014 No. 1417, registered in the Ministry of Justice of Ukraine on March 5, 2015 at No. 252/26697, this Instruction and other regulatory legal acts concerning fire safety.

9. In this Instruction terms are used in the following values:

the official of SPB - person in accordance with the established procedure authorized on control in the field of fire safety on objects of the Ministry of Internal Affairs;

the instruction - the written requirement of the authorized officer of SPB, obligatory for accomplishment by the head of object of the Ministry of Internal Affairs, for elimination at the scheduled time of violations of requirements of the legislation in the field of fire safety which is constituted following the results of check;

II. Organization of conducting checks

1. Scheduled inspections:

1) scheduled inspections of objects of the Ministry of Internal Affairs are carried out according to verification plans which affirm quarterly to the 28th day of the last month of the quarter preceding planned;

2) scheduled inspections of objects of NSU are carried out according to verification plans which affirm the commander of NSU quarterly to the 25th day of the last month of the quarter preceding planned;

3) scheduled inspections of HIGHER EDUCATION INSTITUTIONS are carried out according to verification plans which affirm their heads monthly to the 25th preceding planned;

4) in the verification plan the name of object of the Ministry of Internal Affairs and its location are specified;

5) scheduled inspections of objects of the Ministry of Internal Affairs are carried out at least once a year;

6) in case of registration of new object during the period for which the verification plan is already approved the specified object joins in the verification plan for the next planning period;

7) for implementation of check of objects of the Ministry of Internal Affairs which provides official journey within Ukraine the order is issued;

8) check duration in the region is determined depending on quantity of objects which are in the field of the Department of MIA;

9) duration of scheduled inspection is determined depending on the area (territory) of object, the number of buildings, rooms and sites which are in the field of the Department of MIA.

2. Unscheduled inspection:

1) check which conducting is not provided by plans of checks is unplanned;
