About some questions of import to customs area of Ukraine and carrying out the first state registration of vehicles

For the purpose of regulation of the relations on import to customs area of Ukraine and carrying out the first state registration of the vehicles imported or made in Ukraine, and also step-by-step introduction in Ukraine of the international ecological requirements to vehicles the Verkhovna Rada of Ukraine decides:

1. Voided.

2. Customs clearance for the purpose of free circulation and the first state registration in Ukraine of the imported vehicles new and former in use, or made in Ukraine perform on condition of their compliance to environmental standards not lower than the EBPO-2 level according to technical regulations:

- for tractors of semitrailer trucks (truck tractors), buses and cars, wheel for transportation, - codes of goods items 8701 20, 8702 and 8703 according to UKT foreign trade activities - on January 1, 2006. This regulation is not extended till July 1, 2006 to the specified vehicles moved on customs area of Ukraine or made in Ukraine till December 31, 2005 inclusive, and vehicles on which till December 31, 2005 certificates of conformity are inclusive issued;

- for cargo vehicles and special purpose vehicles - codes of goods items 8704 and 8705 according to UKT foreign trade activities - since January 1, 2007.

The customs clearance for the purpose of free circulation and the first state registration in Ukraine of vehicles by codes of goods items 8701 20, of 8702, of 8704, 8705 according to UKT foreign trade activities both made in Ukraine, and imported on customs area of Ukraine, new and such that were in use, and new vehicles by code of goods item 8703 according to UKT foreign trade activities both made in Ukraine, and imported on customs area of Ukraine, is performed on condition of their compliance to environmental standards:

it is not lower than the EBPO-3 level - since January 1, 2013, except for it is not lower than the EBPO-3 level of vehicles made in Ukraine or imported on customs area of Ukraine before Date of Introduction of environmental standards as obligatory;

it is not lower than the EBPO-4 level - since January 1, 2014, except for it is not lower than the EBPO-4 level of vehicles made in Ukraine or imported on customs area of Ukraine before Date of Introduction of environmental standards as obligatory;

it is not lower than the EBPO-5 level - since January 1, 2016, except for of the vehicles made in Ukraine or imported on customs area of Ukraine till December 31, 2015 inclusive;

it is not lower than the EBPO-6 level - since January 1, 2025, except for of the vehicles made in Ukraine or imported on customs area of Ukraine till December 31, 2024 inclusive.

2-1. Environmental standards, test methods, designation of level of environmental standards, procedures of maintenance of the appropriate ecological level of wheel vehicles during all term of their operation are determined according to features of design of vehicles according to the Agreement on adoption of single technical instructions for wheel vehicles, pieces of the equipment and parts which can be established and/or used on wheel vehicles, and about conditions of mutual recognition of the official approvals issued on the basis of these instructions, concluded in 1958, with amendments of 1995 and the Rules of the Economic Commission for Europe of the UN attached to it according to the procedure, determined by the central executive body in the field of transport, road economy, tourism and infrastructure.

3. The document certifying compliance of vehicles to requirements of technical regulations is the certificate or other document on confirmation of conformity issued according to the legislation of Ukraine that specifies to what level of environmental standards there corresponds on design the vehicle ("EBPO-2" - "EBPO-6" or other level). Designation of level of environmental standards which there meets the vehicle shall be brought in the registration certificate of the vehicle.

3-1. Article 1 of this Law loses force from day of the entry of Ukraine into the World organization of trade.

3-2. Operation of articles 1 and 2 of this Law does not extend to vehicles which are imported on customs area of Ukraine temporarily, for the purpose of transit and in case of resettlement of citizens on the permanent residence into Ukraine, and also on:

cars of emergency medical service, vehicles of special purpose - the portable medical clinics recognized as the humanitarian assistance according to the Law of Ukraine "About the humanitarian assistance" which are imported for the purpose of free circulation and are classified by the following codes according to UKT foreign trade activities: 8703 23 19th 10, 8703 23 19th 30, 8703 23 90th 11, 8703 23 90th 13, 8703 23 90th 31, 8703 23 90th 33, 8703 24 10th 00, 8703 24 90th 10, 8703 24 90th 30, 8703 32 19th 00, 8703 32 90th 10, 8703 32 90th 30, 8703 33 19th 00, 8703 33 90th 10, 8703 33 90th 30, 8705 90 80 90;

cars the firefighters recognized by the humanitarian assistance according to the Law of Ukraine "About the humanitarian assistance" who are imported for the purpose of free circulation and are classified by code 8705 30 00 10 and 8705 30 00 90 according to UKT foreign trade activities.

the vehicles imported on customs area of Ukraine in customs regime of import for use in production of defense appointment if customer of such products is the state customer determined by the Cabinet of Ministers of Ukraine and/or for operation by such customer, classified by the following codes according to UKT foreign trade activities: 8701 30 00th 00, 8703 33 (except 8703 33 11th 00), 8704 (except commodity subcategories 8704 10 10th 10, 8704 21 10th 00, 8704 22 10th 00, 8704 23 10th 00, 8704 31 10th 00, 8704 32 10 00 and commodity category 8704 10 90).

3-3. Determine that till December 31, 2022 inclusive customs clearance for the purpose of free circulation and the first state registration in Ukraine of vehicles by codes of goods items 8702 (except commodity subcategories 8702 10 11th 30, 8702 10 19th 90, 8702 40 00th 10, 8702 40 00th 90, 8702 90 11 00 and 8702 90 19 00), 8704 (except commodity subcategories 8704 10 10th 90, 8704 22 10th 00, 8704 22 91 00, 8704 22 99th 00, 8704 23 10th 00, 8704 23 91 00 and 8704 23 99 00) and 8705 (except commodity subcategories 8705 10 00th 00, 8705 20 00th 00, 8705 30 00th 10, 8705 30 00 90 and 8705 90 80 90) according to the UKT foreign trade activities both made in Ukraine, and imported on customs area of Ukraine not lower than the EBPO-3 level is performed on condition of their compliance to environmental standards, and also under condition, what is the vehicles are imported on customs area of Ukraine by legal entities for own use and cannot be alienated by such persons within 1095 days from the date of their first state registration in Ukraine.

Operation of this article does not extend to vehicles which occur or are imported from the Russian Federation, the Republic of Belarus and temporarily occupied territories of Ukraine.
